ORDINANCE NO. 7167 -83
AN ORDINANCE OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, AMENDING
CHAPTER 2, ARTICLE 17, SECTION 2 -205 OF
THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, COMMONLY REFERRED TO AS FEES
CHARGED FOR LEGAL ADVERTISEMENTS.
STATEMENT OF PURPOSE AND INTENT
In 1980, the Common Council passed Ordinance No. 6836 -80
which authorized the City to collect fees from petitioners to
cover the costs of advertising tax abatements, voluntary annexations,
vacations of public ways, and rezonings.
The undue and excessive bookkeeping procedures resulting
from passage of that Ordinance has prompted the following amendments.
The Office of the City Clerk believes that the amendments would
streamline this procedure and would result in a more efficient
and workable operation.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. Chapter 2, Article 17, Section 2 -205 of the
Municipal Code of the City of South Bend, Indiana, is amended to
read as follows:
ARTICLE 17. CHARGES FOR DIRECT CITY EXPENDITURES
Sec. 2 -205. Fees Charged for Legal Advertisements.
All petitioners seeking tax abatements, voluntary annexa-
tions, vacation of public ways, or rezonings, except those
rezonings petitioned for by the Area Plan Commission or a
member of the Common Council, shall ire - charged -tire- exact -fee
aeeessari +y remit the sum of One Hundred Dollars ($100.00)
at the time of filing said Petition. Said sum is non - refundable
and shall be used to fulfill all legal advertisement requirements
of such proceedings incurred by the City.
SECTION II. This ordinance shall be in full force and
effect from and after its passage by the Common Council,
approval by the Mayor and publication as provided by law.

The attached Bill would amend Section 2 -205 of the
Municipal Code of the City of South Bend relating to
advertisement costs for tax abatements, voluntary annexations,
and re- zonings.
You will recall that in 1980 an ordinance was passed
authorizing the City to charge for such expenditures.
However, the procedure as it presently exists, results in an
undue amount of bookkeeping by the City Clerk's office.
Thus in the effort to streamline this procedure and
to make it more efficient, I am requesting that the
ordinance be amended to require such a petitioner to remit
$100.00 at the time of filing a petition to cover such
advertising costs. It is my understanding from the City
Clerk's office that the proposed sum is in direct and
reasonable relation to the average advertising cost
related to such procedures.
