(_Q'.f- AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA (Chanter 21, Municipal Code). BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. Ordinance No. 4990 -68, as amended, which ordi- nance is co— may known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: Lots 4 & 5 as shown on the recorded plat of Fred W. Keller' Subdivision of Lots 16, 17, 18 and 32 in Burrough's Sub- division of Bank Outlet 115 of the Third nlat of Outlots of the Town, now City, of South Bend, Indiana, platted by the State Bank of Indiana; excepting from said Lot 5, the following described tract in the Southwest corner thereof, bounded by a line running as follows, viz: Beginning at the Southwest corner of said Lot 5, running thence Easterly with the Southerly line of said Lot, 40 feet; thence North to a point 10 feet South of the North line of said Lot 5; thence Southwesterly parallel with the Northerly line of said Lot 5 to the Westerly line of said Lot; thence South on said West line to the place of beginning. be and the same is hereby established as B Residential, B Height and Area. We, the undersigned, make anplication and petition the Common Council of the City of South Bend, Indiana, to amend the Zoning Ordinance as herein requested. 1. JOHNSON Executive Director (219) 284 -9571 RE: A proposed ordinance and site development plan of Jerry G. and Norma Baughman, to zone from "A" Residential, "B" Height and Area to "B" Residential, "B" Height and Area, property located at 605 Portage Avenue, City of South Bend Gentlemen: The attached rezoning petition of Jerry G. and Norma Baughman was legally advertised May 9, 1981. The Area Plan Commission gave it a public hearing on May 19, 1981, at which time the following action was taken: Upon a motion by Joseph Serge, being seconded by Joseph Simeri and unanimously carried, the proposed ordinance and site development plan of Jerry G. and Norma Baughman, to zone from "A" Residential, "B" Height and Area to "B" Residential, "B" Height and Area, property located at 605 Portage Avenue, is sent to the Common Council with an unfavorable recommendation for the following reasons: 1. The pro- posed use and required parking area would create an intrusion into this residential neighborhood, and would encourage other conversions from residential to office or commercial uses along this section of Portage Avenue. 2. The use of the alley will introduce non - residential traffic onto a residential alley. 3. This is a very small lot with an irregular configuration. Parking and maneuvering room is very tight. In the Staff's opinion, it does not now work. The parking may not be able to be resolved. If the Council should rezone this site, it shall have to be subject to the submission of a final site plan.
