EASEMENT
The City of South Bend, Indiana, hereinafter called "Grantor,"
In consideration for the sum of One Dollar ($1.00) and other valuab
consideration in hand paid to the Grantor, hereby grants to One
Michiana Square Associates hereinafter called the "Grantee," a
permanent Easement in the hereinafter described land for the purpose
of adding a parking ramp to a building on land which has already been
deeded by Grantor to Grantee adjacent to the real estate which is the
subject of this Easement. In consideration of the granting of this
Easement, Grantee agrees to maintain the area covered by this
Easement at its expense and perpetuity in a neat, tidy and
attractive condition, including but not limited to the removal of
trash and debris of every type or nature, and the repair and
replacement of any sidewalk or structures located on the Easement
when it becomes necessary, all at the expense of Grantee.
The real estate which is the subject of this Easement is a
portion of Michigan street (public way) that is adjacent to and
abutting Lot 7 of River Bend Addition to the City of South Bend,
Indiana, more particularly described as follows: -n -n

Said portion being 5 feet in width (east to trAz=ram,
west) and 98 feet long (north to south) and : '

This easement shall be subject to and shall not diminish in any
way any utility or other easement held by the Grantor on said Land.
The Grantee as part of the consideration of this Easement will
indemnify and save the Grantor harmless from and against any and all
damage, injuries, losses, claims or demands or costs proximately
caused by default, culpability or negligence of the Grantee in the
use of the property encompassed by this Easement.
