Comprehensive documentation provides a complete understanding of the project. Problems often occur during a project review or during the execution of the project when the property owner, staff or commissioners are unclear as to project specifics. Applications will NOT be processed without required documentation. Photographs may be submitted in digital format or in photographic print. When a project involves blueprints and/or site plans, one (1) set shall be submitted with the Application. Any documentation submitted to this office cannot be returned to the applicant. APPLICATION FEE The application processing fee for any Application for a Certificate Of Appropriateness is $20 Payment must accompany the application at the time of submission. For an electronically submitted application, payment must reach the HPC office within 48 hours following transmission. MEETING ATTENDANCE When an Application has been scheduled for any meeting, the owner, architect or contractor(s) retained for the project shall attend the meeting where their project will be reviewed and a decision rendered. Failure by the owner, architect, or contractor to attend such meetings may result in denial of the Application due to insufficient representation. CERTIFICATE ISSUANCE Certificates of Appropriateness will be filed with the Building Department of South Bend and St. Joseph County. A copy of the Certificate will be emailed directly to the owner and/or contractor(s) listed on the application. INSPECTION AUTHORITY All projects will be inspected during and following execution for compliance with the decision(s) rendered by the Historic Preservation Commission of South Bend and St. Joseph County. As to the Products used in the Work, all warranties are those of the manufacturer or supplier and are not from the Warrantor. Customer accepts all such warranties from the manufacturer or supplier and acknowledges that it has no rights or remedies against Warrantor with respect to the Products used in the Work. Warrantor’s Performance: If a latent defect occurs in an item that is covered by this Limited Warranty, the Warrantor will repair, replace, or pay you the reasonable cost of repairing or replacing the defective item. The Warrantor’s total liability under this Limited Warranty shall not exceed the price of the Work. The choice among repair, replacement, or payment is the Warrantor’s. Steps taken by the Warrantor to correct defects shall not act to extend the terms of this Limited Warranty. Warrantor shall not be obligated to remedy any defects where otherwise required pursuant to this Limited Warranty unless and until Customer notifies Warrantor in writing of the defect and then only if such notification is made either sixty (60) calendar days subsequent to completion or thirty (30) calendar days prior to the expiration of the Warranty Period. Contractor shall have the right to substitute products designated by Contractor to be equivalent quality, and minor color variations may exist between replacement product and originally installed product, and such shall not constitute a defect. Insurance: In the event the Warrantor repairs or replaces, or pays the cost of repairing or replacing any defect covered by this Limited Warranty for which you are covered by insurance, upon request by the Warrantor, you shall assign the proceeds of such insurance to the Warrantor to the extent of the cost to the Warrantor of such repair or replacement. 1638.005047/Limited Warranty 8.4.20 Page 2 Exclusions: The following are not covered by this Limited Warranty: 1. Ice build-up on roof. During prolonged cold spells, ice build-up is likely to occur at the eaves of a roof. This condition occurs when snow and ice accumulate, and gutters and downspouts freeze up. Prevention of ice build-up on the roof is the Customer’s responsibility. 2. Any damage caused by condensation, which may occur during seasonal weather changes or improper humidity levels or improper ventilation. 3. Any damage caused by the Customer’s improper use of a humidifier, which may occur during seasonal weather changes. 4. All personal property and fixtures which are consumer products (as that term may be defined under applicable federal, state and local laws, or their implementing regulations), are not covered by this Limited Warranty or any other warranty from the Warrantor. Such items are frequently covered by the manufacturer’s specific warranty, and such warranties, if any, are assigned and delivered to Customer upon completion. Warrantor is not a warrantor under and does not adopt such manufacturer’s or supplier’s warranties. In the event of defects in such products, Customer should contact the manufacturer or supplier directly. Warrantor is not responsible for the performance of any manufacturer under such manufacturer’s warranty. 