GAMMON Approved and signed by me :u —_ —! . > / , 19 �?--1 Clerk ORDINANCE NO. 7098 -82 AN ORDINANCE APPROPRIATING $500,000 FROM THE 1982 COMMUNITY BLOCK GRANT FUND TO SUPPLEMENT THE ECONOMIC DEVELOPMENT CAPITAL FUND TO BE ADMINISTERED BY THE CITY OF SOUTH BEND, INDIANA, THROUGH ITS DIVISION OF COMMUNITY DEVELOPMENT FOR THE RETENTION OF THE RETAIL STORE CURRENTLY KNOWN AS ROBERTSON'S. STATEMENT OF PURPOSE AND INTENT The Division of Community Development wishes to supplement the Economic Development Capital Fund to assist economic enterprises through a variety of mechanisms. In particular it wishes to assist the retention of the retail store located in the Central Business District, which store is currently known as Robertson's,through the efforts of the South Bend Development Corporation. Such funds will be made available to the SBDC through the usual Community Development contracting procedures and will be subject to all applicable regulations and restrictions for CD Block Grant Funds. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, as follows: SECTION program year administered forth below: PURPOSE The sum of $500,000 is hereby appropriated starting July 7, 1982 (Program Year 1982), to by the Division of Community Development, as PROGRAM YEAR CD 82 -1005 COMMUNITY DEVELOPMENT PROGRAM AMOUNT Economic Development Capital Fund $500,000 for the be set SECTION II: The City, through its Board of Public Works, may contract with the South Bend Development Corporation for use of the funds appropriated above only in connection with a project which assists in the retention of the retail store located in the Central Business District known currently as Robertson's. The contract shall provide that any of the above funds not obligated or involved in any negotiations by the South Bend Development Corporation for such purpose on April 1, 1983, shall be immediately repaid to the City, pursuant to the terms of the contract. SECTION III. This appropriation is subject to the following condition: that each direct and indirect recipient of said funds herein appropriated shall agree that fair and equitable arrangements shall be made to protect the interests of any current employees effected by such financial assistance. Such arrangements shall include the obligation to collectively bargain with any representatives of such current employees so that a policy of non - displacement of current full -time employees is met. The Division of Community Development shall be charged with overseeing this provision. Failure to comply with the non - displacement policy, shall be grounds for automatic repayment of such funds received, to the City of !South Bend, Indiana. SECTION IV: This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. (219) 2849371 South Bend Common Council 4th Floor County -City Building South Bend, Indiana 46601 Dear Members of the Council: August 4, 1982 The attached ordinance would appropriate $500,000 from the City's 1982 Community Development Block Grant to supplement the Economic Development Capital Fund. The additional funds would be used, in turn, to capitalize a local development corporation - -the South Bend Development Corporation, Inc. The newly formed, non - profit development corporation would use the funds to stimulate private investment and to participate in joint ventures with the private sector for economic development pur- poses. One of the first potential projects could involve assistance to a private investment group, in the form of a low- interest loan, as part of a community effort to keep Robertsons' in downtown South Bend. As loan proceeds from the Robertsons' project or any other develop- ment project are returned to the South Bend Development Corporation, the funds would be used for other projects which fall within the scope of the local economic development program. As you know, the $500,000 was originally scheduled to be paid against our Section 108 Loan. The City established an accelerated payment plan that would have paid back the loan within two years as compared to the original four year repayment plan.
