Attach a listing of the names and addresses of all subcontractors (i.e. persons or firms outside your own firm who have performed part of the work) that you have used on public works projects during the past five (5) years along with a brief description of the work done by each subcontractor. 3. If you intend to sublet any portion of the work, attach the name and address of each subcontractor, equipment to be used by the subcontractor, and whether you will require a bond. However, if you are unable to currently provide a listing, please understand a listing must be provided prior to contract approval. Until the completion of the proposed project, you are under a continuing obligation to immediately notify the City of South Bend in the event that you subsequently determine that you will use a subcontractor on the proposed project. 4. Attach a listing of equipment you have available to use for the proposed project. 5. Have you entered into contracts or received offers for all materials which substantiate the prices used in preparing your proposal? If not, attach an explanation for the rationale used which would corroborate the prices listed. SECTION III CONTRACTOR'S FINANCIAL STATEMENT Attachment of bidder's financial statement is mandatory. Any bid submitted without said financial statement as required by statute shall thereby be rendered invalid. The financial statement provided hereunder to the City of South Bend awarding the contract must be specific enough in detail so that said City of South Bend can make a proper determination of the bidder's capability for completing the project if awarded. Contractor shall require his/her/its subcontractors performing work under this public contract to certify that the subcontractors do not knowingly employ or contract with an unauthorized alien, nor retain any employee or contract with a person that the subcontractor subsequently learns is an unauthorized alien, and that the subcontractor has enrolled in and is participating in the E-Verify Program. Persons, firms, partnerships, corporations, associations, or joint venturers awarded a contract by the City of South Bend through its agencies, boards, or commissions shall not discriminate against any employee or applicant for employment in the performance of a City contract with respect to hire, tenure, terms, conditions, or privileges of contract or employment, or any matter directly or indirectly related to contracting or employment because of race, sex, religion, color, national origin, ancestry, gender expression, gender identity, sexual orientation, or due to age or disability that does not affect that person's ability to perform the work. In awarding contracts for the purchase of work, labor, services, supplies, equipment, materials, or any combination of the foregoing including, but not limited to, public works contracts awarded under public bidding laws or other contracts in which public bids are not required by law, the City, its agencies, boards, or commissions will consider the Contractor's good faith efforts to obtain participation by those subcontractors certified by the State of Indiana as a Minority Business ("MBE") or as a Women's Business Enterprise ("WBE") as a factor in determining the lowest, responsible, responsive bidder. Contractors seeking the award of a City contract cannot be required to award a subcontract to an MWBE; however, they may not unlawfully discriminate against said MBE/WBE. GENERAL PHILOSOPHY The management of Ritschard Bros., Inc. ("Ritschard") is committed to providing a work environment which ensures the well-being of all Ritschard employees, protects Ritschard's and employees' property and prohibits any influences which might have a detrimental effect upon the orderly, safe and efficient operation of the business. Based upon these goals, Ritschard will require all potential employees to submit to pre- employment drug screening as apart of the pre -employment evaluation and its employees to report for work and perform their duties within the standards established. The intent of this policy is to ensure that the individuals hired by Ritschard are free of the effects of controlled substances and to intervene when an employee may be working in a condition that may potentially harm himself/herself, fellow employees or other individuals or property- B. APPLICATION OF POLICY 1. This policy applies to all applicants and employees. 2. A separate alcohol and controlled substance testing policy has been established for those employee -drivers who are covered under the rules and regulations of the Department of Transportation (CDL Employees). (See Appendix 1 attached to this policy.) C . DEFINITIONS 1. Chemical Substances: (a) any illegal substance, including, but not limited to, narcotics, hallucinogens, cocaine, marijuana, designer drugs; (b) any controlled substance, including, but not limited to, amphetamines and barbiturates, which are used either without being prescribed by a licensed physician or in excess of the amount prescribed by a licensed physician; and (c) any beverage containing alcohol. 