GAMMON Approved and signed by me Clerk ORDINANCE NO. 7005 -81 SUBSTITUTE BILL NO. 129 -81 AN ORDINANCE OF.THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ESTABLISHING NEW ELECTRICAL, HEATING, VENTILATING AND AIR - CONDITIONING FEES, NEW PLUMBING, WRECK - ING,HOUSE MOVING, PUBLIC OCCUPANCY, AND SIGN FEES, NEW HEATING AND ELECTRICAL CONTRACTORS FEES, NEW CURB CUT AND EXCAVATION PERMIT FEES, AND AMENDING VARIOUS SECTIONS OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND RELATED THERETO STATEMENT OF PURPOSE AND INTENT The Common Council of the City of South Bend has conducted an intensive investigation of all licensing procedures and fees within the City. The Council has found that several of the public works type of license fees and permits have not been reviewed since 1916, and that several others have not been reviewed since 1960. The Council submits the following Bill which updates the fees charged by the City in light of the costs reasonably related to such licenses and permits. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend, Indiana, hereby establishes the following fees for Wrecking and Demolition Permits, House Moving Permits, Public Occupancy Permits, and Sign Permits: (1) WRECKING AND DEMOLITION PERMIT FEES RESIDENTIAL $5.00 per one and two -story house including accessory $10.00 for more than a two -story house - 'I - COMMERCIAL $15.00 per one -story building up to 4,000 square feet $75.00 per one -story building with 4001to 10,000 square feet $35.00 per one -story building with 10,001 or more square feet For any building with two or more stories, a fee of 500 of the single -story fee shall be a44e4l�;,according to size for each story. (2) HOUSE MOVING PERMIT FEE - �wentp- F3e-- {Sgg -gg }- Fifty ($50.00) Dollars per one or two story building move and - Fifty -{ 59 -99 - One Hundred ($100.00) Dollars to move any building over two - stories. (3) PUBLIC OCCUPANCY PERMIT FEES All temporay occupancy of public property shall require a permit with a fee of- 'Pen- {S }g -gg }- Twenty ($20.00) Dollars for each location. (4) SIGN PERMIT FEES All illuminated signs projecting over public property shall be assessedas follows: (a)Permit fees for new signs shall be calculated at a rate of fifteen- cents= {S8 -�5} thirty cents ($0.30) per square foot of each face measured on skeleton framework. (b) Permit fees for signs flat against a building shall be calculated at a rate of - €€ €teen - cents- ESA:35} thirty cents ($0.-30), per square foot measured as total area of the display surface. All installations of new bill boards shall require a permit with a bill board fee of Twenty -five dollars ($25.00). SECTION IV. The Common Council of the City of South Bend, Indiana, hereby establishes the following fees for licensing Heating, Air - Conditioning and Ventilating Contractors and Electrical Contractors, and the registration of Plumbing Contractors: (1) HEATING, AIR - CONDITIONING AND VENTILATING CONTRACTORS LICENSE FEES. The Common Council of the City of South Bend, Indiana, hereby establishes the following fees for excavation permits and curb cuts: (1) EXCAVATION PERMITS (2) CURB -CUT PERMITS $ -5 -99- 25.00 each -A- -25- 10.00 each SECTION VI. The above license and permit fees shall be in effect from January 1, 1982 through December 31, 1982. Any fee amount of the Municipal Code of the City of South Bend, Indiana,which appears to be in conflict with this ordinance is hereby repealed. All other license and permit procedures related hereto and outlined in the Municipal Code of the City of South Bend, Indiana,including but not limited to bonding amounts and licensing procedures are hereby affirmed. SECTION VII. Severability. If any provisions of this ordinance are declared to be invalid or unconstitutional such declaration shall not be construed to affect any of the other provisions herein, and the remainder of the ordinance shall not thereby be invalidated. SECTION VIII. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and legal publication, with all fees applicable to permits and licenses issued for calendcyr year 1982. The Personnel and Finance Committee has been meeting with various members of the City Administration who deal with this area on an every day basis. You w: -11 note that the specific fees are not included due to the fact that additional information will be provided to the entire Council by Mr. Markle and Mr. Wells. It is the intent of the Committee to immediately send this Bill to the Personnel and Finance Committee for continuing review and specific recommendations. In light of the fact that it is desireous to have the new fees in effect by January 1, 1982, the Bill is being filed in this manner to meet the filing deadline established by the City. Please note that on Monday, November 23, 1981, the Personnel and Finance Committee will meet at 4:30 p.m. to review the additional material requested of the Administra- tion. It is anticipated that at this meeting specific recommendations will be made in each of the license and permit areas to complete the Bill. We seek your favorable support.
