In ccnsideration of the sum of One Dollar ($).00) cash in hand paid,
receipt whereof is hereby acknowledged, the undersigned hereby grant, convey,
transfer and deliver unto the Civil Cite Of South Bend, a temporary easement
and right-of-way, for -the following purposes namely: The eight to enter
upon the hereinafter described land and grade, level , fi it , drain, have,
build, maintain, repair, and rebuild roads, streets, highways, together with
such bridges, culverts, ramps, and cuts as may be necessary, on, over, and
across the around embraced within the right -of --way hercinafter described,
which is located within the boundaries of a tract or parcel of lard situated
in the County of St. Joseph, State of Indiana, brief 1 v described as follows:
A temporary right-of-way for construction access to i;: St. Joseph
River during the reconstruction of the Colfax Bridge, described as the south
tw elsve (12) feet of Lot 9 of the Original Plat of Lo.;e1l, in the northwest
quarter of Section 12, Township 37 North, Range 2 East, Portage Township,
City of South Bend, St. Joseph County, Indiana.
To have and to hold the said temporary easement and right-of-way unto
the Civil City of South Bend, Indiana,and unto its successors and assigns
until the reconstruction of the Colfax Bridge is completed_
And said Grantors hereby covenant with the Civil City of South Bend,
Indiana, that- they are law'l-ully seized and possessed of the aforedescribed
tract or parcel of land; that they have a good and lay,;ful right to sell and
convey; that it is free from all encumbrances; and that they will 5-Iarrant
and forever defend the title in quiet possession thereto against the laWful
claims of all persons wvhomsoever.
It is understood and agreed by the parties hereto, that wherever in
the foregoing instrument the singular number is used, it will read as
,plural, if and when necessary, and that wherever words of neuter gender are
employed, they ,..i 11 likewise apply to the masculine gender, whenever the
contract requires.
