GAMMON Approved and signed by me '7/ 19 �� Clerk ORDINANCE 7t-j AN ORDINANCE ADOPTING I.C. 36 -10 -4 AS THE APPLICABLE STATUTORY BASIS FOR THE OPERATION OF THE SOUTH BEND PARK DEPARTMENT STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend adopted by Ordinance 2768, I.C. 19 -7 -30 as the applicable statute for the operation of the South Bend Parks Department. This provision of the Indiana Code has been recodifed by the 1981 General Assembly as I.C. 36 -10 -4. The Council has received a petition from the Board of Park Commissioners requesting that South Bend adopt this recodified chapter by ordinance. NOW THEREFORE, be it ordained by the Common Council of the City of South Bend that: SECTION I. The South Bend Park Department shall operate under the provisions of I.C. 36 -10 -4, Sections 36- 10 -4 -1 through 36- 10 -4 -40, and as may be amended from time to time. SECTION II. Department of Public Parks Administration Building St. Louis Boulevard at Wayne Street South Bend, Indiana 46617 PHONE: (219) 294 -9401 November 17, 1981 South Bend Common Council County -City Building 227 West Jefferson Boulevard South Bend, Indiana Dear Council Members: The South Bend Board of Park Commissioners, at its regular meeting, November 16, 1981, passed a motion petitioning the Common Council to place the operation of the Department of Public Parks under Indiana Code 36 -10 -4. Such a move is necessitated because of the Home Rule Law passed at the last legislature which recodified all park laws thus eliminating the law the Park Department had previously operated under. Seitz, JRS:kb PRTTTTnN WHEREAS, I.C. 36- 10 -4 -1 permits a city having a population of at least 35,000 to adopt by ordinance I.C. 36 -10 -4 upon a petition signed by all of the members of the Board of Park,Commissioners of the Park District of the City of South Bend. WHEREAS, the City of South Bend has more than 35,000 population. WHEREAS, I.C. 36 -10 -4 essentially recodifies I.C. 19 -7 -30. WHEREAS, the Common Council of the City of South Bend adopted by Ordinance 2768 I.C. 19 -7 -30, which Ordinance was codified as Section 2 -137 of the South Bend Municipal Code. WHEREAS, the Board of Park Commissioners of the Park District of the City of South Bend desires to have the Park Department of the City of South Bend operate under provisions recodified by the 1981 General Assembly of the State of Indiana as 36 -10 -4. NOW THEREFORE, the Board of Park Commissioners of the Park District of the City of South Bend petitions the South Bend Common Council to adopt I.C. 36 -10 -4 by ordinance for the continued efficient and effective operation of the South Bend Park Department.
