GAMMON Approved and signed by me_ ���� /• / u, 192a Clerk ORDINANCE NO. 7099 -82 AN ORDINANCE FIXING THE MAXIMUM SALARY FOR THE CITY ATTORNEY IN THE DEPARTMENT OF REDEVELOPMENT STATEMENT OF PURPOSE AND INTENT: Since the City Attorney has assumed the responsibility of being the attorney for the Department of Redevelopment under Home Rule Statute, additional compensation is being requested for the additional work performed. Monies have been appropriated and are available within the Department of Redevelopment of the City of South Bend. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: SECTION I. appointed offer of follows: POSITION The maximum annual salary for the following the City of South Bend be no more than as Department of Redevelopment City Attorney PRESENT SALARY /WAGES PROPOSED SALARY /WAGES $3,000 SECTION II. In addition to the preceding amount, the City Attorney is alsunded from the Legal Department as the City Attorney for $30,398, Water Works as Utility Commissioner for $2,920 and Waste Water as Utility Commissioner for $2,920 for a total annual salary of $39,238. SECTION III. PARENT, Mayor COUNTY-CITY BUILDING SOUTH BEND, INDIANA 46601 August 18, 1982 AREA 219 284 -9261 Members of the Common Council Council Chambers 4th Floor, County -City Building South Bend, Indiana 46601 Dear Council Members: The attached ordinances providing for additional compensation to the City Attorney and City Engineer seek to make explicit and to authorize the compensation which I believe is appropriate for increased duties they have undertaken for the Department of Redevelopment and the Bureau of Water Works respectively. Both the Redevelopment Commission and Board of Water Works Commis- sioners will forward to you records of their formal action authorizing that these increased amounts be paid from their funds. The particular individuals involved in these ordinances are not unique. As you are aware, in previous years - of my administration as well as administrations of my predecessors - mayors have recognized the need to award additional compensation to City employees who assumed specific, increased duties. The traditional method of making this in- crease effective has been to authorize payment to the employee based on the existing line item in the salary ordinance. This was believed to be within the provisions of the law. The tradition grew out of a combination of problems which have served to cause confusion and which lead to my submitting these ordinances to you today: the lack of provision for merit increases when employees are being paid the maximum for their salary classification; the expectation that public employees must be content with the salary allotted to them regardless of how many additional duties come their way during the budget year or during their tenure in office; and the funding of the City's operation from a variety of sources, leading to an ever decreasing percen- tage of the City budget from the general fund, with an increasing amount coming from utilities revenues, special state accounts, and a variety of federal sources. With a major portion of the City budget being comprised of personnel costs, it is not surprising that a certain number of personnel, partic- ularly central support staff, would be funded at least partially from more than one source, just as other City costs are absorbed from a variety OFFICE OF THE MAYOR SOUTH BEND, INDIANA Members of the Common Council -2- August 18, 1982 of sources. It has been only within the last two years that we have moved toward a clearer identification of those costs; yet for many years the total salary of a number of City employees was not reflected in the salary ordinance due to multiple funding of their positions. I am pleased that we are moving toward a clearer identification of the overall funding and payment picture of both personnel and other City costs. In fact, I plan to initiate a study of alternatives to the fragmented funding by which we now budget. To place the increases received by the two individuals concerned in these ordinances in the above context of the traditional handling of such situations clarifies why I failed to approach the Council earlier to authorize the increases they deserve. The current approach is, of course, the correct one and the one I shall follow in the future. As you are aware, these increased amounts have been paid to these persons for several months, the City Attorney since January, 1982, and the City Engineer since April, 1982. I believe at the time I authorized these increases, as I still believe, that the additional responsibilities assumed by these persons, whether due to change in state law, as in the case of the City Attorney, or by specific additional project duties, as in the case of the City Engineer, clearly warranted additional compensa- tion be paid to them from the particular funds of those functions. Upon considering the circumstances within which I acted earlier and within which I now bring the ordinances before you, I request your favorable consideration of these ordinances.
