(SEE EASEMENT) RELEASE OF EASEMENT WHEREAS, the Civil City of South Bend, by and through its >;y Board of Public Works, has obtained an easement for sewage and drainage for the vacated portion of Columbia Street within the parcel of land described as follows: c� Columbia Street running south from the \x. V t'' south right-of-way of Bronson Street for Q= - a distance of 371 feet more or less, all -.-"_ 00 _'�_� being in Sample's Sub of Lots 26, 27 and 28 - D & F Addition; and a^ ~~ -- �JHEREAS, a copy of said easement was recorded in the U- Office of the Recorder of St. Joseph County in Miscellaneous Record 84-17519; and WHEREAS, the City of South Bend, having completed the work, no longer has any need for the easement. NOW, THEREFORE, BE IT RESOLVED that the Civil City of South Bend, by and through its Board of Public Works, hereby releases and terminates all rights and interest in said easement. The following Ordinance vacates the above described public property. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: SECTION I. The Common Council of the City of South Bend having e a public hearing on the petition to vacate the following property: Columbia Street running south from the south right-of-way of Bronson Street for a distance of 371 feet more or less, all being in Sample's Sub of Lots 26, 27 and 28 - D&F Addition. (SEE EXHIBIT A) hereby determines that it is desirable to vacate said property. SECTION II. The City of South Bend hereby reserves the rig s an easements of all utilities and the Municipal City of South Bend, Indiana to construct and maintain any facilities, including, but not limited to, the following: electric, telephone, gas, water, sewer, surface water control structures and ditches, within the vacated right-of-way, unless such rights are released by the individual utilities. SECTION III. The following property may be injuriously or bene icia y affected by such vacating: NONE SECTION IV. The purpose of the vacation of the real property is o: Expand present manufacturing and parking facilities. SECTION V. This ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor.