2. Unfit Condition: Manifesting behavior which includes, but is not limited to, the following: (a) drowsiness; (b) sleepiness or sleeping; (c) slurred and/or incoherent speech; (d) unusually aggressive behavior; (e) unusually depressive behavior; (f) unusual and rapid changes in mood; (g) disorientation or inability to concentrate; (h) lack of coordination in walking or -performing other tasks. 3. Unsatisfactory Job Performance: Incidents which indicate job performance problems, including, but not limited to, the following: (a) unexplained work errors; (b) unusual difficulty in performing normal or routine duties; (c) unexplained on -the job accident; (d) unexplained on -the job injury. 4. History of Unsatisfactory Job Performance: A pattern of recurring job performance problems such as poor work performance, absenteeism, tardiness, minor injuries/accidents or other job difficulties. 5. Reportable Accident: Any accident on the job which results in death or bodily injury to one or more individuals requiring medical treatment away from the accident scene, or damages to property totalling $500.00. 6. Off -Duty Misconduct: Any arrest by a law enforcement agency for off -duty use, sale or possession of chemical substances or for other off -duty drug activity. 7. Fitness -for -Duty Evaluation: A medical examination which may include testing for chemical substances. 8. Positive Test. A positive test is one which indicates the presence of any drug listed in Exhibit A. 9. Negative Test. A negative test is one which does not indicate the presence of any drug listed in Exhibit A. D. PRE -EMPLOYMENT DRUG SCREENING POLICY 1. All individuals submitting applications for employment to Ritschard will be provided with a copy of the written Notice to All Applicants and will be orally informed, at the time of making application, about the requirement of a urine drug screen. All applicants must sign a copy of the notice acknowledging that the applicant has received a copy of the Notice. 2. All applicants who meet the criteria for employment will be screened for drugs prior to being made an offer of employment. In the unlikely event that it is necessary to make an offer of employment prior to the applicant undergoing drug screening, the offer shall be made contingent upon the applicant's compliance with the drug screening program. The applicant will be specifically informed that if the applicant refuses to fully cooperate with -2- Ritschard's drug screening policies and procedures, or fails the drug screening test, the offer of employment will be rescinded. 3. Applicants who refuse to take the drug screening test or do not sign the appropriate Consent and Release form (Consent Form 1) shall not be offered employment. 4. Applicants who test positive for drugs with no legitimate medical explanation shall not be employed. An applicant who tests positive may, at the applicant's option and own expense, undergo confirmatory testing of the original sample at the independent laboratory that performed the initial testing. The GC/MS will be used for confirmatory testing. If the applicant tests negative upon confirmatory testing, Ritschard will consider the applicant eligible for employment. If the applicant tests positive upon confirmatory testing, the applicant will not be employed. 5. The cost of the initial screening and evaluation will be paid by Ritschard. E. FITNESS -FOR -DUTY POLICY 1. Compliance With This Policy is Considered a Condition of Employment (a) If an employee refuses to comply fully with all aspects of this policy, such employee will be suspended without pay pending completion of an investigation. During the course of the investigation, the employee shall have the opportunity to offer an explanation for his or her behavior. Management will decide the course of action. 2. Possession, Sale or Use of Chemical Substances. (a) Employees will be subject to immediate discharge if caught selling, using, or being in possession of chemical substances (i) on company premises, including the company parldng lot; (ii) on the job site; (iii) while in or responsible for company vehicles at or away from company premises; or (iv) while on company business at or away from company premises, including the job site. (b) An employee who is arrested for off -duty drug activity, including use, sale or possession of narcotics, drugs or other illegal chemical substances will be considered to be in violation of this policy and -3- may be suspended or terminated by the Company. In deciding what action to take, the Company will take into consideration the nature of the charges, the employee's present job assignment, the employee's record with the Company, including length of service and other factors relative to the impact of the employee's arrest upon the conduct of the Company's business and reputation. 