HILL CITY ATTORNEY FROM: SANDRA M. PARMERLEE, CLERK BOARD OF PUBLIC WORKS RE: WARRANTY DEED - MARTIN BLAD FARMS, INC. At the Board of Public Works meeting on Monday, February 21, 1983, the Board approved the Warranty Deed of Martin Blad Farms, Inc. to the Civil City of South Bend. A copy is attached for your information. On Thursday, February 23, 1983, the Recorder's office informed us that they would not accept this Deed for recording until we get verification from Martin Blad Farms, Inc. that they do not owe any state taxes. If they do not, the following language needs to be typed on the Deed: Grantor certifies that there is no Indiana Gross Income Tax due or payable at this time. They did not tell us what needs to be typed in if there are taxes due. I imagine they would not accept the Deed if there are taxes due. I would appreciate your advise on this matter. Additionally, I received two (2) more Martin Blad Farms, Inc. Warranty Deeds from Dave Wells. Dave did not believe these Deeds need to be placed on the Board agenda. John was not certain if they did or not. Since we put the one (1) mentioned above on the agenda on the 21st, I would appreciate a legal opinion as to whether or not these additional Deeds need to be placed on the Board agenda and approved by the Board. Dave has informed me that we can expect approximately six (6) more Deeds in the future. For your information, I am enclosing copies of the two (2) Deeds which I most recently received from Dave Wells. Thank you for your assistance in this matter. smp Enc.
