AN ORDINANCE OF THE CITY OF SOUTH BEND SETTING
FEES CHARGED BY THE SOUTH BEND POLICE. DEPARTMENT
FOR CERTAIN SERVICES.
STATEMENT OF PURPOSE AND INTENT:
The Common Council of the City of South Bend finds that
costs are incurred by the South Bend Police Department in response
to individual requests for certain services, information, and
documents, which the Police Department staff supplies to non-
governmental and non - criminal justice agencies and individuals.
The costs of these services, information and documents should be
borne by those agencies and individuals which request these
matters rather than by the city as a whole. Therefore, a schedule
of fees for certain services, information and documents was approved
by the Board of Public Safety on June 9, 1981, and is set forth
below.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend that:
SECTION I. Definitions.
(a) "Governmental Agency" means any agency, board,
commission, department, bureau, or other entity
of local, state, or federal government.
(b) "Criminal Justice Agency" means any court or
any governmental agency or sub -unit thereof
which performs the administration of criminal
justice pursuant to a statute or executive order
and which allocates a substantial part of its
annual budget to the administration of criminal
justice. Included in this definition are
enforcement officers, prosecutors, probation
officers, and correctional institutions.
SECTION II. The South Bend Police Department is authorized to
charge t—he fees listed below for services requested by persons or
agencies which are not a governmental agency or criminal justice agency.
This fee schedule shall not apply to accident reports or any other
documents the charge for which is set by state statute.

SECTION III. All funds obtained from charges for services under
this Ordinance shall be placed in the General Fund of the City of
South Bend.
SECTION IV.