3. Searches. (a) Ritschard may conduct unannounced searches for chemical substances in company facilities, in company property or on company premises, including company vehicles in the company parking lot. Employees are expected to cooperate in the conducting of such searches. (b) Searches of employees and their personal property may be conducted upon reasonable suspicion; this includes, but is not limited to, when an employee appears to be in an unfit condition, or when there has been a reportable accident, or when circumstances or workplace conditions justify such search in the employer's sole discretion. (c) Although an employee, or his personal property, will not be searched without consent, an employee's consent to such a search is required as a condition of employment and the employee's refusal to consent will result in the employee's suspension without pay for thirty (30) calendar days on the first refusal and termination on the second refusal. (d) Searches of company facilities and company property, including lockers and company vehicles, can be conducted at any time and do not have to be based on reasonable suspicion. 4. Random Testing. (a) The Company may require a test on a random basis if: (i) The test is authorized by federal or state law. (ii) The employee serves in an occupation that regulations of the Indiana Department of Labor have designated as a high risk or safety -sensitive occupation. (iii) The test is conducted as part of an employee assistance program sponsored or authorized by the employer in which the employee voluntarily participates. (iv) The employee's occupation separates the employee from a supervisor's ability to ascertain whether the employee is in an unfit condition. (b) The employee selected for random testing and the employee's direct supervisor will be notified within two (2) hours of the scheduled testing. (c) If the employee was randomly selected, the Company shall explain to the employee that the employee is under no suspicion and that the employee's name was selected randomly. (d) An employee selected for random testing may obtain a deferral of testing if the employee's supervisor and another management person concur that there is a compelling need to defer the testing. An employee whose random test is deferred will be subject to an unannounced test within the following sixty (60) days. 5. Evaluation Procedure. (a) An employee may be requested to undergo a fitness -for -duty evaluation if- (i) The employee appears to be in an unfit condition at work; (ii) The employee demonstrates unsatisfactory job performance; (iii) The employee demonstrates a history of unsatisfactory job performance; (iv) The employee is involved in off -duty misconduct; or (v) The employee is involved in a reportable accident while on the job. (b) An employee who (1) refuses to submit to a fitness -for -duty evaluation in accordance with the provisions of this policy, or (2) -5- refuses to fill out and sign the written consent form agreeing to submit to the medical examination and/or testing and permitting Ritschard to be apprised of the testing results or fitness -for -duty evaluation (Consent Form 2), will be subject to immediate discharge. (c) An employee who switches or adulterates any sample submitted for testing will be subject to immediate discharge. F. EMPLOYEE ASSISTANCE PROGRAM 1. Employees who are determined, as a result of the fitness -for -duty evaluation, to have used chemical substances in excess of the limits set forth in Exhibit A, shall be required to attend and pay for at their own expense a treatment program offered by an outside provider. The cost of the program will be fully explained to each employee. Refusal to participate in or complete the program or the after -care program will result in the employee's termination. 2. Employees who believe that they have a chemical substance problem should promptly contact the President of the Company. The employee will be given the opportunity to enroll in a voluntary program operated by professional counselors. The cost of the program will be fully explained to each employee. 3. Employees who participate in the program will be tested for chemical substances in accordance with the provisions of the program until the program ends. A positive test result following the commencement of the program will subject the employee to immediate discharge. 4. Employees who complete the program will be tested for chemical substances in accordance with the recommendations of the Medical Review Officer. The days on which the testing will occur will be unannounced. If an employee tests positive for chemical substances after the completion of the program, the employee will be subject to immediate discharge. If eighteen (18) months pass without a positive test for chemical substances, there will be no presumption in the future that the employee is using a chemical substance or is under the influence. Should any testing procedure indicate that an employee has used chemical substances in excess of the limits set forth in Exhibit A, the employee may, at his or her option and own expense, have a confirmatory test performed on the original sample at the laboratory which performed the initial testing. The laboratory shall use the GUMS test (for drugs) or the blood alcohol test (for alcohol), whichever is applicable under the circumstances. If the confirmatory test indicates the employee has not used chemical substances in excess of the limits set forth in Exhibit A, the results of the confirmatory test will control for the purposes of any subsequent action. In addition, Ritschard will purge the employee's personnel record of the results of the initial test. If the confirmatory