AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68 AS AMENDED,
COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF
SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE).
BE IT ORDAINED by the Common Council of the City of South Bend, Indiana:
Section 1. Ordinance No. 4990 -68, amended, which ordinance is commonly
known as the zoning ordinance of the City of South Bend, Indiana, be and the
same hereby is amended in order that the zoning classification of the follow-
ing described real estate in the City of South Bend, St. Joseph County, State
of Indiana:
Lots 21 & 23 Swanson Park Second Addition & Lot 2 of Tuxedo Park First
Subdivision in the City of South Bend, Indiana containing 0.96 acres
more or less.
be and the same is hereby established as "B" residential "A" height & area.
Section 2. This Ordinance shall be in full force and effect from and
after its passage by the Common Council, approval by the Mayor and legal
publication.

RE: A proposed ordinance and site development plan of the Osteopathic
Hospital to zone from "A" Residential, "A" Height and Area to "B"
Residential, "A" Height and Area, property located on the southeast
corner of Tuxedo Drive and Marshall Street, City of South Bend
Gentlemen:
The attached rezoning petition of the Osteopathic Hospital was legally
advertised October 9, 1982. The Area Plan Commission gave it a public
hearing on October 19, 1982, at which time the following action was taken:
Upon a motion by Leroy Yoder, being seconded by Dean Speicher,
with Robert Lehman, Joseph Serge and Brian Crumlish voting
"Nay ", the proposed ordinance and site development plan of the
Osteopathic Hospital to zone from "A" Residential, "A" Height
and Area to "B" Residential, "A" Height and Area, property
located on the southeast corner of Tuxedo Drive and Marshall
Street is sent to the Common Council with a favorable recommenda-
tion subject to a final site plan incorporating the landscape plan
to effectively screen the parking lot from Jefferson Boulevard,
Tuxedo Drive, Marshall Street, and Lot 22 on Tuxedo Drive.
PLEASE NOTE that the attached Ordinance has been amended by the petitioner to
include a legal description different than that used for the Common Council's
first reading. The amended Ordinance was the Ordinance legally advertised and
heard by the Area Plan Commission. The original of the amended Ordinance is
attached to this letter.
The above recommendation is made subject to a final site plan.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report. Attached

STAFF REPORT
OSTEOPATHIC HOSPITAL #805 -82 October 7, 1982
2515 East Jefferson, South Bend
REQUESTED ACTION: The petitioners are requesting a zone change
from "A" Residential, "A" Height and Area to
"B" Residential, "A" Height and Area to allow
for "additional employee parking facilities."
EXISTING LAND USE: Three single - family houses are on the site.
SURROUNDING LAND USE AND ZONING: Located to the north and west of the site are
single- family houses zoned "A" Residential, "A"
Height and Area; to the east is Osteopathic
Hospital zoned "B" Residential, "A" Height and
Area; and to the south is a church zoned "A"
Residential, "A" Height and Area.
APPLICABLE PARKING REGULATIONS: All parking spaces within 50 feet of a residential
lot must be properly screened, and no parking is
permitted within the 25 foot setback line.
ACCESS: Access to the proposed parking lot would be
from the existing hospital parking lot only.
DRAINAGE: A series of drywells are proposed for storm
drainage.
DATA: The total site is 35,196 square feet or .81 acres
in area. Of that, .41 acres, or 51% of the site
would be utilized for parking, and .40 acres, or
49% of the site would be open space.
SITE PLAN: The site plan is preliminary.
AGENCY COMMENTS: The City Engineer has the following comments:
1. City water and sanitary sewers are available
to the site.
2. Storm water shall be retained in properly
sized dry wells on the site.
3. 6' chain link fence at extreme southwest
and northwest corners of property to be
removed a distance of 20 ft.: to allow
increased sight distance. Fence can be
installed on a diagonal to maintain
security.