5. Any bodily injury, any damage to personal property, or damage to real property which is not part of your House. 6. Any damage to the extent it is caused or made worse by: A. Negligence, improper maintenance or improper operation by anyone other than the Warrantor or its employee, as agents or sub-contractors; or B. Failure to give notice to the Warrantor of any defect within a reasonable time; or C. Improper maintenance; or D. The Products. 7. Any defects in, or caused by, materials or work supplied by anyone other than the Warrantor, or its employees, agents or sub- contractors. 8. Normal wear and tear or normal deterioration. 9. Accidental loss or damage from causes such as, but not limited to: fire, explosion, smoke, water escape, glass breakage, windstorm, hail, lightning, falling trees, aircraft, vehicles, flood and earthquake. 10. Minor color variations. 11. Any mold. II. HOW TO MAKE A LIMITED WARRANTY CLAIM Submission of Claims to Warrantor. If you have a complaint, you must send a clear and specific complaint to the Warrantor on that item prior to the time the Warranty expires. III. MISCELLANEOUS Notices. All notices to the Warrantor or to you must be sent by mail, postage prepaid, certified mail, return receipt requested to the recipient at the address shown for the recipient on page 2 or to whatever other address the recipient may designate in writing. For further explanation please discuss in detail with your sales representative. LIGHT FIXTURES, PICTURES, and MIRRORS These items could fall and break due to the vibration of the work being done. We suggest that you check all fixtures, pictures, mirrors, etc. to make sure they are secure. If in doubt, take them down. We will not assume responsibility for these items as a result of the normal vibrations of home improvement work. ACCESS We plan to utilize driveways and walkways where they provide the necessary access to your home. If there is not sufficient access, we will put plywood down before driving on your lawn. We will not be responsible for any damage that occurs to the concrete or asphalt during this process. Please notify us in writing, five days prior to the job starting if you have a sprinkler system, septic field, a well or if you do not want us to use your driveway for our services. SCHEDULING Your material will be delivered before the project will begin. The office will contact you one day before your job is to begin. If there is no answer we will leave a message. Please be advised that scheduling conflicts can occur due to circumstances beyond our control. SCHEDULING MULTIPLE PROJECTS If more than one project is being completed at your home, please be advised that there will be a brief period of time between each installation. Each project will also be invoiced separately. We appreciate your cooperation and patience during this process. Please ask your salesperson to explain this procedure in more detail if necessary. HOMEOWNERS ASSOCIATION / PROPERTY OWNERS ASSOCIATION It is the responsibility of the homeowner to notify M&M of any specific rules, colors or specifications that pertain to their list of covenants. CANCELLATIONS OF CONTRACT Customers have three business days from the date of contract signing to rescind their contract without penalty. If a customer chooses to cancel their contract after that time, they will incur a processing fee equal to 25% of their contract price plus the cost of any custom product. When applicable, these fees will be deducted directly from the customer’s down payment, otherwise the customer will be billed for these fees. SPECIFICS PERTAINING TO EXTERIOR PROJECTS: AWNINGS, GRILLS, LAWN FURNITURE, AND ANY OTHER EXTERIOR FIXTURES These items should be removed, protected, rolled up, etc. by the homeowner before our crews arrive to start any exterior home improvement work. TREES AND BUSHES If you have low hanging branches over your roof or against your siding, some trimming will be necessary. Homeowner will be responsible for cutting back any branches that limit M&M’s ability to do an efficient workmanlike job. Trees and bushes must be cut back prior to scheduling the start of your project. TEAR OFFS When it is necessary to remove your existing roof, some debris and/or asphalt may fall through the sheeting boards into your attic or garage. We suggest covering or removing items, which require protection. M&M will not be responsible for any interior clean up. Nails will be used to install the shingles on your roof. These nails will