MAY 8, 1995
Be it remembered that the Common Council of the City of South Bend met in the Council
Chambers of the County -City Building on Monday, April 10, 1995, at 7:00 p.m. The
meeting was called to order and the Pledge to the Flag was given.

REPORT FROM THE SUB - COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
The sub - committee has inspected the minutes of the March 28, and April 10, 1995
meetings of the Council and found them correct.
Therefore, we recommend the same be approved.

RESOLUTION NO. 2231 -95 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA, REQUESTING THE UNITED STATES GOVERNMENT
THROUGH THE POSTMASTER GENERAL TO ISSUE A COMMEMORATIVE
STAMP HONORING THE RESCUE WORKERS, VICTIMS, AND THEIR
FAMILIES OF THE OKLAHOMA CITY TRAGEDY.
Whereas, the Common Council of the
Americans throughout our great country, h
Oklahoma City last month; and
Whereas, the Council believes that a
victims and their families but also to
workers would be a small token of helping
and
City of South Bend, like the millions of
ave been stunned by the tragedy occurring in
sincere and fitting tribute not only to the
the hundreds if not thousands of rescue
Oklahoma City as well as our national heal;
Whereas, the April 20, 1995, AP photo of an Oklahoma city Firefighter carrying
one year old Baylee Almon epitomizes the heartfelt care, concern, and support of our
Nation, as those affected begin to rebuild, regroup, and rededicate their individual
lives as they begin to move forward in light of these devastating circumstances; and
Whereas, the Common Council further believes that as a further sign of our
Nation coming together as a fami.Ly, that appropriate legislation be considered which
would earmark two cents of every such Commemorative Stamp depicting the AP photograph
be earmarked into a non - reverting fund to assist the families of the victims and the
families of the volunteers like Rebecca Anderson, a nurse who gave her life recusing
victims from the Alfred Murray Federal Building in Downtown Oklahoma City.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, as follows:
SECTION I. The Common Council of the City of South Bend, Indiana, joins with the
millions of Americans in paying our respects to the families of the victims of the
Oklahoma City bombing and pays special tribute to the thousands of volunteers who
have been involved and continue to be involved in the search and rescue efforts.
SECTION II. The Common Council believes that the appropriate entities of the United
States Federal Government should begin discussions on the issuance of a special
Commemorative Stamp depicting the AP photo of a Oklahoma City Firefighter carrying
Baylee Almon, with two cents of each such stamp sold being earmarked into a special
non - reverting fund to assist =w«ilies of the victims and the volunteers who have been
forever affected by this tragedy.
SECTION III. The Common Council of the City of South Bend, Indiana, calls upon all
Americans to unite together in assisting the City of Oklahoma and all of its
residents in their own individual ways of helping them to move forward in rebuilding
their lives as positively as possible in light of the circumstances.
SECTION IV. This Resolution shall be in fuii L,rce and efrecu from and after its
adoption by the Common Council and approval by the Mayor.

