AN ORDINANCE CONSENTING TO THE ANNEXATION
BY THE INCORPORATED TOWN OF ROSELAND, INDIANA,
OF CERTAIN TERRITORY
STATEMENT OF PURPOSE AND INTENT:

NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, as follows:
SECTION I. The Common Council of the City of South Bend
gives its consent to the annexation by the incorporated Town of
Roseland, Indiana, of the following territory which is located within
three miles of the corporate boundaries of the City of South Bend:
A parcel of land located in the West 1/2
of the Southwest Quarter of Section 25,
Township 38 North, Range 2 East being more
particularly described as: Beginning at the
Northwest corner of W. D. Guy's First Addition
to the Town of Roseland as shown in the St.
Joseph County Recorder's Office Book 11,
page 151; thence West 50' more or less to the
East right -of -way line of the Conrail Railroad;
thence South along said right -of -way line to
the South right -of -way line of Cripe Street;
thence West along said right -of -way line 62'
more or less to the West right -of -way line of
the Conrail Railroad; thence South along said
West right -of -way line to a point of inter-
section with the South right -of -way line of
Warren Street extended West; thence East along
said extended line 112' more or less to the
Southwest corner of Johnson's Addition to the
Town of Roseland as shown in the St. Joseph
County Recorder's Office Book 10, pages 158
and 159; thence North to the point of beginning
containing approximately 3.99 acres.
SECTION II. This Ordinance shall be in full force and effect
from and a ter its passage by the Common Council, approval by the
Mayor, and legal publication.

The attached proposed ordinance would give the Common Council's consent
to the Town of Roseland for annexation of certain property which has
long been considered to be within the town limits of Roseland. In
surveying various matters for the Town of Roseland, the Area Plan
Commission pointed out that the property had never been legally
annexed.
The property actually lies within the town limits or, according to its
counsel, adjacent thereto. It is merely an easement for I & M and
Conrail, according to Roseland's counsel.
In order to resolve the matter, Roseland wishes to follow formal
annexation procedures to clarify the town boundaries.
Pursuant to I.C. 36- 4 -3 -9, Roseland must have the consent of the City
of South Bend before annexing territory within three miles of South
Bend's city limits.