protrude through the roof deck and be visible in the attic. WOOD REPLACEMENT M&M is not responsible for any moldy or damaged wood, which is visible from the interior of the building only. Homeowners should notify us, in writing, prior to the start of their job, should they wish to have us replace this type of decking. Any wood that is replaced by M&M will not be primed or painted unless otherwise stated. Any rafter work performed by M&M will be sistered onto existing rafters for additional support unless otherwise noted. PLYWOOD DECK If it becomes evident, once your existing roof has been removed, that the plywood deck was installed without proper spacing, M&M, will make the necessary repairs to the existing roof deck to ensure that the plywood underlayment is properly spaced. This may result in an extra charge at an hourly rate of $75 per hour. HIDDEN LINES M&M is not responsible for air conditioning lines, electrical wiring or conduit, plumbing pipes, cable or antenna wires that are mounted to the interior rafters, studs, decking or siding. It is the responsibility of the homeowner to inform M&M of any of these conditions prior to the start of the job. Customer is responsible for notifying M&M at contract signing if the home has any built-in shelving, bathroom niches, or other unique wall features that could get damaged during a siding installation. Without being notified ahead of time, M&M cannot be held responsible should any nails penetrate these areas, that would normally be a wall cavity. PLUMBING VENT PIPES Over time, cast iron pipes can rust and may need to be replaced by a plumber when pipe flashings are removed and replaced. In addition, built up corrosion on the inside of the pipe can become dislodged, due to the vibration that occurs during the tear off process. Should this be the case, M&M will not be responsible for the additional charges or for any damages that may occur if the pipe falls from its original position. MULTIPLE LAYERS M&M will not be responsible for stains and gaps that become visible along your siding walls after multiple layers are removed, and only one layer is installed. If you have questions please ask your salesman. DISCOLORATION Airborne pollutants can cause staining or discoloration to appear on your gutters and other exterior products on your home. This discoloration or staining can be seen especially when light colored products are installed. Neither M&M nor their manufacturers are responsible for stains or discoloration on your new gutters or other exterior products as a result of environmental factors, which are beyond their control. VENTILATION If not contracting with M&M for these services, it is the responsibility of the homeowner to ensure that their attic is insulated properly and that the insulation is not restricting intake ventilation from eave vents. It is also the responsibility of the homeowner to make sure that all exhaust vents (i.e. dryers, range hoods, bathroom vents, etc.) are properly ventilating to the exterior of the home. M&M is not responsible for moisture buildup, condensation, installation of soffit vents, mold or mildew growth in your home relating to improper or insufficient air intake and insulation. If it is discovered that cathedral areas of your roof do not contain baffles which facilitate proper air flow M&M will need to install at $4.00 per baffle. If boards need to be removed and replaced to install baffles, the charge will be $3.00 per foot. Plywood will be removed to determine if baffles are present. If existing plywood is found to be in good condition, those sheets will be reinstalled. The price to REMOVE AND REINSTALL plywood is $30 per sheet. If the existing plywood is found to be rotten or cracked and needs to be replaced with NEW plywood, the plywood price on the first page of the contract will be charged. BROAN VENTS When applicable, M&M will install new broan vent(s) into existing locations or cut in additional broan vents and connect to existing bath fans with a flex hose. This will allow for the warm, humid air to escape out the roof instead of into the attic space. M&M is NOT responsible for broan vents or bath fans that come dislodged after the initial installation, nor re-connecting broan vents at a future date. It’s the responsibility of the customer to ensure the vents are properly secured and fastened to exhaust pipes. Melting snow has nowhere to go, so water gets between shingles, which can cause leaks. This is not a problem related to the roofing workmanship. This problem is out of our control. M&M will not be responsible for leaks that occur because of ice damming. SEEPAGE AND WATER IN BASEMENTS