AN ORDINANCE REQUESTING VACATION
OF A PUBLIC RIGHT -OF -WAY IN THE
MONROE- SAMPLE DEVELOPMENT AREA
STATEMENT OF PURPOSE AND INTENT
The Common Council recognizes the need for orderly redevelopment of the
Monroe - Sample Development Area.
The Council recognizes that certain alterations of the existing street
and alley pattern are needed to facilitate the orderly redevelopment of
the area.
In order to promote the redevelopment of the Monroe- Sample Industrial
Park, the following described public right -of -way is to be vacated.
SECTION I.
Public right of way being a part of the City of South Bend, Portage Town-
ship, St. Joseph County, Indiana, and being more particularly described
as follows, viz:
The North -South alley bounded by Bronson Street; Rush Street; Clinton
Street; and the first East -West alley south of Bronson Street in John
Rush's 4th Addition,
be and the same is hereby vacated.

The City of South Bend hereby reserves the rights and easements of all uti-
lities and the Municipal City of South Bend, Indiana to construct and main-
tain any facilities, including, but not limited to, the following: electric,
telephone, gas, water, sewer, surface water control structures and ditches,
within the vacated right of way, unless such rights are released by the
individual utilities.
SECTION III.
This ordinance shall be in full force and effect from and after passage by
the Common Council,, approval 'by the Mayor and legal publication.

Attached is a vacation petition and ordinance for an alley in the
Monroe - Sample Development Area. This alley vacation conforms to the
Monroe - Sample Development Plan as approved by the Common Council and
adopted by the Redevelopment Commission. I have enclosed a map of the
area showing the alley that is to be vacated.
