AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana:
Section 1. Ordinance NO. 4990 -68, as amended, which
ordinance is commonly known as the Zoning Ordinance of the City
of South Bend, Indiana, be and the same hereby is amended in
order that the zoning classification of the following described
real estate in the City of South Bend, St. Joseph County, State
of Indiana:
Lots No. 6 and 7 of the Original Plat
of River Park, now City of South Bend,
Indiana
be and the same is hereby established as C -1 Commercial, A Height
and Area.
Section 2. This Ordinance shall be in full force and
effect from and after its passage by the Common Council, approval
by the Mayor and legal publication.

We, the undersigned, make application and petition the
Common Council-of the City of South Bend, Indiana, to amend the Zoning
Ordinance as herein requested.
1. The property sought to be rezoned is located at:'
935 South Ironwood, South Bend, IN 46615,
being Lots No. 6 and 7 of the Original Plat
of River Park, now City of South Bend, Indiana.
2. Name of property owners:
Richard Sherk and Joyce A. Sherk

3. It is desired and requested that this property be
rezoned from A Residential, A Height and Area, to
C -1 Commercial, A Height and Area.
4. This rezoning is requested so as to allow the fol-
lowing use: Flower Shop, together with ancillary
gift shop.
5. Attached is a copy of the legal description of the
property, a list of names and addresses of all
property owners within 300 feet of the petition
property; a site plan; and self- addressed, stamped
envelopes of all property owners within 300 feet
of the petition property.

Ironwood Drive, City of South Bend

The attached rezoning petition of Richard and Joyce Sherk was legally
advertised November 6, 1982. The Area Plan Commission gave it a public
hearing on November 16, 1982, at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by Dean Speicher
and unanimously carried, the proposed ordinance and site develop-
ment plan of Richard and Joyce Sherk to zone from "A" Residential,
"A" Height and Area to "C -li' Commercial, "A" Height and Area,
property located at 935 South. Ironwood Drive is sent to the Common
Council with no recommendation.
If the Council should rezone this site, it shall have to be subject to the
submission of a final site plan.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report. Attached
for your consideration in the review of this matter is a copy of the Area Plan
Commission's Staff Report.

STAFF REPORT
RICHARD AND JOYCE SHERK #807 -82 November 5, 1982
935 South Ironwood Drive, South Bend
REQUESTED ACTION: The petitioners are requesting a zone change from
"A" Residential, "A" Height and Area to "C -1"
Commercial, "A" Height and Area to allow a
flower shop, together with an ancillary gift
shop.
EXISTING LAND USE: The site contains a single - family house.
SURROUNDING LAND USE AND ZONING: Located to the north, east, south and west are
single - family houses zoned "A" Residential, "A"
Height and Area.
APPLICABLE PARKING REGULATIONS: All parking lots located within 50 feet of a
residential district must be properly screened.
ACCESS: Access to the site would be from Ironwood Drive.
DRAINAGE:
One 1800 gallon drywell is proposed for storm
drainage.
DATA:
The total site is 21,780 square feet. Of that,
1,833 square feet or 8.4% of the site is covered
with the buildings; 3,668 square feet or 16.8%
of the site would be utilized for parking and
drives; and, 16,279 square feet or 74.8% would
be open space.
SITE PLAN:
The site plan is preliminary.
AGENCY COMMENTS:
The City Engineer had the following comments:
1. City water and sanitary sewers are available
to the site.
2. Storm water shall be retained in dry wells.
3. Driveway should be 22' minimum width.
STAFF COMMENTS:
This petition was originally given an unfavorable
recommendation by the Area Plan Commission and
denied by the Common Council in September, 1982.
The petition has now been resubmitted.
