GAMMON t Clerk ORDINANCE NO. 6942 -81 AN ORDINANCE APPROPRIATING $282,289.14 FROM THE WATER WORKS GENERAL FUND FOR CONTRACTUAL SERVICES BY CONVERSE /TEN -ECH AND APPROVING THE AWARD OF CONTRACTS AND EXPENDITURES FOR SERVICES BY CONVERSE /TEN -ECH STATEMENT OF PURPOSE AND INTENT: Converse /Ten -Ech Environmental Consultants has provided qualitative identification of contamination, hydrogeotechnical survey of ground water, monitoring of ground water to determine source and quantity of contaminants, design, and bidding of cor- rective action program. Converse /Ten -Ech Environmental Consultants will oversee the installation of the interceptor well system, provide start up and monitoring of the interceptor wells, soil and water sampling as needed, supervise removal of contaminated soil and provide advisory services concerning the Olive Street well field. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: SECTION I. The contracts between the Board of Works Commissioners and Converse /Ten -Ech Environmental Consultants for contractual services are approved. SECTION II. 'The sum of $282,289.14 is hereby appropriated as follows: Agreement No. 1: Work to include qualitative identification of contamination, hjydrogeotechnical survey of ground water, monitoring of ground water to determine source and quality of contaminants, design and bidding of corrective action program, $170,104.17. Agreement No. 2. Work to oversee installation of the interceptor well system, provide start up and monitoring of the interceptor wells, soil and water sampling as needed, supervise the removal of contaminated soil and provide advisory services, $112,184.97. SECTION III. The Common Council ratifies and approves the expenditures made to date for services performed by Converse /Ten- Ech Environmental Consultants under the contracts. SECTION IV. This ordinance shall be in full force and effect from and after its passage by the Common Council and signature by the Mayor. South Bend, Indiana Dear Council Members: There will be presented during first reading of the June 22, 1981 Council Meeting an ordinance approving two contracts between Converse /Ten -Ech Enrionmental Consultants and the Board of Water Works Commissioners of the City of South Bend. Additionally, that same ordinance will appropriate $285,000.00 to pay for those services previously rendered and those services anticipated to be needed to complete the clean up of the Olive Street well field. As I'm sure the Council is aware, Converse /Ten -Ech has been providing a variety of investigative, analytical, and engineering services in connection with the Olive Street well field contamin- ation since the problem was first discovered in March and April of 1980. All work performed was previously authorized by the Board of Water Works Commissioners through its use of emergency powers given to them by State Statutes and the State Board of Health. Since I started my current assignment March 9 of this year, one of my priorities has been to establish a cut off point for the emer- gency services, and come to the Council with an outline of what services had been provided, and what work still needed to be accom- plished to be certain the contamination problem was cleaned up and the well field placed back in proper service. The following is a synopsis of what each engineering agreement includes and the cost of those services. The document titled Agreement No. 1 entails work performed from April 29, 1980 to May 31, 1981. The work in that agreement was originally authorized under the emergency powers of the Board of Water Works Commissioners and has included; qualitative identifi- cation of contamination, hydrogeotechnical survey of ground water, monitoring of ground water to determine source and quantity of Council Members Page Two June 17, 1981 contaminants, design, and bidding of corrective action program. Additionally, Ten -Ech has provided numerous hours of laboratory services, technical answers to Ashland Chemical's questions and miscellaneous advisory services to the South Bend Water Works. This phase of the work or "Agreement No. 1" has been completed at a cost of $170,104.17. The actual services provided are defined in depth in Agreement No. 1. The document marked Agreement No. 2 is for services starting June 1, 1981 and would be completed at a time when the well field is sufficiently cleaned up as to put it into service on a perman- ent basis. During the proposed length of service under this agreement, Ten -Ech will oversee the installation of the interceptor well system, provide start up and monitoring of the interceptor wells, complete additional soil and water sampling as needed, supervise the removal of contaminated soil, and provide advisory services and expert testimony if needed. A complete list of services to be provided is in the detail of Agreement No. 2. I anticipate the cost of this contractual phase to not exceed a figure of $112,185.00. If a settlement is reached, then some of the work included in the contract will not be needed. I feel that Converse /Ten -Ech has put together a corrective program that will eliminate our current problem. Additionally the work that they have done to date, is the largest factor in our ability to pin point the pollution source and provide adequate corrective action. In reviewing these documents please keep in mind that the costs involved with the exception of some testimony related fees are all contained in our negotiations for recovery of damages which involves Ashland.
