AN ORDINANCE OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA, AMENDING
VARIOUS SECTIONS OF CHAPTER 2, ARTICLE 7,
OF THE MUNICIPAL CODE OF THE CITY OF
SOUTH BEND, COMMONLY KNOWN AS BUDGETARY
PROCEDURES
STATEMENT OF PURPOSE AND INTENT
On April 28, 1981 the Common Council passed Ordinance No. 6912 -81,
which established budgetary procedures.
The Council has found that these new procedures have proven to
be very helpful, and are a great improvement over the line -item budgets
which were submitted to the Council in the past.
The Common Council is introducing the following Bill in the hope
of further improving the budgetary procedures, and to set forth specific
prodcedures to be followed for Salary Ordinances.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Municipal Code of the City of South Bend, Indiana,
is hereby amended by amending the following Sections of Chapter 2,
Article 7, Budgetary Procedures:
ARTICLE 7. Budgetary and Salary Procedures
Sec. 2 -87 Proposed Line -Item Budget
(d) Within each type of fund identified in the Proposed Budget,
the following information shall be included:
1) The "Budget Work Sheets Detailed by Account" for each Cost_
Center shall include the following categories: Account
Number, Account Description, Previous Year Budget, Prior
Year Actual Disbursements. Current Budget. Reauested

ing the following identifications within their cost center
line -item budget if applicable:
I. "V" designating that a city -owned or city - leased
vehicle goes with the position.
II. "M" designating that the position is entitled to
mileage as a part of his employment if it is used greater
than 50% of the time.

of each Cost Center includes a listing of: cash balances

year; a listing of a breakdown of services contractual for
the previexs- prior for year; unfilled positions; and
reclassification information.

the following manner by each Cost Center:
(I) The "Line -Item Detail" sheets shall be available from
the Office of the City Clerk, Information required

account description, and requested budget shall be
included for each line -item with a detailed narrative
description of the proposed uses of such funds. If
the account number has changed from the rior ear,

(II) A Personnel Organization Chart for the present and
proposed calendar years shall be attached identifying
all positions, whether such positions are full or
part -time, and job duties for each position.
(III) If any positions are a result of reorganization re-

Sec. 2 -91 Ordinance Required for New Positions /Notification of
Reclassification.
(a) No position shall be created for any employee, whether full
or part -time, after the budget has been passed by the Common Council,
unless an Ordinance is ap ssed by the Common Council approving such
new position(s) and its funding source(s). The Mayor shall be res-
ponsible for filing such an ordinance for Council consideration. If
said position is created after the passage of the budget, and if an
ordinance as required by law has not been presented for Council con-
sideration, the Mayor shall be considered in violation of this section.
(b) The Mayor shall give written notice to all members of the
Common Council and its attorney of all employee reclassifications.

to be invalid or unconstitutional, such declaration shall not be construed
to affect any of the other provisions, sections, or parts herein, and the
remainder of the ordinance shall not thereby be invalidated.
SECTION III. This ordinance shall be in full force and effect

In the past few days, I have read and re -read Bill
No. 27 -82 attempting to find substantial reasons why I
should sign it into law. Sections 287 and 288 do pertain
to the budgetary process and represent improvements which I
can support. However, Sections 291 and 292 detract overwhel-
mingly from the intent of the Council as stated in passing the
bill and thus I have to veto Bill No. 27 -82.
I am vetoing the bill because it will unduly politicize
the personnel process, it will impede City workers' efforts
to improve productivity, and it will lead to ridiculous and
damaging results in managing the City workforce.
(1) Bill No. 27 -82 will unduly politicize the personnel
process through provisions which require informing
the Council members of all employee reclassifications.
Supervisors should not have to worry whether an
employee is a friend of this or that politician before
taking personnel action. Supervising is difficult
enough without encouraging this kind of thinking
through an ordinance. Also, why should an employee,
demoted as a disciplinary action, be subjected to
the embarrassment of making this action public
through informing Council members?
(2) Bill No. 27 -82 will impede the progress being made
towards increasing the productivity of our workforce.
It is ironic that when labor and management in the
private sector are cooperating to reduce unnecessary
work rules, a bill is passed by the Council which
includes unnecessary regulations that will lead to
lower productivity.

(3) Bill No. 27 -82 will lead to ridiculous and damaging
results because it would impose extraordinary
restrictions on the use of the salary ordinance and
the budget. I believe those extraordinary restric-
tions result more from imprecision in drafting than
from the intent of the Council. Nevertheless, the
resulting problems would remain.
(a) For example, if the budget ordinance provided
for five Equipment Operator III's,'the Depart -
ment Head could not demote, for disciplinary
reasons, an Equipment Operator III to the level
of Equipment Operator II without a Council
ordinance.
(b) In similar fashion, if a Department Head deter-
mined to combine two part -time positions or to
divide a full -time position to save salary costs
and to improve productivity, an ordinance would
be required.
(c) The bill would also prevent a Department Head
or other supervisor from saving money through
following of standard hiring procedures. For
example, the Park Department has two Secretary
III's in the budget. If one of those Secretary
III's should resign, the Superintendent of Parks
could not hire a new person as a Secretary II
without having a separate ordinance passed by
the Council. The Superintendent.would therefore
be stymied in his flexibility to hire a new person
at an entry level as is often the case.
Any ordinance which has the effect of requiring the
passage of an ordinance to permit a demotion, a reduction
in grade as a result of change in job function, or to
create a probationary period cannot be signed by me into
law. I cannot believe that any reasonable person would
expect a City Administration to manage the day -to -day
operations of their bureaus and departments in this
fashion. While I can understand that the intent of the
ordinance may not have been to achieve the above - described
results, the ordinance, as drafted, would have those results.
As Mayor, I am accountable to the people of South Bend for
the provision of City services as supported by the City Council
through the budgetary process. The major responsibility of the
City Council members is to pass laws and budgets which help in
providing City services efficiently and at the lowest cost.

A City Council has the obligation to review the provision of
those services from time to time and to make recommendations
to provide those services in the best manner possible. Council
members are accountable to the public for broad policy- making
and not for the day -to -day management of the City.
In ending, I reaffirm my policy and that of my staff to
meet with you any time and to provide you with all the informa-
tion you request. If the information concerns personnel actions
or other matters which cannot be made public, I will call an
Executive Session to provide such information.
