ORDINANCE NO.
AN ORDINANCE APPROVING THE SALE OF A PORTION OF
VOORDE PARK DECLARED TO BE EXCESS PARK PROPERTY NOT
SET ASIDE BY STATE OR CITY LAW FOR PUBLIC PURPOSES
STATEMENT OF PURPOSE AND INTENT:
The Board of Park Commissioners, at its meeting conducted on
August 2, 1983, determined that the following parcel of park property
in Voorde Park was real estate no longer needed for park property and
was not set aside by State or City law for public purposes:
A parcel of land being a part of the Northwest
Quarter of the Southeast Quarter of Section 33,
Township 38 North, Range 2 East, and a part of the
City of South Bend, St. Joseph County, Indiana being
more particularly described as follows, viz:
Commencing at the Northwest corner of the Southeast
Quarter of said Section 33; thence South 0 °- 01' -14"
West along the west line of said Southeast Quarter of
Section 33, a distance of 889.84 feet; thence South
89 °- 40' -09" East, along the South Right -of -way line of
Voorde Drive and its projection, a distance of 254.00
feet to the place of beginning for this description;
thence continuing South 89 °- 40' -09" East, along said
South right -of -way, a distance of 213.47 feet; thence
South 0 °- 19' -51" West, a distance of 407.56 feet to
the North right -of -way line of Keller Street; thence
North 89 °- 58' -08" West, along said North right -of -way
line, a distance of 213.47 feet; thence North
0 °- 19' -51" East, along the East line of a parcel of
land conveyed to Gibbs Wire and Steel Company, Inc. by
warranty Deed recorded in Book 815, Page 594 in the
Office of the Recorder of St. Joseph County, Indiana,
a distance of 408.68 feet to the place of beginning
containing 2.000 Acres more or less less.
Subject to any easements, covenants or restrictions
of record.
The Board of Park Commissioners has resolved that said real
estate be sold and disposed of to the advantage and best interests of
the City of South Bend, Indiana, and the proceeds of such sale be
credited to the Department of Public Parks pursuant to State statute,
and has, therefore, given notice of and conducted a public hearing
upon the desirability of offering said real estate for sale; and
subsequent to the public hearing conducted on August 2, 1983,
arrangements were completed for a joint appraisal of said real estate
per I.C. 36- 1 -11 -4, which said appraisal has been completed.
The Mayor of the City of South Bend, pursuant to I.C.
36- 1 -11 -3, has given his approval of the sale of said real estate,
which approval is dated August 30, 1983. I.C. 36- 10 -4 -18 requires
that the Board of Park Commissioners obtain the approval of the city
legislative body prior to advertising the real estate for sale.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION 1. The sale of the parcel of real estate in Voorde
Park designated on August 2, 1983, by the Board of Park Commissioners
as excess park property, no longer needed for park purposes and not
set aside by State or City law for public purposes, is hereby
approved.
SECTION 2. This Ordinance shall be in full force and effect
from and after its passage by the Common Council and approval by the
Mayor.

Dear Mrs. Beck:
The Department of Public Parks is requesting the Common Council to
approve an ordinance selling two acres of land off the west end of
Voorde Park.
The Board of Park Commissioners, on June 20, 1983, adopted a res-
olution stating that a portion of Voorde Park is no longer needed
for public use or park purposes and set August 2, 1983 for a public
hearing on said resolution.
At the August 2, 1983 meeting, there were no written or oral remon-
strances against the selling of the Voorde Park property and the Park
Board adopted a resolution expressing determination for sale of
certain real estate owned by the City of South Bend for park purposes.
Although the Park Board is usually against the selling of any park owned
land, the Board felt that the selling of a small unused portion of
Voorde Park would be in the best interest of the City of South Bend.
Your approval of the enclosed ordinance will be appreciated.
