Regulations pertaining to the Historic Preservation Commission are
found in Chapter 21 (Zoning), South Bend Municipal Code and Chapter
26 of the St. Joseph County Code.
The issuance of this certificate does NOT in any manner, release
the recipient from the responsibility of complying with the requirements
of the zoning ordinances, building codes, safety codes, ADA or other
requirements of the City of South Bend, the County of St. Joseph, the
State of Indiana, or the United States Federal Government.
This certificate is good for one year from the date of issuance and
is effective from the date entered herein. Plans are on file and open for
public inspection at the office of the Historic Preservation Commission of
South Bend and St. Joseph County, 227 West Jefferson Blvd., Suite 1400
S, South Bend, Indiana, during normal business hours.

Important Information Regarding this Request
REQUIRED DOCUMENTATION AND SITE PLANS
The Historic Preservation Commission of South Bend and St. Joseph County cannot process an Application
without required documentation. Comprehensive documentation provides a complete understanding of the
project. Problems often occur during a project review or during the execution of the project when the
property owner, staff or commissioners are unclear as to project specifics. Applications will NOT be
processed without required documentation.
Photographs may be submitted in digital format or in photographic print. When a project involves
blueprints and/or site plans, one (1) set shall be submitted with the Application. Any documentation
submitted to this office cannot be returned to the applicant.
APPLICATION FEE
The application processing fee for any Application for a Certificate Of Appropriateness is $20
Payment must accompany the application at the time of submission. For an electronically submitted
application, payment must reach the HPC office within 48 hours following transmission. Payment can be
made by credit card by contacting
Business License Administrator Michelle Adams at (574) 235-5912; by cash in person in the Department of
Community Investment on the 14th floor of the County City Building; or by check made out to City of
South Bend. Applications will NOT be processed without the required fee.
MEETING ATTENDANCE
When an Application has been scheduled for any meeting, the owner, architect or contractor(s) retained for
the project shall attend the meeting where their project will be reviewed and a decision rendered. Failure by
the owner, architect, or contractor to attend such meetings may result in denial of the Application due to
insufficient representation.
CERTIFICATE ISSUANCE
Certificates of Appropriateness will be filed with the Building Department of South Bend and St. Joseph
County. A copy of the Certificate will be emailed directly to the owner and/or contractor(s) listed on the
application.
INSPECTION AUTHORITY
All projects will be inspected during and following execution for compliance with the decision(s) rendered
by the Historic Preservation Commission of South Bend and St. Joseph County.
Owner acknowledges that while the Historic Preservation Commission only considers Certificates of
Appropriateness for exterior features, under certain circumstances it may be necessary for the Commission
Staff to have access to the interior of the building in order to accurately assess the condition of the exterior
feature and that the lack of access to the interior may prevent the Commission Staff from making a
favorable recommendation.
Any work performed on a historic landmark or in an historic district which does not conform to the
Certificate of Appropriateness certificate shall be immediately halted by the Historic Preservation

Commission and the Building Department of South Bend and St. Joseph County. Fines may be levied for
projects not in compliance.

TERMS & CONDITIONS
This proposal, when accepted by the Purchaser, becomes a contract, upon the terms and conditions especially set
forth herein. It may not be modified, changed or rescinded in any manner except by written agreement of Schuell
Fence and the Purchaser. It is contingent upon delays due to strikes, fire, accidents and/or other causes beyond the
control of the Seller.
Schuell Fence Company agrees to guarantee the above fence to be free from defects in materials and
workmanship for five(5) years. WOOD FENCE WARRANTY DOES NOT COVER WARPING, CHIPPING,
SHRINKAGE, OR CRACKING WHICH ARE NATURAL PROPERTIES OF WOOD. Additional product
manufacturer warranties may also apply.
The Purchaser is solely responsible for complying with any and all zoning regulations and obtaining any *permits
that may be required from the city, township, or county that they reside in. Schuell Fence Company will assist the
customer, upon request, in determining where the fence is to be erected, but under no circumstance does
Schuell Fence Company assume any responsibility concerning property lines or in any way guarantee their
accuracy. If property pins cannot be located it is recommended that the customer have the property surveyed by a
licensed surveyor.
Schuell Fence Company will assume the responsibility for having underground public utilities located and marked.
However, Schuell Fence Company assumes no responsibility for sprinkler lines, or any other private buried lines or
objects. The customer will assume all liability for any damage caused by directing Schuell Fence Company to dig
within 24" (2'ft) of known utilities.
The final billing will be based upon quoted job layout and description unless modifications to the job have been
made by the customer, or if actual work performed varies from quote. Partial billing for materials delivered to the job
site and work completed may be sent at weekly intervals. Adjustments for material used on this job and adjustments
for labor will be charged or credited at the currently established rates. Additional charges for any extra work not
covered in this contract that was requested by the customer will also be added. All proposals, including installation
by the Seller, are made on the condition that the entire work be completed without interruption by the Purchaser.
The full amount of this contract along with any additional charges will become payable upon completion of all work
whether or not it has been invoiced unless other terms are specified. A finance charge of 1 1/2% per month (or a
minimum of $1.00), which is an annual percentage rate of 18%, shall be applied to accounts that are not paid within
10 days after completion of any work invoiced except where other terms are specified. All materials will remain the
property of Schuell Fence Company until all invoices pertaining to this job are paid in full, and Schuell Fence
Company reserves the right to reposess materials from property for non-payment. The customer agrees to pay all
interest and any legal and/or collection costs incurred in the collection of this debt. Acceptance of this contract
grants Schuell Fence Company access to property for the purpose of reposession in the event of non-payment.
This Contract Proposal shall terminate 30 days from the date of submission by Schuell Fence when not executed
by the Purchaser.
*Schuell Fence Company can obtain a permit if required by city or township upon request for an additional charge
of $75.00 plus the cost of the permit. Initial here to request that permit will be obtained on your behalf by Schuell

**SCHUELL FENCE COMPANY IS NOT RESPONSIBLE FOR ANY DAMAGE TO EXISTING SPRINKLER LINES.
REPAIR COSTS FOR ANY DAMAGE TO BURIED SPRINKLER LINES WILL BE THE RESPONSIBILITY OF THE
CUSTOMER.
