WHEREAS, a Charles J. Johnson was the apparent owner of record
on September 27, 1985 of the following described real property
locate,i in South Bend, Indiana:
The South Half of Lot Numbered Sixty-three
(63) as shown on the recorded Plat of Olive
Heights Addition to the City of South Bend; and
WHEREAS, on October 1, 1985, Charles J. Johnson, or someone
acting on his behalf recorded a Quit -Claim Deed to said property to
the City of South Send in the St. Joseph County Recorder's Office;
a nd
WHEREAS, said recording was done without the knowledge of any
officer, agent or employee of the City of South Bend, much less at
the request of any such officer, agent or employee; and
WHEREAS, the City of South Bend has no use for said property,
and it being the genera]. policy of the City of South Bend all
property which it does not use should remain on the Tax Rolls of the
City of South Bend , and
WHEREAS, the City of South Bend by and through its Board of
Public Works expressly and unequivocally renounces acceptance of this
Deed; and
NOW THEREFORE, BE IT RESOLVED by the Board of Public Works of
the City of South Bend, that the Deed recorded by Charles J. Johnson
on October 1, 1985, instrument no. 85212,E_5, is not accepted by the
City of South Bend and the City acknoviledges no ownership interest in
this property.