A public hearing was held on the resolution at this time. Council President Ladewski
presented the resolution. He indicated he issuance of the stamp would commemorate
the tragedy, as well as memorialize those who died, as well as the rescuers. Steve
Weiger, President of the local Firefighters' Union indicated that firefighers
throughout the United States would support this resolution. Council Member Coleman
made a motion to adopt this resolution, seconded by Council Member Washington. The
resolution was adopted by a roll call vote of eight ayes.
RESOLUTION NO. 95 -31 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA, COMMENDING THE BETHEL PILOTS FOR WINNING THE
NAIA DIVISION II, NATIONAL CHAMPIONSHIP FOR 1995
Council Member Luecke made a motion to continue this resolution until May 22,
seconded by Council Member Coleman. The motion carried.
REPORT OF CITY OFFICES
Phil St. Clair, Superintendent of Parks, discussed their annual
report, a copy of this report had been given to the Council. He indicated they were
planning 16 million dollars worth of capital improvements over the next few years.
Council Member Coleman made a motion to resolve into the Committee of the Whole,
seconded by Council Member Washington. The motion carried.
COMMITTEE OF THE WHOLE
Be it remembered that the Common Council of the City of South Bend met in the
Committee of the Whole on at 7:25 p.m., with eight members present. Chairman
Washington presiding.
BILL NO. 16 -95 A BILL AMENDING THE ZONING ORDINANCE FOR THE PROPERTY LOCATED AT 3822
LINCOLNWAY WEST IN THE CITY OF SOUTH BEND, INDIANA
This being the time heretofore set for public hearing on the above bill, proponents
and opponents were given an opportunity to be heard. Council Member Coleman reported
that the Zoning and Annexation Committee had met on this bill and recommended it to
the Council favorable. John Byorni, Area Plan, reported that the petitioners were
requesting this zoning for a car rental and sales facility. He described the
surrounding area. He reported that the Area Plan Commission gave this zoning a
favorable recommendation. Anthony Zappia, attorney, indicated that Budget Rent a Car
is presently zoned "C" and "B" residential, and they were requesting a "C" commercial
for the entire site. He indicated the car rental has been at this location since
1986; the area is highly commercialized to the North; and the single family residence
in the area has not objection to this zoning. He indicated the total cost of the
project would be $20,000. t-�uncil Member Zakrzewski made a motion to recommend this
bill to the Council favorable, seconded by Council Member Kelly. Council Member
Luecke indicated he supported this zoning with a buffer at the rear of the property.
The motion carried.
BILL NO. 19 -95 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,
AMENDING VARIOUS SECTIONS OF CHAPTER 21 "ZONING" OF THE MUNICIPAL CODE
OF THE CITY OF SOUTH BEND PROHIBITING THE SALE OF FIREARMS AND
AMMUNITION UNDER THE CITY'S PLANNING AND ZONING POWERS
This being the time heretofore set for public hearing on the above bill, proponents
and opponents were given an opportunity to be heard. Council Member Coleman reported
that the Zoning and Annexation Committee had met on this bill and recommended it to
the Council favorable, as amended. Council Member Zakrzewski made a motion to accept
the substitute bill on file with the City Clerk, seconded by Council Member Coleman.
The motion carried. John Byorni, Area Plan, said this was a Common Council initiated
petition. He indicated this bill proposes that any gunsmith shop that did not exist
before April 1, 1994, cannot be located within 200 feet of a school, child care
center or child care ministry. He said the Area Plan Commission sends this to the
Council with a favorable recommendation. Council Member Kelly made the presentation
for the bill. He indicated that a gun shop was going to open across from Lincoln
School, and there was no stipulation in the Code against this establishment. He
indicated this bill would establish a distance of 200 feet of a school or day care
facility. He indicated he wished it had to be further than 200 feet, however, we
cannot exceed State law. He thanked the Lincoln School parents for their efforts and

all who supported this bill. Pastor Larry Gooden, Inner raith Church of God and
Christ, spoke in favor of * ',e bill.
He presented a petition from seven pastors in favor of this bill. Scott Steiner,
2101 Leer, spoke in favor. Pastor Preston, from Church of God and Christ, spoke in
favor and presented a petition from several pastors in the area. Allen Bell, 1016
Longhorn Dr., a teacher at Lincoln School, thanked everyone involved in the project.
He read a letter from Representative Roemer. Gene Oaklv. ?614 York Road, indicated
200 feet is not enough it should be 1,000 feet from a child facility. John Broden,
assistant city attorney, expressed the Mayor's support of this bill. He indicated he
hoped the City never has to enforce this bill. Ernest Szarwark, 1140 E. Woodside,
spoke in favor. Council Member Zakrzewski indicated it was unfortunate that the 200
foot limit was all that could be enforced. Council Member Puzzello indicated that in
the schools they try to teach peaceful ways to handle arguments. Council President
Ladewski presented a petition with 156 signatures in favor of this bill. Council
Member Zakrzewski made a motion to recommend this bill to the Council favorable, as
amended, seconded by Council Member Coleman. The motion carried.
BILL NO. 20 -95 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH -
SOUTH ALLEY WEST OF SOUTH FRANKLIN STREET ON WEST INDIANA, AND A
PORTION OF THE EAST -WEST ALLEY PARALLEL TO WEST INDIANA AVENUE
CONTINUING WEST THEREFROM
Council Member Luecke made a motion to continue this bill until May 22, at the
request of the petitioner, seconded by Council Member Zakrzewski. The motion
carried.
BILL NO. 17 -95 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA,
SETTING THE ANNUAL SALARIES FOR THE COUNCIL MEMBERS FOR CALENDAR YEARS
1997, 1998 AND 1999
This being the time heretofore set for public hearing on the above bill, proponents
and opponents were given an opporLU..ity to be heard. Council Member Luecke reported
that the Personnel & Finance Committee had met on this bill and recommended it to the
Council favorable. Council Member Coleman made the presentation for the bill. He
indicated this bill freezes the Council salary at the 1996 level through 1999, thus
removes the difficulty of the next Council setting their own salary; the Council's
salary will remain below the wages of full time City employees; and sends a massage
to the citizens that revenues will not go toward Council Members' salaries. Council
Member Luecke made a motion to recommend this bill to the Council favorable, seconded
by Council Member Duda. The motion carried.

