AMENDMENT TO OWNER-ENGINEER AGREEMENT Amendment No. 1 1.Background Data: a.Effective Date of Owner-Engineer Agreement:Original: May 28, 2024 b.Owner:City of South Bend, Indiana c.Engineer: Black & Veatch Corporation d.Project:PFAS Minimization Study 2.Description of Modifications: a. Engineer shall perform or furnish the following Additional Services: Background and Purpose In June 2024, the U.S Environmental Protection Agency (EPA) published final regulatory limits for six (6) per- and poly-fluoroalkyl substances (PFAS) in the federal register. Public Water Systems (PWSs) will need to comply with the PFAS regulations within five (5) years (by April 2029) and will be based on a running annual average (RAA). The City of South Bend owns and operates nine (9) water treatment plants (WTPs) relying on groundwater from different wellfields. The North and Pinhook WTPs are the only two facilities with finished water PFAS levels above the maximum contaminant levels (MCLs). Both facilities contain PFOS above the MCL. The Pinhook WTP also contains PFHxS and the HI above the MCLs. Engineer is currently performing a treatment alternatives evaluation for the various WTPs in the South Bend distribution system. Within that study, anion exchange (AIX) was selected as the optimal treatment technology for the North and Pinhook WTPs due to a variety of financial and non-financial factors. The City has requested support from Engineer to conduct bench-scale testing to select the best- performing AIX resin for the two sources, which will also aid in permitting of the new treatment process. Task 1 – Project Management and Administration Engineer will support the Owner by managing the project to coordinate the bench scale testing tasks, monitor and control the project budget and schedule, and keep the Owner informed of project progress and issues necessary for success of the project. Engineer will provide project supervision, direction, and coordination with the Owner’s management and staff. Project administration and management also includes budget and schedule control, client management support, document control, coordination of activities, monthly invoicing and project close-out. Engineer will maintain a change register of any scope changes affecting the project budget or schedule and review it with the Owner on a monthly basis. Engineer shall discuss and receive written approval for any scope changes from the Owner prior to proceeding. Task 2 – PFAS Bench Scale Testing Engineer will conduct bench-scale testing to select the best-performing adsorptive media for each WTP. Engineer will conduct Rapid Small-Scale Column Tests (RSSCTs) at the Engineer’s research facility in Kansas City, Missouri to assess performance of alternative media products and validate design parameters. For each WTP, Engineer will perform RSSCTs on water samples collected from the finished water (HSPS discharge) using three (3) columns, including three (3) different types of AIX resin, totaling six (6) columns between Pinhook and North WTPs. Engineer will perform a literature search prior to testing to confirm optimal products selected for bench-scale testing. Testing will evaluate the relative performance of the finished water from Pinhook and North WTPs to simulate installation of adsorbent contactors at the effluent of the high service pumps, prior to final chemical feed points. Observation of contaminant breakthrough will be used to characterize the performance of each media relative to each other. RSSCTs will require collection and shipment of four (4) 55-gallon drums of water (two from each facility). Engineer will ship drums with liners to the City and coordinate sample pickup and shipping with a local shipping agency (shipping costs included in the Proposed Fee). City staff will be responsible for collecting and preparing water samples for shipment and dosing chlorine quenching agent in the water prior to shipment. Engineer will arrange for liftgate services for the delivery and pickup of the drums. Engineer will prepare and submit a bench-scale test protocol to the City. Engineer will participate in a review meeting with the City within two (2) weeks of submitting the draft protocol. Following the review meeting, Engineer will incorporate the City’s comments, finalize the protocol, and coordinate shipping of the water samples. Engineer will initiate testing within two (2) weeks of receiving the water samples from the City. The finalized bench- scale test protocol will be included as an appendix to the bench-scale testing results Technical Memorandum (TM). Engineer shall summarize the bench-scale testing results in a draft Bench-Scale Testing Results TM. The Bench-Scale Testing Results TM will document the performance of each resin and compare conceptual life-cycle costs (inclusive of media cost, change-out frequency, and disposal). The recommended resin at each WTP will be based on the life-cycle cost analysis. Engineer will participate in a review meeting with the City within two (2) weeks of submitting the draft TM. It is assumed that the City will submit their review comments in advance of the review meeting. Attendees will include the Engineer project manager, PFAS process lead, and water process engineer. Following the review meeting, Engineer will incorporate the City’s comments, finalize the Bench-Scale Testing Results TM and submit to the City within two (2) weeks. Deliverables: (issued via electronic delivery in PDF format) ·Draft Bench-Scale Testing Protocol ·Draft Bench-Scale Testing Results TM ·Final Bench-Scale Testing Results TM Assumptions and Limitations The following assumptions and limitations are applicable to this proposal: ·One round of bench-scale testing included for each WTP. Additional rounds of testing can be conducted as a supplemental service. ·City will fill and package drums for shipping. ·City will acquire quench chemical agent and dose into the drums prior to shipment. ·Pilot and full-scale demonstration testing is not included in the scope. Requirements for demonstration testing will be determined during regulatory coordination. b. The responsibilities of Owner are modified as follows: Owner will submit to Engineer any comments regarding the deliverables described under Paragraph 2.a. d. For the Additional Services or the modifications to services set forth above, Owner shall pay Engineer the following additional or modified compensation: For professional services described under Paragraph 2.a. to add additional scope under Part 2 – Additional Services, Owner agrees to pay Engineer in accordance with the Agreement for Professional Services on a Lump Sum Basis. The total compensation for Amendment 1 shall increase the lump sum amount by $126,574 and shall not be revised without written authorization. The proposed fee for bench-scale testing is show in the attached table. e. The schedule for rendering services is modified as follows: Engineer will submit deliverables described under Paragraph 2.a. and conduct a follow-up discussion with the Owner after the completion of testing. Engineer will revise the deliverables in response to Owner’s comments, as appropriate, and furnish one (1) electronic copy of the revised TM and any other deliverables to the Owner within 14 calendar days of receipt of Owner’s comments. f.
