RELEASE OF EASEMENT
WHEREAS, the Civil City of South Bend, Indiana, by and through
its Board of Public Works (hereafter, the "City") has obtained a five
foot (5,) utility easement over the following described real property
situated in St. Joseph County, Indiana, said Easement recorded on
May 19, 1953, Plat Book 18, Page S:
Lot 1 of Swanson Park Fifth Addition to
the City of South Bend, Indiana;
and
WHEREAS, said easement is recorded in the office of the Recorder
of St. Joseph County on the plat of the subdivision; and
WHEREAS, the City no longer has any need for the following
described portion of said utility easement:
A part of Lot 1 of Swanson Park Fifth
Addition to the City of South Bend,
Indiana, said part being more
particularly described as follows:
The South 5 feet of the 5 foot easement
along the west line of said lot which
extends 80 feet from the Northwest
Corner of the Lot as shown on the
recorded Plat of said -subdivision.
Now, THEREFORE, BE IT RESOLVED that the Civil City of South Bend,
Indiana, by and through its Board of Public Works, hereby releases
and terminates all rights and interest in the following portion of
utility easement, all its utilities located therein to be abandoned
in place:
A part of Lot 1 of Swanson Park Fifth
Addition to the City of South Bend,
Indiana, said part being more
particularly described as follows:
The South 5 feet of the 5 foot easement
along the west line of said lot which
extends 80 feet from the Northwest
Corner of the Lot as shown on the

from our transferred employee, Kevin Downey, as part of our Employee Relocation
Assistance Program. It is our intent to put the home on the market for sale.
The enclosed survey indicates an encroachment of the garage in the easement
for public utilities as shown on the plat of said subdivision.
To clear title, we respectfully petition the City of South Bend to relinquish
their right to that portion of the easement in which the encroachment lies,
if there are no facilities in that portion of the easement.