RESOLUTIONS
RESOLUTION NO. 2232 -95 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
APPROVING THE ISSUANuE OF SCRAP METAL /JUNK DEALERc /TRANgvER
STATION LICENSE FOR THE CALENDAR YEAR 1995
WHEREAS, the Common Council of the City of South Bend recognizes the contributions
that operations such as junk /scrap and recycling dealers make to the community, and
the Council further realizes that such operations must be reasonably regulated in
order to minimize any environmental or aesthetic nuisances which may be created by
the operations of scrap /junk /and recycling dealers within the City; and
WHEREAS, the Common Council of the City of South Bend has enacted reasonable rules
and regulations with regard to the issuance of licenses and the operations of the
scrap /junk /and recycling dealers;
WHEREAS, in accordance with these rules and regulations, inspections of the below
listed scrap /junk/ and recycling operations have been completed by the Department of
Code Enforcement and the Fire Department Prevention Bureau, and it has been found
that such premises is fit and proper for the maintena..ce and operation of such
businesses; and
WHEREAS, the Board or Public Works, at its meeting held on April 10, 1995,
recommended the issuance of a license for the below listed applicants in the City of
South Bend by appropriate action of the Common Council.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. That the license applications for the following be approved based upon
the satisfactory review of the properties by the Department of Code Enforcement and
the Fire Department Prevention Bureau, inspections having been made in March, 1995,
and subsequent favorable recommendation by the Board of Public Works:

A public hearing was held on the resolution at this time. Kathy Dempsey, Director of
Code Enforcement, made the presentation for the resolution. She indicated South Bend
Scrap had met all the requirements for a license, however, they were left off the
previous resolution. Council Member Kelly a,,ade a motion to adopt this resolution,
seconded by Council Member Zakrzewski. The resolution was adopted by a roll call
vote of eight ayes.
RESOLUTION NO. 2233 -95 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY
RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF
SOUTH BEND, INDIANA, COMMONLY KNOWN AS 2740 VIRIDIAN DRIVE,
SOUTH BEND, INDIANA TO BE AN ECONOMIC REVITALIZATION AREA
FOR PURPOSES OF A SIX (6) YEAR REAL PROPERTY TAX ABATEMENT
FOR COMMUNICATIONS TEST DESIGN, INC.'S EXPANSION
WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a
Declaratory Resolution designating �_,rtain areas within the City as Economic
Revitalization Areas for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area commonly known as 2740 Viridian
Dr., South Bend IN, and which is particularly described as follows:
A part of the Southeast Quarter (1/4) of Section Twenty -eight (28),
Township Thirty -eight (38) North, Range Two (2) East, of the Second
Principal Meridian, City of South Bend, St. Joseph County, Indiana and
described as follows:
Commencing at the Northeast corner of the Southeast Quarter (1/4) of said
Section 28, said point being at the intersection of Bendix and Boland Drives;

WHEREAS, notice of the adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and
WHEREAS, the Council held a public hearing for the purposes of hearing all
remonstrances and objections from interested persons; and
WHEREAS, the Council has determined that the qualifications for an economic
revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. The Common Council hereby confirms its Declaratory Resolution designating
the area described herein as an Economic Revitalization Area for the purposes of tax
abatement. Such designation is for Real property tax abatement only and is limited
to two (2) calendar years from the date of adoption of the Declaratory Resolution by
the Common Council.
SECTION II. The Common Council hereby determines that the property owner is
qualified for and is granted Real property tax deduction for a period of six (6)
years, and further determines that the petition complies with Chapter 2, Article 6,
of the Municipal Code of the City of South Bend and Indiana Code 6 -1.1 -12.1 et seq.
SECTION III. This Resolution shall be in full force and effect from and after its
adoption by the Common Council and approval by the Mayor.

A public hearing was held on the resolution at this time. Steve Thompson, a
representative of Test Designs, made the presentation for the resolution. He
indicated they were constructing an addition to their existing facility. Council
Member Luecke made a motion to adopt this resolution, seconded by Council Member
Coleman. The resolution was adopted by a roll call vote of eight ayes.
RESOLUTION NO. 2234 -95 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND
COMMONLY KNOWN AS 2820 VIRIDIAN DRIVE, SOUTH BEND, INDIANA
46628 AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF
PERSONAL PROPERTY TAX ABATEMENT FOR MACK TOOL & ENGINEERING,
INC.
WHEREAS, a petition for personal property tax abatement consideration has been
filed with the Common Council of the City of South Bend, requesting that the area
commonly known as 2820 Viridian Dr., South Bend, Indiana, and which is more
particularly described as follows:
A part of the Southeast quarter of Section 28, Township 38 North, Range 2 East,
of the Second Principal Meridian,, City of South Bend, St. Joseph County,
Indiana and described as follows:

and prepared a report with information sufficient for the Common Council to determine
that the area qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1-
12.1 -1, et seg., and South Bend Municipal Code Sections 2 -76 et seg. and has further
prepared maps and plats showing the boundaries and such other information regarding
the area in question as required by law; and
WHEREAS, the Human Resources and Economic Development Committee of the Common
Council has reviewed said report and recommended to the Common Council that the area
qualifies as an Economic Revitalization Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend,
Indiana, as follows:
SECTION I. The Common Council hereby determines and finds pursuant to Indiana
Code 6 -1.1- 12.1 -4.5, that:

