GAMMON Clerk ORDINANCE NO. 6997 -81 AN ORDINANCE REQUESTING VACATION OF VARIOUS PUBLIC RIGHT -OF -WAY IN THE MONROE - SAMPLE DEVELOPMENT AREA AND GEORGE AVENUE OF THE CITY OF SOUTH BEND, INDIANA. STATEMENT OF PURPOSE OF INTENT The Common Council recognizes the need for the orderly redevelopment on the Monroe - Sample Development Area. The Council recognizes that certain alterations of the existing street and alley pattern are needed to facilitate the orderly redevelopment of the area. In order to promote the redevelopment of the Monroe - Sample Industrial Park, the following described public rights -of -way are to be vacated. SECTION I. The Common Council of the City of South Bend having held a public hearing on the petition to vacate the following property: Public rights -of -way being a part of the City of South Bend, Portgage Township, St. Joseph County, Indiana, and being more particularly described as follows, viz: All East -West; North South; and Northeast - Southwest Alleys bounded by Bronson Street; Lincolnway East; State Road 23; and Marietta Street in Frantz's 2nd Addition; Frantz' 3rd Addition; Gallagher's 1st Addition; E. H. Rush's 1st Addition; and J. Rush's 4th addition; and Public rights -of -ways being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows; viz: George Avenue in the area bounded by Bronson Street; Lincoln Way East; State Road 23; and Marietta Street in Frantz' 2nd Addition; Frantz' 3rd Addition; E. H. Rush's 1st Addition; and J. Rush's 4th Addition, be and the same is hereby vacated. SECTION II. The City of South Bend hereby reserves the rights and easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and'ditches, within the vacated right -of -way, unless such rights are released by the individual utilities. SECTION III. This ordinance shall be in ful force and effect from and after passage by the Common Coun il, a ova by the Mayor and legal publication.