test indicates the employee has used chemical substances in excess of the limits set forth in Exhibit A, the results of the confirmatory test will control for the purposes of any subsequent action. H. COLLECTION AND TESTING PROCEDURES 1. Collection Procedures. (a) All reports of medical examinations and treatment status and chemical substances tests will be maintained in a confidential manner with original medical records remaining with the Medical Review Officer (MRO) at the collection facility. (b) Initial urine collection shall be performed in private. The collection facility shall check the sample for temperature, pH, specific gravity, and urine creatinine level to determine whether adulteration has occurred. If collection facility personnel suspect adulteration has occurred, a second sample shall be collected in direct visualization by collection facility personnel of the same gender as the applicant to verify the source of the sample. (c) The MRO shall be a licensed physician who is responsible for receiving laboratory results generated from the Company's drug testing program. The MRO must have knowledge of substance -7- abuse disorders and have appropriate medical training to interpret and evaluate an individual's positive test result together with the employee's medical history and any other relevant biomedical information. The MRO can be an employee of the Company or a private physician performing review services for the Company. (d) The collection facility shall follow the appropriate chain of custody protocol established in accordance with federal regulations and the testing laboratory. 2. Testing Procedures. (a) Testing will be performed by an independent laboratory certified by the United States Department of Health and Human Services. All testing should be done under the direction of a board -certified forensic toxicologist. The testing laboratory should also be a participant in the College of American Pathologists accreditation program and the accreditation program offered by the State of Indiana. (b) The testing laboratory will define and publish an appropriate chain of custody protocol in accordance with federal and state regulations. I. MANAGEMENT RESPONSIBILITY 1, All management employees (including supervisors) are responsible for maintaining a drug- and alcohol -free environment. At a minimum, all management employees will receive basic training on identification of behavioral and psychological signs of alcohol and substance abuse. 2. In addition to the basic training, certain management employees who are responsible for identifying employees, including CDL Employees, who appear to be unfit to perform their duties safely due to alcohol or substance abuse, will additionally receive Company provided DOT Supervisor Training in accordance with Department of Transportation, Federal Motor Carrier Safety Regulations. I Any supervisor who believes an employee is in an unfit condition and cannot continue to work shall report his/her observations to the Project Manager or Safety Director and shall complete the Observation Checklist. In 4. Upon receipt of information that an employee is believed to be in an unfit condition, the Project Manager or Safety Director shall interview the employee and conduct whatever investigation is deemed necessary to determine if the employee needs to be sent for a Fitness -for -Duty evaluation. A Fitness -for -Duty questionnaire should be completed at the time of the interview. 5. If the Project Manager or Safety Director concludes that the employee is in an unfit condition and cannot continue to work because of either alcohol or substance abuse, the employee shall immediately be referred to the collection facility for a Fitness -for -Duty evaluation. In addition, the employee should be suspended from work, without pay, pending the results of the Fitness -for -Duty evaluation. 6. An employee who appears to be in an unfit condition will be asked to sign a Testing Consent and Release Agreement. If the employee refuses= to consent to a Fitness -for -Duty evaluation, the employee should be suspended, without pay, pending termination. 7. Regardless of the outcome of this process, the supervisory staff members are responsible for transporting the employee either to the medical facility, back to the work site, or to the employee's home. Only if the employee openly refuses transportation shall the management staff involved abdicate this responsibility. Any refusal by the employee to accept such assistance should be documented by management. Should the employee insist upon driving himself/herself home, management is to contact the local police authorities, indicating what behavior has been observed, his/her refusal to accept assistance in getting home, the make of his/her automobile, and his/her license plate number. The date and time of this call should be recorded along with the name of the police personnel who took the call. 8. Throughout this process, supervisory personnel should not attempt to diagnose possible causes of observed behaviors. It is the supervisor's responsibility, however, to communicate with the medical personnel involved as to what behaviors have been observed and reasons for concern.
