CIVIL CITY OF SOUTH BEND, INDIANA
Conveys and Warrants to
SOUTHOLD HERITAGE FOUNDATION, INC., the Grantee, for and in
consideration of Ten Dollars ($10.00) and other valuable
consideration, the receipt of which is hereby acknowledged, Real
Estate in St. Joseph County, in the State of Indiana, described as
follows:
A part of ';ank Out Lot Numbered One Hundred Thirty
(130) of the Third recorded Plat of Out Lots of
Town, now City of South Bend, platted by the State
Bank of Indiana, described as follows:
Beginning at the intersection of the East line of
Harrison Street and the Southerly line of Lincoln
Way West, formerly Michigan Avenue, in said City at
a stake set 203 feet Southeasterly from the
original Northwest corner of said Bank Out Lot No.
130; thence continuing Southeasterly along the
Southerly line of Lincoln Way West, 301 feet to a
stake set at the intersection of the last named
line with the Westerly line of Cottage Grove
Avenue, formerly Stover Street, as now established
thru said Out Lot; thence South along the West line
of Cottage Grove Avenue 72 feet and 2 inches to the
South line of Bank Out Lot No. 130; thence
Southwesterly along the Southerly line of said Out
Lot a distance of 286 feet and b inches to a stake
on the East line of Harrison Street; thence North
along the East line of Harrison Street 216 feet and
5 inches to the place of beginning.
ALSO, beginning at a stake set in the East corner
of the East end of said Out Lot No. 130; thence
Northwesterly along the Southerly line of Lincoln
Way West, 96.9 feet to the Easterly line of Cottage
Grove Avenue, as now established across said Out
Lot; thence South along the East line of Cottage
Grove Avenue 47 feet to the South line of said Bank
Out Lot No. 130; thence North 83 3/4 degrees East
along the Southerly line of said Out Lot, 85.2 feet
to the place of beginning;
(1) Easements necessary for the Seller to dedicate and
grant or to reseve unto itself for future easements
for any public or private utilities and facilities;
(2) Building codes and zoning ordinances of the City of
South Bend; and
(3) Any and all other covenants, restrictions, easements
and reservations of record.
(4) Any and all property taxes outstanding.
(5) The structure will be preserved and maintained in
accordance with plans approved in writing by the
Department of Natural Resources.
