AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
STATEMENT OF PURPOSE AND INTENT
The Common Council recognizes the need for Development Controls for
the Monroe Sample Development Area.
The Council recognizes that the current zoning of the Development
Area is not in keeping with the Development Controls of the adopted Monroe
Sample Development Plan.
In order to promote the development of planned sub - areas, the
following described real estate is to be rezoned.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, as follows:
SECTION I. Ordinance No. 4990 -68, as amended, which is commonly
known as the Zoning Ordinance of the City of South Bend, Indiana, be and the
same hereby is amended in order that the zoning classification of the following
described real estate in the City of South Bend, St. Joseph County, State of
Indiana:
A parcel of land being a part of the City of South Bend, Portage
Township, St. Joseph County, Indiana and being more particularly
described as follows, viz:
Commencing at the intersection of the centerline of Monroe Street
and the centerline of the first north south alley east of Michigan
Street in said City; thence south along said alley centerline to
the centerline of South Street; thence east along said centerline
to the centerline of St. Joseph Street; thence south along said
centerline to the centerline of Bronson Street; thence east along
said centerline to the centerline of Lincolnway East; thence
northwest along said centerline to the centerline of Monroe Street;
thence west along said centerline to the centerline of Fellows
Street; thence south along said centerline to the centerline of the
first east west alley south of Monroe; thence west along said alley
centerline to the centerline of Carroll Street; thence north along
said centerline to the first east west alley south of Monroe Street;
thence west along said alley centerline to the centerline of the first
north south alley west of Carroll Street; thence north along said
alley centerline to the centerline of Monroe Street; thence west along
said centerline to the point of beginning.

described as follows, viz:

the centerline of the first east west alley south of Monroe Street;
thence east along said alley centerline to the centerline of Carroll
Street; thence south along said centerline to the centerline of the
first east west alley south of Monroe Street; thence east along said
alley centerline to the centerline of Fellows Street; thence north
along said centerline to the centerline of Monroe Street; thence west
along said centerline to the point of beginning.

Michigan Street centerline to the centerline of Sample Street; thence
east along said centerline to the centerline of the first north south
alley east of Michigan Street; thence north along said alley centerline
to the centerline of Bronson Street; thence east along said centerline
to the centerline of St. Joseph Street; thence north along said centerline
to the centerline of South Street; thence west along said centerline to
the centerline of the first north south alley east of Michigan Street;
thence north along said alley centerline to the centerline of Monroe Street;
thence west along said centerline to the point of beginning.

Section 4
A parcel of land being a part of the City of South Bend, Portage Township,
St. Joseph County, Indiana and being more particularly described as follows,
viz:
Commencing at the intersection of the centerline of Bronson Street and
the centerline of the first north south alley extended east of Michigan
Street; thence south along said alley centerline to the centerline of
Conrail; thence southeast along said railroad centerline to the centerline
of State Road 23; thence east - northeast along said centerline to the center-
line of Lincolnway East; thence northwest along said centerline to the
centerline of Bronson Street; thence west along said centerline to the
point of beginning.
be and the same hereby established as "D" Light Industrial, "F" Height
and Area.
Section 5
The following parcels of land, being a part of the City of South Bend,
Portage Township, St. Joseph County, Indiana, and being more particularly described
as follows, viz:
Lot 41, except the south thirty -eight (38) feet, of the Replat and Resurvey
of Rush Second Addition to the Cityof South Bend.
Part of Lots 18, 19 and 20 as shown on the recorded Plat of John Rush's
First Addition to the City of South Bend, described as beginning at the
Northwest corner of said Lot 18; thence East along the south line
of Monroe a distance of 114.87 feet to the northeast corner of said Lot
20, which is on Lincolnway East, thence south 37 1 /40 east along the
westerly line of Lincolnway East a distance of 158.68 feet; thence west
210.52 feet to the west line of said lot 18; thence north along said
west line of Lot 18, a distance of 126.32 feet to the place of beginning.
AND ALSO, that part of Monroe Street, now vacated, described as beginning
at the Northwest corner of said Lot 18; thence North 30 plus or minus
feet a point which was on the centerline of the former Monroe Street;
thence east 90 plus or minus feet to the west line of Lincolnway East,
thence South 37 1/40 East along the Westerly line of Linconway East a
distance of 40 plus or minus feet to northeast corner of Lot 20; thence
west along the north line of Lot 20, 19 and 18 to the place of beginning.

Area, as an exception to the parcel of land described in Section 1 herein.
Section 6
This ordinance shall be in full force and effect from and after its passage
by the Common Council, approval by t e M ayor and legal publication.

Attached is an ordinance amending Chaper 21 of the Municipal Code,
rezoning the Monroe Sample area. This rezoning conforms to the Monroe
Sample Development Plan by establishing specific sub -areas for residential,
commercial and industrial use.
The attached map is provided for your information.

RE: A proposed ordinance initiated by Councilman Lewis McGann to zone
from "B" Residential, "C" Commercial and "D" Light Industrial, "B"
"E ", "F" and "G" Height and Area to "B" Residential, "C" Commercial
and "D" Light Industrial, "E" and "F" Height Area, property located
in the Monroe- Sample Redevelopment Area, City of South Bend.
Gentlemen:
The attached rezoning petition of Lewis McGann was legally advertised
November 7, 1981. The Area Plan Commission gave it a public hearing on
November 17, 1981, at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by Joseph Simeri
and unanimously carried, the proposed ordinance initiated by Council-
man Lewis McGann to zone from "B" Residential, "C" Commercial and
"D" Light Industrial, "B ", "E ", "F" and G Height and Area to "B"
Residential, "C" Commercial and "D" Light Industrial, "B" and "F"
Height Area, property located in the Monroe - Sample Redevelopment
Area, is sent to the Common Council without a recommendation.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report. Attached,
for your consideration in the review of this matter, is a copy of the Area Plan
Commission's Staff Report.

REQUESTED ACTION: This petition is to rezone the Monroe - Sample Development
Area from "B" Residential, "C" Commercial and "D" Light
Industrial, "B," "E," "F," and "G" Height and Area to
"B" Residential, "C" Commercial and "D" Light Industrial,
"E" and "F" Height and Area, to allow for residential,
commercial and industrial uses in compliance with the
adopted Monroe - Sample Development Plan.
EXISTING LAND USE: The Monroe - Sample Area contains residential, commercial,
and industrial uses along with vacant land.
LOCATION: The Monroe - Sample Development Area is bounded approxi-
mately by Monroe Street on.the- north, Lincolnway East
on the east, Sample Street on the south, and Michigan
Street on the west.