M&M is not responsible for any seepage or water leakage in basements, which may occur in the absence of gutters and downspouts. If not written and specified on the contract where the downspouts should go, they will be installed back at the original location. ANTENNAS Please notify the office before work begins if you want your antenna removed. We will remove and/or dispose of antennas. We will not install new antennas. M&M will not be responsible for antenna reception. SATELLITE DISHES M&M will lift your satellite dish and will reset it where it is currently located and will ensure proper flashing of the dish. However, M&M is not responsible for any damages caused to the dish during this process or responsible for the reception of the dish. No exceptions will be made. If you prefer, you may contact your Satellite provider and have them remove the dish prior to the start of the job and reinstall it upon completion of the job. GUTTER REMOVAL AND REINSTALL- If M&M is replacing fascia and soffit, but not existing gutters, and wood fascia boards need to be replaced we will charge $75.00 per every 50’ of gutters that need to be removed and reinstalled. This price does not include wood charges that are stated on the contract. GUTTER GUARDS - If you have existing gutter guards and M&M needs remove and replace them in an effort to complete your project. M&M cannot be responsible for minor damages due to this process. If you would prefer to remove them yourself prior to the installation please have this done no later than one week from the date of your contract signing. SKYLIGHTS - M&M strongly recommends the replacement of skylights with the replacement of a new roof. If at the request of the customer the existing skylight(s) are not to be replaced with the roof, M&M cannot be held responsible for leaking after the install or damage to the existing skylight(s) during the install. By initialing here: you acknowledge that any existing skylights you decide not to have replaced (and areas immediately surrounding) will not have any warranty, OR that all your existing skylights are being replaced. SPECIFICS PERTAINING TO WINDOW AND DOOR PROJECTS: WINDOW TREATMENTS It is the responsibility of the homeowner to remove and later reinstall any and all window treatments prior to the start of your job. M&M will not be responsible for shades, blinds, or window treatments of any kind if not removed prior to job start. When installing replacement windows there is the possibility that your existing blinds/window treatments may no longer fit in the opening. M&M cannot be responsible for this. Please see the measure technician for further explanation, if necessary. FURNITURE & APPLIANCES It is the responsibility of the homeowner to remove all furniture and appliances a minimum of three feet away from all windows and doors to allow access for installation. M&M is not responsible for damages caused to furniture or appliances that are not moved prior to the start of your job. CAULKING is considered routine maintenance and therefore it is the responsibility if the homeowner. WOOD REPLACEMENT Unless previously agreed upon, any weak or rotten wood which is visible to our crew during the window/door installation will be replaced as necessary. The additional cost to the customer will be as follows: $4.85 per foot for all 1x4, 1x6 and 1x8 replacement and $10.50 per foot for any 2x4, 2x6 and 2x8 replacement. Any wood that is replaced by M&M will not be primed or painted unless otherwise stated. HAND STAINING As is the nature of hand-applied stain on wood, colors and grain patterns may vary slightly on all windows, wood trim and other wood products. CONDENSATION M&M is not responsible for conditions beyond its control, including condensation. Condensation is the result of excess humidity in your home. GLASS SPACE The glass space in your custom vinyl replacement windows could be slightly less than your existing windows. This is due to the construction of the window and is not a result of mismeasuring. LIFETIME LABOR WARRANTY Only applies to windows and sliding patio doors that have a manufacturing defect. If damage or defect is a result of an accident in the home, vandalism, or an act of God there will be a labor fee associated with the warranty. SPECIFICS PERTAINING TO INSULATION PROJECTS: CONDENSATION M&M is not responsible for conditions beyond its control, including condensation. Condensation is the result of excess humidity in your home. EXTERIOR UNDER VENTILATION M&M is not responsible for pre-existing conditions in your attic space including but not limited to the presence of mold & mildew. As manufactured, fiberglass