Release of Easement for water, sewer and drainage in the
real estate known as the north/south alley east of Michigan
Street, west of St. Joseph Street and running between Wayne
Street on the North and Western Avenue on the South.

Dear Mr. Leszczynski:
Please find enclosed a Release of Easement required for the
North -South alleys in the One Michiana Square project. We
are requesting that you waive your rights to this easement.
This would have been sent to you with the previous request
for waiver of similar rights for East-West alleys. I believe
all utilities in this area have already been abandoned. If
you have any questions in regard to the attached, please don't
hesitate to contact me.
Kindly execute the attached, and return it to my attention
as quickly as possible. If you have any other questions in
this regard, please contact the undersigned or Mr. Mark Myers
of the Abstract & Title Corporation of St. Joseph County at
232-5845. Thank you for your cooperation.

PARTIAL RELEASE OF EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that for value received, receipt
of which is hereby acknowledged, CftV of South Send
Grantee of certain easement in the real estate located in Section 12,
Township 37N, Range 2E, Township of Portage, County of St. Joseph,
State of Indiana, under the terms of a written grant executed by
a Recorded Plat, at South Bend, Indiana and recorded in the office
of the County Recorder of St. Joseph County, Indiana on May 2, 1977,
in Miscellaneous Record Book 306, P. 129, hereby agrees to and hereby
does release its rights in said easement in and to that part of the
real estate as herein described to wit:
The North -South alley East of Michigan Street, West of St. Joseph
Street, and running between Wayne Street on the North and Western
Avenue on the South, as shown on the Original Plat of the City of
South Bend.
The alley described would run between Lots 307 to 318 inclusive as
shown on the original plat. Said lots are now vacated and would now
constitute Lot Numbered Seven (7) as shown on the recorded plat of
River Bend Addition recorded May 4, 1977 in the Office of the Recorder
of St. Joseph County, Indiana, in Plat Book "R", page 31.