(a) the estimate of the cost of the new manufacturing equipment is reasonable
for equipment of that type;
(b) the estimate of the number of individuals that will be employed or whose
employment will be retained by the Petitioner can be reasonably expected to
result from the proposed installation of new manufacturing equipment;
(c) the estimate of the annual salaries of those individuals who will be
employed or whose employment will be retained can be reasonably expected to
result from the proposed installation of new equipment;
(d) any other benefits about which information was requested are benefits that
can be reasonably expected to result from the proposed installation of new
manufacturing equipment; and
(e) the totality of benefits is sufficient to justify the deduction requested.
SECTION II. The Common Council hereby determines and finds that the proposed
new manufacturing equipment can be reasonably expected to yield the benefits
identified in the State of Benefits as set forth in Section 1 through 3 of the
Petition for Personal Property Tax Abatement Consideration and that the Statement of
Benefits form completed by the Petitioner, said form being prescribed by the State
Board of Accounts, are sufficient to justify the deduction granted under Indiana Code
6 -1.1- 12.1 -4.5.
SECTION III. The Common Council hereby accepts the report and recommendation of
the Department of Economic Development, and the Human Resources and Economic
Development Committee's favorable recommendation, that the area herein described be
designated as Economic Revitalization Area for purposes of personal property tax
deduction for a period of five (5) years.
SECTION IV. The Common Council determines that such designation is for personal
property tax abatement only and shall be limited to two (2) calendar years from the
date of the adoption of this Resolution by the Common Council.
SECTION V. The Common Council hereby determines that the property owner is
qualified for and is granted property tax deduction for a period of five (5) years.
SECTION VI. The Common Council directs the City Clerk to cause notice of the
adoption of this Declaratory Resolution to be published pursuant to Indiana Code 5 -3-
1, said publication providing notice of the public hearing before the Common Council
on said declaration.
SECTION VII. This resolution shall be in full force and effect from and after
its adoption by the Common Council and approval by the Mayor.

A public hearing was held on the resolution. Council Member Kelly reported that the
Community and Economic Development Committee had met on this bill and recommended it
to the Council favorable. Melvin Hartz, owner of Mack Tool, made the presentation.
He indicated this was a family owned business that was started in 1988 with three
employees and it has grown to 32 employees. He indicated they were purchasing
additional equipment in order to stay competitive in the market. Council Member
Washington made a motion to adopt this resolution, seconded by Council Member Duda.
The resolution was adopted by a roll call vote of eight ayes.
RESOLUTION NO. 2235 -95 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND,
INDIANA, COMMONLY KNOWN AS 5681 W. CLEVELAND RD. AN ECONOMIC
REVITALIZATION AREA FOR PURPOSES OF A SIX YEAR REAL PROPERTY
TAX ABATEMENT FOR M/W L.L.C.
WHEREAS, a petition for personal property tax abatement consideration has been
filed with the Common Council of the City of South Bend, requesting that the area
commonly known as 5681 W. Cleveland, South Bend, Indiana, and which is more
particularly described as follows:
Lot Numbered Four (4) as shown on the recorded Plat of Crossroads Industrial
complex Phase II, Section One recorded in the Office of the Recorder of St.
Joseph County, Indiana, as Instrument No. 9201847
and this property has Key Numbers 25 1018 061610, be designated as an Economic
Revitalization Area under the provisions of Indiana Code 6 -1,1- 12.1 -1 et seq., and
South Bend Municipal Code Section 2 -76 et seq.; and
WHEREAS, the Department of Economic Development has concluded an investigation
and prepared a report with information sufficient for the Common Council to determine
that the area qualifies as an Economic Revitalization Area under Indiana Code 6 -1.1-
12.1-1, et seq., and South Bend Municipal Code Sections 2 -76 et seq. and has further
prepared maps and plats showing the boundaries and such other information regarding

deduction for a period of five (5) years.

property tax abatement only and shall be limited to two (2) calendar years from the
date of the adoption of this Resolution by the Common Council.
SECTION V. The Common Council hereby determines that the property owner is
qualified for and is granted property tax deduction for a period of five (5) years.
SECTION VI. The Common Council directs the City Clerk to cause notice of the

Member Luecke made a motion to adjourn, seconded by Council Member Duda. The motion
carried and the meeting was adjourned at 8:30 p.m.
