AN ORDINANCE TO VACATE THE FOLLOWING
DESCRIBED PROPERTY
LEGAL: FIRST 7' NORTH /SOUTH ALLEY W OF AND ADJACENT TO LOT F JOHN E WALZ
REVISED ADD. RUNNING SOUTH FROM THE SOUTH LINE OF VACATED DEAN
STREET TO THE NORTH LINE OF SHERWOOD STREET. SW-, SEC 24- 37 -2E.
Pursuant to Indiana Code Section 36- 7 -3 -12, the Common Council is charged
with the authority to hear all petitions to vacate public ways or public places
within the City.
The following Ordinance vacates the above described public property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend having held a public
hearing on the petition to vacate the following property:
FIRST 7' NORTH /SOUTH ALLEY W OF AND ADJACENT TO LOT F JOHN E WALZ
REVISED ADD. RUNNING SOUTH FROM THE SOUTH LINE OF VACATED DEAN
STREET TO THE NORTH LINE OF SHERWOOD STREET. SW4 SEC 24- 37 -2E.
hereby determines that it is desirable to vacate said property.
SECTION II. The City of South Bend hereby reserves the rights and easements
of all utilities and the Municipal City of South Bend, Indiana to construct and
maintain any facilities, including, but not limited to, the following: electric,
telephone, gas, water, sewer, surface water control structures and ditches,
within the vacated right -of -way, unless such rights are released by the individual
utilities.
SECTION III. The following property may be injuriously or beneficially affected
by such vacating: N /A.
SECTION IV. The purpose of the vacation of the real property is to:

SECTION V. This ordinance shall be in full force and effect from and
after its passage by the Common Counciy and approval by the Mayor.

Dear Council Members:
In accordance with Ordinance No. 6976 -81, the following
recommendation is being submitted to the Common Council con-
cerning the petition filed by Super Auto Salvage to vacate
the first seven foot north -south alley west of and adjacent
to Lot F, John E. Walz Revised Addition, running south from
the south line of vacated Dean Street to the north line of
Sherwood Street.
Favorable comments have been received by the Board
from the Engineering Department, Area Plan Commission and
Community Development Department for vacation of the above
mentioned public right -of -way. A public hearing was held
on November 1, 1982, by the Board concerning the proposed
vacation. No remonstrators were present to speak against
the vacation, and no written objections were filed with the
Board. A copy of the excerpts of minutes from that public
hearing is enclosed herein.
The Board of Works, therefore, recommends vacation of
the above alley, SUBJECT TO ANY AND ALL UTILITY EASEMENTS.
