Committee Chair Oliver Davis called to order the Zoning&Annexation Committee meeting at
5:15 p.m.
Substitute Bill No. 38-24—Special Exception at 623 Olive Street
Committee Member Sheila Niezgodski motioned to accept Substitute Bill No. 38-24, which was
seconded by Committee Member Karen White and carried by a vote of five (5) ayes with one (1)
committee member absent.

Citizen Member Stacy Odom-Absent Citizen Member Jordan Giger-Aye
Kari Myers, Zoning Specialist from the Department of Community Investment on the 14th floor
of the County-City building, stated that this bill requests a special exception for restaurant use.
She clarified that, following the last meeting,the focus is on ensuring the use remains more
restaurant-oriented rather than overly commercial. This bill has been forwarded to the committee
from the Board of Zoning Appeals with a favorable recommendation.
Fabiola Garcia,petitioner at 623 South Olive Street, South Bend, IN 46619, stated that this space
will be used to sell a variety of beverages, both cold and hot, as well as food items such as
waffles and crepes.
Committee Vice-Chair Ophelia Gooden-Rodgers asked the petitioner to reiterate what the
restaurant will offer.
Fabiola Garcia responded that the restaurant would function more as a coffee shop.
Committee Member Sheila Niezgodski expressed that these healthy food options are a valuable
addition to the local neighborhood, and she is pleased to see the initiative succeed.
Committee Member White noted that the space was previously used for retail and asked if the
petitioners plan to utilize the entire building.
Fabiola Garcia confirmed that they intend to use the entire building.
Committee Chair Davis held the public hearing, and nobody spoke.
Committee Member Niezgodski motioned to send Substitute Bill No. 38-24 to the Committee of
the Whole with a favorable recommendation, which was seconded by Committee Member White
and carried by a vote of five (5) ayes with one (1) committee member absent.

Bill No. 42-24—Amending Zoning Ordinance for Property Located at 829 South 27'h
Street
Skip Morrell, Principal Development Planner on the 14th floor of the County-City building,
stated that further discussions are needed with the petitioner to clarify the details of this bill
before it is presented to the committee.
Committee Chair Warner held the public hearing, and nobody spoke.
Committee Member White motioned to table Bill No. 52-24 to the Zoning and Annexation
committee meeting on October 28, 2024, which was seconded by Committee Vice-Chair
Gooden-Rodgers and carried by a vote of five (5) ayes with one (1) committee member absent.

Bill No. 52-24—Special Exception at 812 LaSalle Avenue
Kari Myers, Zoning Specialist from the Department of Community Investment on the 14th floor
of the County-City building, stated that this petition requests a special exception for restaurant
use in an Urban Flex (UF) zone. The location is near the South Bend Clinic and St. Joseph High
School and is consistent with the surrounding area. The building has previously been used for
retail and service purposes, and the plan aims to invigorate the area. While it is not located within
the Northeast Neighborhood Plan, it aligns with its goals. This bill has been forwarded to the
committee from the Board of Zoning Appeals with a favorable recommendation.
Mark Kramer, petitioner at 71115 Grafalcon Court, Niles, MI 49120, stated that he has owned
the building for over forty (40) years, during which it has been used as office space. His intention
is to rent out the restaurant space, with the eventual goal of selling it to the restaurant owner.
Committee Chair Warner held the public hearing, and nobody spoke.
Committee Member Niezgodski motioned to send Bill No. 52-24 to the Committee of the Whole
with a favorable recommendation which was seconded by Committee Member White and carried
by a vote of five (5) ayes with one (1) committee member absent.
