ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which ordi-
nance is commonly known as the zoning ordinance of the City of South
Bend, Indiana, be and the same hereby is amended in order that the
zoning classification of the following- described real estate in the
City of South Bend, St. Joseph County, State of Indiana:
1. Out Lot or Block Numbered Nine (9) in Samuel
L. Cottrell's First Addition to the Town of
Lowell, now a part of the City of South Bend.
2. Lots Numbered 13 through 26, both inclusive,
as shown on the recorded Plat of Howard's
Subdivision of the north part of Out Lot
Numbered Eight (8) in Samuel L. Cottrell's
First Addition to the Town of Lowell, now a
part of the City of South Bend.
3. Lots Numbered 1 through 12, both inclusive,
as shown on the recorded Plat of T. E. Howard's
Subdivision of the south part of Out Lot :
Numbered Eight (8) in Samuel L. Cottrell's
First Addition to the Town of Lowell, now a
part of the City of South Bend.
4. All of the vacated east -west and north -south
alleys adjoining and appurtenant to any of the
aforementioned lots, together with all of va-
cated St. Peter Street running north and south
between Cedar Street and vacated Madison Street,
and the north one -half of vacated Madison
Street running east and west between St. Louis
Street and Notre Dame Avenue, all located in
the City of South Bend.

Section 2. This Ordinance shall be in full force and effect
from and after its passage by the Common Council, approval by the

The undersigned hereby makes application and petitions
the Common Council of the City of South Bend, Indiana, to amend the
Zoning Ordinance as herein requested.
(1) The property sought to be rezoned is the Saint Joseph's Medical
Center Complex, located in the 700 and 800 Blocks of East
Madison and East Cedar Streets, South Bend, Indiana.
(2) Name of property owner: Saint Joseph's Medical Center, Inc.,
811 East Madison Street, South Bend, Indiana 46617; telephone:
237 -7222.
(3) It is desired and requested that this property be rezoned from
B- Residential, "B" Height and Area to B- Residential, "G" Height
and Area.
(4) This rezoning is requested so as to allow the following uses:
Hospital, physicians' offices and related uses.
(5) Attached is a copy of (a) legal description of the property;
(b) a list of names and addresses of all property owners within
300 feet of the petition property; (c) self - addressed, stamped
envelopes of all property owners within 300 feet of the petition
property. No site plan drawing is required.

RE: A proposed ordinance of Saint Joseph's Medical Center, Incorporated
to zone from "B" Residential, "B" Height and Area to "B" Residential,
"G" Height and Area, property located at 811 East Madison Street,
City of South Bend
Gentlemen:
The attached rezoning petition of St. Joseph's Medical Center, Incorporated
was legally advertised on July 9, 1983. The Area Plan Commission gave it a
public hearing on July 19, 1983, at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by John
Leszczynski and unanimously carried, the proposed ordinance
and site development plan of Saint Joseph's Medical Center,
Incorporated to zone from "B" Residential, "B" Height and
Area to "B" Residential, "G" Height and Area, property located
at 811 East Madison Street, City of South Bend is sent to
the Common Council with a favorable recommendation as tendered.
PLEASE NOTE that the attached Ordinance has been amended by the petitioner
to include a legal description different than that used for the Common
Council's first reading. The amended Ordinance was the Ordinance legally
advertised and heard by the Area Plan Commission. The original of the
amended Ordinance is attached to this letter.
The deliberations of the Area Plan Commission and points considered in arriving
at the above decision are shown in the minutes of the public hearing, and will
be forwarded to you at a later date to be made a part of this report. Attached,
for your consideration in the review of this matter, is a copy of the Area Plan
Commission's Staff Report.

REQUESTED ACTION: The petitioner is requesting a zone change from
"B" Residential, "B" Height and Area to "B"
Residential, "G" Height and Area to allow for a
"hospital, physicians' offices and related uses ".
EXISTING LAND USE: The site contains a hospital, physicians'
offices and related uses.

Area; to the east are medical offices and
single family houses zoned "B" Residential,
"B" Height and Area; and to the west is a
parking lot, a clinic and single family

Area.
The total site to be rezoned is 340,152
square feet or 7.8 acres.
A site plan is not required for petitions
involving only a change in height and area