insulation is resistant to mold growth. However, mold growth can occur on building materials, including insulation when it becomes contaminated with organic material and when water is present. M&M is not responsible for mold or mildew formation in your attic space for any reason. HVAC M&M is not responsible for pre-existing damages or deficiencies with your HVAC system. ELECTRIC USAGE M&M will need to use your electric for the powering of the insulation machine. ATTIC ACCESS It is the responsibility of the customer to clear a path to allow for access into your attic. If your attic access is located in a closet, all shelving, clothing and contents must be removed by the homeowner prior to the installation. ATTIC CONTENTS It is the responsibility of the customer to remove all attic contents prior to the installation of your insulation. In the event that you fail to remove attic contents, M&M will not be responsible for any damages to these items. EXHAUST VENTS M&M is not responsible for venting stove/range exhaust hoods, bathroom exhaust fans and dryer ventilation. These vents must be ventilated to the exterior of the home and are the responsibility of the customer to ensure that they are properly ventilated. VENTILATION If any of the requirements of intake and exhaust ventilation are not contracted with M&M, we will not be responsible for condensation, mold and mildew formation, or for any improper functioning of your attic insulation or ventilation. PAINTING It will be the responsibility of the homeowner to paint any added soffit vents cut into your existing wood soffit. COMPRESSION / SETTLING M&M is not responsible for settling of your new insulation when installed over any type of existing insulation. SPECIFICS PERTAINING TO REPAIR PROJECTS: COLORING The color of all products installed for Repair Work may vary from the original products due to age, fading, discoloration of product, etc. WARRANTY Repair projects do not include a labor warranty, unless otherwise specified on the contract. Coverage: Beginning on the Warranty Commencement Date, the Contractor warrants that the Work will be free of latent defects due to faulty workmanship, except as limited and clarified herein, for the following Work and Periods, subject to all Exclusions: WORK WARRANTY PERIOD EXCLUSIONS Shingle Roofs Lifetime Windows Lifetime 5-year warranty on caulking which is a maintenance issue thereafter. Ecolite series window 5 year labor Vinyl Siding Lifetime 5-year warranty on caulking which is a maintenance issue thereafter James Hardie Siding Lifetime 5-year warranty on caulking which is a maintenance issue thereafter Attic Insulation Lifetime Residential Flat Roof 10 years Soffit & Fascia 10 years Acts of God, including winds over 75 mph Doors 10 years Wear and tear to sweeps, weather stripping, or caulking Gutters 10 years 5-year warranty on joint sealer which becomes a routine maintenance thereafter Storm Door/Window 2 years Caulking, weather stripping No representative of Contractor has the authority to expand the scope of or extend the duration of this Limited Warranty or to make agreements with respect hereto. There shall be no other agreements, either verbal or implied , which supersede this Limited Warranty. “Faulty workmanship” is workmanship that is not in compliance with the applicable building codes regulating construction in the area. Inspection by the governmental jurisdiction will provide evidence of compliance. For purposes of this Limited Warranty, “latent defects” are limited to those defects which are not apparent at the time of Customer’s inspection, but which become apparent and of which Contractor is notified in writing within the applicable Warranty Period. “Products” are the materials used by the Contractor in the Work. As to the Products used in the Work, all warranties are those of the manufacturer or supplier and are not from the Warrantor. Customer accepts all such warranties from the manufacturer or supplier and acknowledges that it has no rights or remedies against Warrantor with respect to the Products used in the Work. Warrantor’s Performance: If a latent defect occurs in an item that is covered by this Limited Warranty, the Warrantor will repair, replace, or pay you the reasonable cost of repairing or replacing the defective item. The Warranto r’s total liability under this Limited Warranty shall not exceed the price of the Work. The choice among repair, replacement, or payment is the Warrantor’s. Steps taken by the Warrantor to correct defects shall not a ct to extend the terms of this Limited Warranty. Warrantor shall not be obligated to remedy any defects where otherwise required