AN ORDINANCE AMENDING CHAPTER 21 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, REGULATING THE SUBDIVISION OF
LAND IN ZONING DISTRICTS
STATEMENT OF PURPOSE AND INTENT
It is the intent of this Ordinance to amend Article I of Chapter 21
of the South Bend Municipal Code to specify the zoning districts in which
subdivision of land may occur.
WHEREAS, Public Law 211, 1982 requires that the zoning ordinance
specify in which zoning districts the subdivision of land may occur;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana, that the Zoning Ordinance be amended as follows:
SECTION 1 That Chapter 21 of the South Bend Municipal Code be
amended to include within Article 1, a new section 21-5.5, as follows:
Sec. 21.5.5 Subdivision of land
Subdivision of land per the City Subdivision Ordinance may occur in
all zoning districts.
SECTION 2 This Ordinance shall be in full force and effect from and
after its passage by the Common Council and approval by the Mayor.

RE: A proposed ordinance iniltiated by the Area Plan Commission amending
Article 1 of Chapter 21 of the South Bend Municipal Code to specify
the zoning districts in which subdivision of land may occur.
Gentlemen:
The attached proposed ordinance was initiated by the Area Plan Commission
and was legally advertised on November 6, 1982. The Area Plan Commission
gave it a public hearing on November 16, 1982, at which time the following
action was taken:
Upon a motion by John Leszczynski, being seconded by Joseph
Serge and unanimously carried, the proposed ordinance initiated
by the Area Plan Commission amending Article 1 of Chapter 21 of
the South Bend Municipal Code to specifv the zoning districts
in which subdivision of land may occur is sent to the Common
Council with a favorable recommendation.
The deliberations of the Area Plan Commission and matters considered in
arriving at the above decision are shown in excerpts of the minutes and
will be forwarded to you at a later date to be made a part of this report.
Attached for your consideration in the review of this matter is a copy of
the Area Plan Commission's Staff Report.

The intent of these Ordinances is to amend the City and County
Zoning Ordinances to specify that the subdivision of land may occur in
all zoning districts. This is to satisfy a requirement of Public Law 211,
1982 regulating the subdivision approval process within the State.
