Dear Mr. Hauser:
This is to advise you that the Board of Public Works, at its
meeting held today, accepted your bid of $50.00 for the purchase of
the above referred to City -owned property with the condition that
you replace the sidewalk in front of this property by May 1, 1994.
The City Attorney's office will prepare the appropriate Purchase
Agreement for this property and I will forward the Agreement to you
for signature as soon as I receive it. After the Board approves
and signs the Purchase Agreement I will send you a completely
executed copy for your files.
You may then submit a check to the Board, made payable to the City
of South Bend, in the amount of $64.00 which is $50.00 for the
property plus $14.00 to cover the fees required of the Auditor's
office and the Recorders's office for the recording of the Quit
Claim Deed for this property.

PURCHASE AGREEMENT
THIS AGREEMENT, entered into this VC,' day of
1994, by and between Peter Hauser, hereinafter
referred to as the "Buyer," and the Civil City of South Bend, a
municipal corporation of the State of Indiana, hereinafter
referred to as the "City."
WITNESSETH:
WHEREAS, I.C. 36--1-11 establishes procedures for the sale
and rental of real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works is empowered to carry out
the provisions of said statute; and
WHEREAS, the Board has determined that:
1. The highest and best use of certain real property owned
by the City is by sale to an abutting landowner;
2. The cost to the public of maintaining said real property
owned by the City equals or exceeds the established fair market
value of said real property;
3. It is economically unjustifiable to sell said real
property owned by the City in accordance with the procedures set
forth in I.C. 36-1-11-4.
WHEREAS, the Board has determined that the assessed value of
said real property is less than TWO THOUSAND DOLLARS ($2,000.00);
and
WHEREAS, the Board appointed a licensed independent
appraiser who appraised the particular real property; and
WHEREAS, based upon the appraisal submitted, the Board has
established an offering price for the property, and published
notice of its intention to sell said property at said price; and
WHEREAS, pursuant to I.C. 36-1-11-5, the Board is empowered
to negotiate and sell said real property to the abutting
landowner who submits the highest offer for said real property;
and
WHEREAS, the offer of the Buyer in the amount of Fifty
Dollars ($50.00), was offered and accepted as the best offer for
said property.
NOW, THEREFORE, it is agreed by and between the parties
hereto, and for and in consideration of the promises and the
mutual covenants herein contained, as follows:
1. The City agrees to sell and Buyer agrees to buy the
following property located in St. Joseph County, Indiana:
Lot Numbered One Hundred Five (105) as shown
on Hartman and Miller's Plat, an Addition to
the City of South Bend, and more commonly
known as 1118 Burns Street,
for the sum of $50.00.
2. Buyer agrees to pay the purchase price and recording fee
in full at the time of closing.
3. Buyer agrees to pay all title and abstract costs
involved in said transaction which it shall desire or request.
4. Buyer further agrees to repair the sidewalk in front of '
the property by May 1, 1994.
5. At the time of closing and after a submission of a
receipt for the total purchase price has been submitted by the
Controller to the Board of Public Works, the Board shall cause a
Quit -Claim Deed to be prepared, which deed shall be signed by the
Mayor and attested to by the City Clerk with the Seal of the City
affixed, which shall then be recorded with the St. Joseph County
Recorder's Office,
6. That the City shall reserve a perpetual easement in,
upon, over and under said real property for the purpose of
installing, constructing, operating, patrolling, maintaining,
repairing, revising, renewing, removing and replacing a sewer
system, its pipes, lines and other facilities, together with the
right of ingress and egress over said real property adjoining
said easement when necessary to install, construct, operate,
patrol, malrnCa4Ln, repa:L .z, raNF!Se, ren-w, --move and Z'epa-nice said
sewer, pipes, lines and other facilities and equipment incident
thereto.
7. That said easement and associated benefits and
obligations shall constitute covenants running with said real
estate, and shall be binding upon the said Buyer and be an
obligation thereof of every person or entity now or hereafter
having any fee, lease -hold or other interest in all or any part
of said real estate.
8. That said easement shall bind and inure to the benefit
of the respective successors and assigns of the parties hereto.

Dear Boars] Members,
I am still interested in purchasing the vacant lot at 1118 N. Burns.
My original bid of $50.00 is still good.
I feel this is a fair offer for several reasons. The sidewalk on this
property is severely deteriorated and will have to be replaced.
A large dead tree and a large dead stump will have to be removed.
If I purchase 1118 N. Burns the necessary improvements WILL be made.
The cost of these improvements could be several thousand dollars.
I own the house to the south of 1118 N. Burns. Over the past seven
months I have made 10,000.00 of necessary improvements to that property.
It is my sincere intention to improve this distressed area of South
Bend. I am a active member of the Northeast Side Neighborhood Asso.
Housing Committee.
Any improvements made to 1118 N. Burns would help accomplish the City
of South Bend goal of revitalization of this distressed neighborhood.
It is in the best interest of ALL to put this lot into the hands of
someone willing to make the necessary improvements and maintain this
property.

Dear Mr. Hauser:
The South Bend Board of Public Works has determined that the vacant
lot at 1118 North Burns Street is not needed for any public purpose
and that the cost to the public of maintaining the lot equals or

As per your request on June 15, 1993 I have made a special on -site inspection of
the above addressed property. The legal description of this property is:
Lot Numbered One Hundred Five (105) as shown
on Hartman and Miller's Plat, an Addition to the City
of South Bend, and more commonly known as 118
Burns St.
This property is assessed at $5,070 tax year 1994 payable 1994: previous
assessment was $400. (Note: In this appraiser's opinion, this new assessment
appears to be erroneous.) The property is zoned A - Residential.
Subject property has some value in that it is located near Notre Dame and the
North East Neighborhood. A parcel in the North East section of South Bend,
corner Northwood and Coquillard sold in 1992 for $2,500 or 270/sq. ft. Other
properties as far back as 1989 - corner Napoleon and Hill - sold in the 250 per
square foot range. Subject area is inferior to the other lots, surrounding building
values, etc. Thus the value estimate for subject arceI is:

I have reviewed the request received by the Board of .Public Works for the
purchase of the above referenced property.
Subject Property:
The lot in question is the vacant parcel north of 1116 N. Burns. The
surrounding area is mainly single family and multi -family residential.. There
are also a number of vacant lots throughout the block and adjacent blocks. The
building on this property (1116) has been recently purchased by the petitioner
and is in deteriorated condition. Also, numerous code violations exist because
of accumulated garbage.
I discussed this request with Dave Norris, planner for the Northeast
Neighborhood, and Margie Herman of the Bureau of Housing. The parcel is not
involved in any redevelopment plans and the Bureau of Housing did not express
interest in any parcels in the Northeast. Both Dave and Margie commented
favorably on the possibility of a private citizen purchasing and maintaining
the lot in question.
Recommendation:
I see no reason or plans for the City in retaining this lot. If the petitioner
is requesting this lot for the creation of a side yard, or expansion of the
existing building he owns, I see no reason to deny the request. Also, I would
encourage the combination of the two lots into one parcel and issuing one tax
key number. This consolidation would eliminate the possibility of speculation
on the lot in question, and would also encourage maintenance of the entire
parcel. Therefore, I recommend that the parcel be sold to the petitioner.