pursuant to this Limited Warranty unless and until Customer notifies Warrantor in writing of the defect and then only if such notification is made either sixty (60) calendar days subsequent to completion or thirty (30) calendar days prior to the expiration of the Warranty Period. Contractor shall have the right to substitute products designated by Contractor to be equivalent quality, and minor color var iations may exist between replacement product and originally installed product, and such shall not constitute a defect. Insurance: In the event the Warrantor repairs or replaces, or pays the cost of repairing or replac ing any defect covered by this Limited Warranty for which you are covered by insurance, upon request by the Warrantor, you shall assign the proceeds of such insurance to the Warrantor to the extent of the cost to the Warrantor of such repair or replacement. Ice build-up on roof. During prolonged cold spells, ice build-up is likely to occur at the eaves of a roof. This condition occurs when snow and ice accumulate, and gutters and downspouts freeze up. Prevention of ice build-up on the roof is the Customer’s responsibility. 2. Any damage caused by condensation, which may occur during seasonal weather changes or improper humidity levels or improper ventilation. 3. Any damage caused by the Customer’s improper use of a humidifier, which may occur during seasonal weather changes. 4. All personal property and fixtures which are consumer products (as that term may be defined under applicable federal, state and local laws, or their implementing regulations), are not covered by this Limited Warranty or any other warranty from the Warrantor. Such items are frequently covered by the manufacturer’s specific warranty, and such warranties, if any, are assigned and delivered to Customer upon completion. Warrantor is not a warrantor under and does not adopt such manufacturer’s or supplier’s warranties. In the event of defects in such products, Customer should contact the manufacturer or supplier directly. Warrantor is not responsible for the performance of any manufacturer under such manufacturer’s warranty. 5. Any bodily injury, any damage to personal property, or damage to real property which is not part of your House. 6. Any damage to the extent it is caused or made worse by: A. Negligence, improper maintenance or improper operation by anyone other than the Warrantor or its employee, as agents or sub-contractors; or B. Failure to give notice to the Warrantor of any defect within a reasonable time; or C. Improper maintenance; or D. The Products. 7. Any defects in, or caused by, materials or work supplied by anyone other than the Warrantor, or its employees, agents or sub- contractors. 8. Normal wear and tear or normal deterioration. 9. Accidental loss or damage from causes such as, but not limited to: fire, explosion, smoke, water escape, glass breakage, windstorm, hail, lightning, falling trees, aircraft, vehicles, flood and earthquake. 10. Minor color variations. 11. Any mold. II. HOW TO MAKE A LIMITED WARRANTY CLAIM Submission of Claims to Warrantor. If you have a complaint, you must send a clear and specific complaint to the Warrantor on that item prior to the time the Warranty expires. III. MISCELLANEOUS Notices. All notices to the Warrantor or to you must be sent by mail, postage prepaid, certified mail, return receipt requested to the recipient at the address shown for the recipient on page 2 or to whatever other address the recipient may designate in writing. General Provisions. Should any provision of the Limited Warranty be deemed by a court of competent jurisdiction to be unenforceable, that determination will not affect the enforceability of the remaining provisions. This Limited Warranty is to be binding upon the parties, their heirs, executors, successors, and assigns. Amendments. This Limited Warranty cannot be changed or altered in any way. We acknowledge receipt of the Workmanship Limited Warranty by our signature(s) below. THIS LIMITED WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES OF WARRANTOR, EITHER EXPRESS OR WHICH MAY BE IMPLIED BY LAW, INCLUDING ALL WARRANTIES OF HABITABILITY, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ALL OF WHICH ARE EXCLUDED. THIS LIMITED WARRANTY DOES NOT EXTEND TO INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHICH ARE EXPRESSLY WAIVED BY CUSTOMER. THE ONLY WARRANTIES PROVIDED BY WARRANTOR ARE THOSE CONTAINED IN THE ABOVE LIMITED WARRANTY, AND THE WARRANTOR HEREBY DISCLAIMS AND THE CUSTOMER HEREBY WAIVES THE IMPLIED WARRANTY OF HABITABILITY AND ACKNOWLEDGES, UNDERSTANDS AND AGREES THAT IT IS NOT A PART OF THE CONTRACT.
