RELEASE OF PERMANENT EASEMENT
This Release of Permanent Easement made the,, day of , 1998,
by the City of South Bend by and through its Board of Public Works, witnesseth:
Whereas, by a Dedication of Public Right -of -Way as Service Drive and Permanent Easement
dated the 11 th day of June, 1984, and recorded in St. Joseph County, grantor, the South Bend Public
Transportation Corporation did thereby grant to grantee, the City of South Bend, its successors and
assigns:
Parcel One
V
The east 21 feet of Lots 31, 32, 33,3 and 34 of the original
plat of the Town (now City) of South Bend, St. Joseph County,
Indiana, together with all that part of a 14-foot wide alley
lying between said Lots 33 and 34, more particularly described
as follows:
Beginning at the southeast corner of said Lot 31; thence West
on and along the south line of said Lot 31 a distance of
21.0 feet; thence North a distance of 278.541 feet to a point
on the north line of said Lot 34 that is 21.0 feet west of
the northeast corner of said Lot 34; thence East on and along said
north line of a distance of 21.0 feet to the northeast corner
of said Lot 34; thence South on and along the east lines of said
Lot 34, 33, 32 and 31 a distance of 278.5 feet to the point of
beginning
Parcel Two
A part of Lot 34 of the original plat of the town (now City)
of South Bend, St. Joseph County, Indiana and more particularly
described as follows:
Beginning at the northwest comer of said Lot 34, thence East
and on and along the north line of said Lot 34 to a point that
is 21.0 feet west of the northeast comer of said Lot 34, thence
deflecting right 120' from the prolongation of the preceding course
for a distance of 44.0 feet, thence deflecting left 30° from the
prolongation of the proceeding course for a distance of 106.62
feet parallel to the south line of said Lot 34, thence north on and along
the West line of said Lot 34 a distance of 28.0 feet to the point of
beginning.
Said tract contains 4472 square feet (0.103 acre).
Whereas, the City of South Bend has agreed to relinquish and release above described
easement.
Now this said Release of Permanent Easement witnesseth that, the City of South Bend
releases Permanent Easement and its rights thereunder, with the intent that the Public Right -of -Way
as Service Drive and Permanent Easement may be forever extinguished.
