CORRECTIVE CLERK'S DEED
Marilyn Rzeszewski, Clerk of the Circuit Court, pursuant to the
proceedings had in the case of the Civil City of South Bend v.
Florence Kirchheimer, Cause No. K-5769 in said Court, effective as of
September 14, 1983 do hereby convey to the City of South Bend, the
fee simple title to the following described real estate located in
St. Joseph County, Indiana:
A permanent right -of --way Easement 34 feet wide East and West
described as being the East 34 feet of the West 54 feet off of
the entire West end of the following described tract of land.
Beginning at a point in the West line of Section 29,
Township 37 North, Range 3 East 217.14 feet North of the

Southwest corner of the N.W. 1/4 of the N.W. 1/4; thence due

East a distance of 990 feet; thence due North a distance of
1099.86 feet; thence due West 990 feet; thence due South
along the West line of said Section 29 a distance of 1099.86
feet to a place of beginning, containing 25 acres more or

less also a temporary easement for slopes and tree wells
located as follows: The east 12 feet of the West 66 feet
taken off of the west end of the above -described tract of
land.
Also a permanent right-of-way easement described as

beginning
g g at a point 54 feet due East of the Northwest
corner of Section 29, Township 37 North, Range 3 East;
thence due South along a line 54 feet East of and parallel
to the West line of said Section 29 a distance of 140 feet;
thence in a straight line in a Northeasterly direction to a
point 150 feet East of and 40 feet South of the Northwest
corner of said Section 29 a distance of 138.62 feet more or
less; thence due North 40 feet to a point in the North line
of said Section 29 and 150 feet East of the Northwest corner
of said Section 29; thence due West along the North line of
said Section 29 a distance of 96 feet to the place of
beginning, all off of the Northwest corner of the
above -described tract of land, all in the N.W. 1/4 of the
N.W. 1/4 of Section 29, Township 37 North, Range 3 East,
Penn Township, St. Joseph County, Indiana.
Subject to all non -delinquent taxes and assessment.
This deed is for the sole purpose of replacing the original Clerk's
Deed effective September 14, 1983 which has been lost.
Executed at South Bend, Indiana this 1A day of _MQJL ; 1989,
by the undersigned Clerk of the Circuit Court pursuant to the Order
of said Court entered on the 31st day of August, 1982, in the above
described proceedings.

Attached find the original of a Corrective Clerk's Deed which
needs to be recorded. Some time ago, Mel Humphrey had asked that I
obtain a fully executed Clerk's Deed for property owned by Florence
Kirchheimer. Apparently this had been an old annexation case and
Mel had a Clerk's Deed which was not fully completed. He was
concerned that prior to the City investing more funds and
improvement of the area that a fully executed Clerk's Deed be
obtained. Also, it appeared to be obvious (from tax records) that
the property had not previously been transferred to the City and
entered onto our records as owners.
Please record this Deed with both the County Record's Office
and City Auditor.
