WUJCIK AGREEMENT FOR EASEMENT This agreement has been made and entered into this IZI-(L day of j1.&�`�))Jy , 1988, by and between the City of South Bend, a municipal corporation of the State of Indiana, (hereinafter referred to as "Grantor") and Ronald R. and Judith K. Wujcik (hereinafter referred to as "Grantee"), W I T N E S S E T H• That in consideration of the sum of one dollar ($1.00) cash in hand paid and other valuable consideration, receipt of which is hereby acknowledged, Grantor hereby grants to Grantee a permanent easement for the purpose of allowing the existence, operation and maintenance of structural appurtenances in and under the following described real estate: The Northwestern most five (5) feet of the fifteen (15) foot utility easement lying adjacent to and parallel with the Southeast property line of Lot 180, Kensington Farms Subdivision, Section 4, Part 2-A, recorded in St. Joseph County, Indiana. The easement described herein is to encompass an encroachment as shown on Indiana Mortgage Report File #881592 prepared and certified by H. Doublas Peirce, L.S. # S 0318 on June 24, 1988 which is attached and made a part of this document. This easement shall be in effect so long as the existing structure remains on lot 180 as shown on the Peirce Survey drawing. It is my understanding that you will have this Agreement of Easement recorded with the St. Joseph County Recorder's Office. I would appreciate your providing this office with a "recorded" copy of the Agreement for Easement when it becomes available.
