SHORT FORM LEASE
THIS SHORT FORM LEASE is entered into this 26th day of December ,
1990 , by and between Liberty National Leasing Company, a national
banking association, ("Lessor"), and the the City of South Bend,
} Indiana, acting by and through its Board of Public Works ("Lessee").
WHEREAS, the Lessor and Lessee on the 26th day of December, 1990,
l i entered into an agreement for lease with purchase option ("Lease")
for certain real property described in Exhibit "A" attached hereto,
and for the improvements and appurtenance constructed on said real
property, which real property, improvements and appurtenances are
collectively referred to in the lease and herein as the "Lease
Facility;" and
WHEREAS, the lease provides that the parties shall execute a
Short Form Lease describing the property demised, giving the term of
the lease, and the name and address of the parties, and referring to
the lease.
Now, therefore, in consideration of the mutual covenants
contained in the lease, the Lessor and Lessee hereby state that:
1. The term of the lease extends for a period of ten (10) years
from the commencement date, which is thrity (30) days after the date
of the deposit of funds in escrow by the Lessor as provided in the
lease.
2. Upon completion of the term of the lease, Lessee has the
option to purchase all of the Lessor's right, title and interest in
the Lease Facility for the sum of One Dollars ($1.00).

Lease to be executed as of the date and year first written above.

LEGAL DESCRIPTION
A part of Parcel 2 in the "Inner Belt
Industrial Park", a Subdivision in the
Southeast and Southwest Quarters of
Section 11, and the Northeast Quarter of
Section 14, all in Township 37 North,
Range 2 East, the Plat of which is
recorded in Plat Book 21, page 1, in the
office of the Recorder of said County
and State, which is more particularly
described as follows:
Beginning at point 428.71 feet East of
the Southwest corner of said Parcel 2,
thence West 428.71 feet; thence North
743.76 feet; thence East 428.71 feet,
thence South 745.03 feet to the place of
beginning.

I am attaching the fully executed Short -Form Lease, along with a
copy of the Short -Form -Lease after its execution by the Board but
before its execution by Liberty National Leasing Company.
You will note that the City recorded, at the request of Liberty
National's assignee, Chicorp, the partially executed Short --Form
Lease. Now that the document has been fully executed, it is
necessary to re-record it.
Please have the lease re -recorded. You should let the recorder's
office know that this is a re-recording, and give them any
information about the previous recording that they may need.
