AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY
OF SOUTH BEND, INDIANA, AMENDING CHAPTER 21,
ARTICLE 10, SECTION 21 -170 ENTITLED PERMITTED
SIGNS BY DISTRICTS
STATEMENT OF PURPOSE AND INTENT
Recently there has been confusion over the terminology presently
existing in Article 10 "Sign Regulations" of the Zoning Chapter of the
Municipal Code of the City of South Bend.
The types of signs permitted in "B" Residence Districts has
specifically been subject to varying interpretations.
The following Bill would amend the sign regulations as they
pertain to "B" Residence Districts in the hope of eliminating any
confusion as to the types of signs which are permitted in this district.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of South Bend, Indiana, as follows;
SECTION I. Chapter 21, Article 10, Section 21 -170 shall be
amended in part to read as follows:
Sec. 21 -170 Permitted signs by District.
(3) "B" Residence district
(a) All signs permitted in the "A" Residence District.
(b) Institutional bulletins- e-- elesteaes -se�s-
of any governmental agency, religious group,
hospital or school, located on the premises and
bearing only the information related to the activities
conducted on the premises, persons involved or other
such information, not exceeding sixty -four (64)
square feet of copy area.
SECTION II. This Ordinance shall be in full force and effect
from and after its passage by the Common Council and approval by the
Mayor.

Dear Councilmen:
The attached Bill would clarify the types of signs
permitted in "B" Residence Districts of our zoning laws.
Due to the confusion of the present language, and
varying interpretations given to it, I requested Mr. Richard
Johnson, Director of the Area Plan Commission to propose
appropriate amendatory language.
The following Bill incorporates language from Section
21- 1(a)(48.1), the definition section of the Zoning Chapter,
and eliminates "identification signs" from the list of
permitted signs in "B" Residence Districts.
This Bill is submitted in the interest of clarifying our
sign regulations, and is believed to be in the best interests
of our City.

RE: A proposed ordinance initiated by Councilman Beverlie Beck, Amending
Chapter 21, Article 10, Section 21 -170 of the South Bend Municipal Code
Entitled Permitted Signs by Districts, City of "South Bend
Gentlemen:
The attached petition initiated by Councilman Beverlie Beck, was legally
advertised October 7, and October 8, 1983. The Area Plan Commission gave it a
public hearing on October 18, 1983, at which time the following action was
taken:
Upon a motion by Robert Lehman, being seconded by William Limerick and
unanimously carried, the proposed ordinance initiated by Councilman
Beverlie Beck, Amending Chapter 21, Article 10, Section 21 -170 of the
South Bend Municipal Code Entitled Permitted Signs by Districts, City
of Soutn Bend is sent to the Common Council with a favorable
recommendation.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report. Attached,
for your consideration in the review of this matter, is a copy of the Area Plan
Commission's Staff Report.

COMMON COUNCIL INITIATED #852 -83 October 7, 1983
REQUESTED ACTION: This proposed ordinance would clarify the types
of signs permitted within the "B" Residential
zoning district. Under the terms of this
ordinance, only institutional bulletins "of any
governmental agency, religious group, hospital or
school, located on the premises and bearing only
the information related to the activities
conducted on the premises, persons involved or
other such information" would be allowed to be as
large as 64 square feet. All other
identification signs must be no larger than one
square foot in area.
