WITNESSETH: WHEREAS, I.C. 36--1-11 establishes procedures for the sale and rental of real property owned by the City of South Bend; and WHEREAS, the Board of Public Works is empowered to carry out the provisions of said statute; and WHEREAS, the Board has determined that: 1. The highest and best use of certain real property owned by the City is by sale to an abutting landowner; 2. Burns. My original bid of $50.00 is still good. I feel this is a fair offer for several reasons. The sidewalk on this property is severely deteriorated and will have to be replaced. A large dead tree and a large dead stump will have to be removed. If I purchase 1118 N. Burns the necessary improvements WILL be made. The cost of these improvements could be several thousand dollars. I own the house to the south of 1118 N. Burns. Over the past seven months I have made 10,000.00 of necessary improvements to that property. It is my sincere intention to improve this distressed area of South Bend. PETER HAUSER 18397 Crownhill Drive South Bend, Indiana 46637 Dear Mr. Hauser: The South Bend Board of Public Works has determined that the vacant lot at 1118 North Burns Street is not needed for any public purpose and that the cost to the public of maintaining the lot equals or exceeds the estimated fair market value of the property. The Board has also determined that the highest and best use of the lot is sale to an abutting landowner. On September 7, 1993, the Board opened sealed bids for the sale of 1118 North Burns Street. No bids were received which equalled or exceeded the appraised value of the property, which has been determined to be $75,0.00. The Board is now obligated by statute to contact all landowners that abut the lot to see if any are interested in negotiating for the purchase of this property. Our records show that you own property that abuts the lot in question. If you have any interest in purchasing the lot described above, please contact me by letter or telephone on or before October 22, 1993. BURNS, TAX KEY # 18-5100-3535 APRIL 29, 1993 I have reviewed the request received by the Board of .Public Works for the purchase of the above referenced property. Subject Property: The lot in question is the vacant parcel north of 1116 N. Burns. The surrounding area is mainly single family and multi -family residential.. There are also a number of vacant lots throughout the block and adjacent blocks. The building on this property (1116) has been recently purchased by the petitioner and is in deteriorated condition. Also, numerous code violations exist because of accumulated garbage. I discussed this request with Dave Norris, planner for the Northeast Neighborhood, and Margie Herman of the Bureau of Housing. The parcel is not involved in any redevelopment plans and the Bureau of Housing did not express interest in any parcels in the Northeast. Both Dave and Margie commented favorably on the possibility of a private citizen purchasing and maintaining the lot in question. Recommendation: I see no reason or plans for the City in retaining this lot. If the petitioner is requesting this lot for the creation of a side yard, or expansion of the existing building he owns, I see no reason to deny the request. Also, I would encourage the combination of the two lots into one parcel and issuing one tax key number. This consolidation would eliminate the possibility of speculation on the lot in question, and would also encourage maintenance of the entire parcel. Therefore, I recommend that the parcel be sold to the petitioner. CC.
