HomeMy WebLinkAbout9433-03 Amend Chapter 21, Zoning, Article 10, Sign RegulationsORDINANCE No. Passed by the Common Council of the City of Sorrtlt Bend, Indiana July 14, 20 03 Attest: Attest: Presented by me to the Mayor of the City of South Bend, Indiana July 15, 20 03 City Clerk President of Common Council City Clerk Approved and signed by me July 15 20 03 '~`'" l'}' j~~ Mayor ORDINANCE NO. 1 ~ 3 ~ ~03 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21, ZONING, ARTICLE 10, SIGN REGULATIONS, OF THE SOUTH BEND MUNICIPAL CODE BY REVISING AND LIMITING THE SIZE, SEPARATION DISTANCE, AND DISPLAY AREA OF OUTDOOR ADVERTISING SIGNS WITHIN THE "IP" INDUSTRIAL PARK ZONING DISTRICT STATEMENT OF PURPOSE AND INTENT The purpose of this ordinance is to bring the restrictions for outdoor advertising signs in the "Il'" Industrial Park zoning district into conformance with the restrictions in the "C" Commercial, "D" Light Industrial, and "E" Heavy Industrial Zoning Districts. The Common Council of the City of South Bend finds that it is desirable that the restrictions on outdoor advertising signs be the same in all districts where they are allowed. Now, Therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section I. Chapter 21, Article 10, Section ZI-170(7) "IP" Industrial Park District is amended to read as follows: (b) (2) The maximum display area of outdoor advertising signs shall be ene six hundred seventy -two (672) square feet. Two tiered, deck yr stacked signs shall be prohibited. square-Feet: Temporary extensions maybe added to individual signs based on individual advertising requirements not to exceed two hundred (200) square feet per face (a maximum of eight hundred seventy-two (872) square feet with extensions. (b) (5) Empty boards and signs without advertising covering the entire face of the board shall be prohibited. (~}-(-S} (bl (6) The maximum height for outdoor advertising signs shall be thirty- five (35) feet. (~}-E~r} B 7 The minimum distance between a new outdoor advertising sign and an existing outdoor advertising sign shall be one thousand feet (1,000'), on both sides of the street alon tg he right-of-way, nor shall it be placed within five hundred feet (500'Zof an interchange, intersection at-grade, or rest area. {~}(~ (bl (81 The minimum distance between an outdoor advertising sign and a principal residential use or zoning district, church, school, designated historic landmark, e~ historic preservation district, river or park, shall be one hundred (100) feet as measured from the extremity of the sign face. (bl (91 Separation distances shall not be limited by jurisdictional boundaries. Section II. This Ordinance shall b e in full force and effect from and after its passage by the Common Council and approval by the ayor. The Area Plan Commission at its public hearing on Tuesday, June 17, 2003, took the following action: Upon a motion by Robert Hawley, being seconded by Charlotte Sobel and unanimously carried, the proposed ordinance initiated by the Area Plan Commission amending Chapter 21, Zoning, Article 10, Sign Regulations, of the South Bend Municipal Code by revising and limiting the size, separation distance, and display area of outdoor advertising signs within the "IP" Industrial Park Zoning District is sent to the Common Council with a favorable recommendation. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. The restrictions on outdoor advertising signs are desired to be the same in all districts where they are allowed.
