AN ORDINANCE APPROVING THE DEVELOPMENT
AGREEMENT BETWEEN THE CITY OF SOUTH BEND,
INDIANA, AND NEW ENERGY CORPORATION OF
OF INDIANA TO BRING ABOUT THE CONSTRUCTION
OF AN ETHANOL PLANT WITHIN THE CITY OF
SOUTH BEND.
STATEMENT OF PURPOSE AND INTENT
To approve a contract to facilitate the construction of a
One Hundred Fifty -One Million Dollar ethanol plant by New Energy
Corporation of Indiana on a site within the City of South Bend.
NOW, THEREFORE, BE IT ORDANINED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA AS FOLLOWS:
SECTION I. That the Development Agreement entered into
between the City of South Bend, Indiana, and New Energy Corporation of
Indiana on the 9th Day of October, 1981, to bring about the construction
of an ethanol plant within the City of South Bend, Indiana which cost
to the City will exceed Seven Thousand Five Hundred Dollars ($7,500.00),
is hereby approved.
SECTION II. This Ordinance shall be in full force and effect
from and after its adoption by the Common Council and approval of the
Mayor.

The attached ordinances have been prepared in keeping with the require-
ment of South Bend Municipal Code Section 2 -50(g) regarding council
approval of City contracts. One proposed ordinance approves the Develop-
ment Agreement between the City and New Energy Corporation of Indiana
for the construction of New Energy's ethanol plant. The other proposed
ordinance approves the Interlocal Cooperation Agreement between the City
and St. Joseph County for the construction and maintenance of an access
road from State Highway 23 to the site of the ethanol plant.
The adoption of these ordinances will constitute final formalization of
the City's agreements concerning the development of the New Energy
ethanol plant. The Councils' signatures on these documents indicate
their commitment to these agreements.
