Whereas, afterwards an order of sale was duly issued, directed to Dean Bolerjack
then the Sheriff of St. Joseph County, Indiana, commanding him to sell the land hereinafter described, and all
interest, estate, right, and title of the defendants aforesaid therein, or so much thereof as might be necessary,
according to the terms of said decree, to pay and satisfy the judgment and decree aforesaid, with the interest
and costs thereon; and
Whereas, at a sale duly advertised and held on the 6th day of October ?A.D., 1977 ,
conformable to law and said decree, said Dean Sol er jack Sheriff, did first expose to sale at public
auction, the rents and profits for a term not exceeding seven years of said estate of said defendants and each
of them, and receiving no bid therefor, then offered at public auction aforesaid, all the rights, title, and inter-
est in fee simple of the said defendants and each of them in and to said real estate and

Nine Hundred Seventy-seven and 66/100ths ($977.66) did then and there bid the sum of
and no person bidding more, the same was in due form openly struck off and sold to the said
City of South Bend
for the said sum so bid, it being the highest
bidder and that being the highest price bid for the same; and
Whereas, also on the 6th day of October , A. D., 1977 , as required by law,
dean Soler jack then Sheriff as aforesaid, executed to said purchaser a certificate reciting
the foregoing facts and that said purchaser would be entitled to a deed of conveyance therefor, if no redemp-
tion from said sale be made as and within the time fixed by law;

signed Dean Bolerjack , now Sheriff of said St. Joseph County, in consideration of the prem-
ises and the statute so providing, and of the non -redemption by said defendants, or any of them, or any other
person entitled so to do as provided by law, hath GRANTED, BARGAINED, and SOLD, and doth by these
presents, GRANT, BARGAIN, SELL, CONVEY, AND CONFIRM to the said

PURCHASE AGREEMENT
THIS AGREEMENT, entered into this Stday of ,
1989, by and between David Golob, hereinafter referred to as
"Buyer", and the Civil City of South Bend, a municipal corporkJAon of
the State of Indiana, hereinafter referred to as the "City."
WITNESSETH:
WHEREAS, I.C. 36-1-11 establishes procedures for the sale
and rental of real property owned by the City of South Bend; and
WHEREAS, the Board of Public Works is empowered to carry out
the provisions of said statute; and
WHEREAS, the Board has determined that:
1. The highest and best use of certain real property owned
by the City is by sale to an abutting landowner;
2. The cost to the public of maintaining said real property
owned by the City equals or exceeds the established fair market value
of said real property;
3. It is economically unjustifiable to sell said real
property owned by the City in accordance with the procedures set
forth in I.C. 36-1-11-4.
WHEREAS, the Board has determined that the assessed value of
said real property is less than TWO THOUSAND DOLLARS ($2,000.00); and
WHEREAS, the Board appointed a licensed independent
appraiser who appraised the particular real property; and
WHEREAS, based upon the appraisal submitted, the Board has
established an offering price for the property, and published notice
of its intention to sell said property at said price; and
WHEREAS, pursuant to I.C. 36-1-11-5, the Board is empowered
to negotiate and sell said real property to the abutting landowner
who submits the highest offer for said real property; and
WHEREAS, the offer of the Buyer in the amount of Four
Hundred Ten Dollars ($410.00), was offered and accepted as the best
offer for said property.
NOW, THEREFORE, it is agreed by and between the parties
hereto, and for and in consideration of the premises and the mutual
covenants herein contained, as follows:
1. The City agrees to sell and Buyer agrees to buy the
following described property:
Lot 61 as shown on the Second Plat of Northwest Addition to
the City of South Sand, Indiana and morL- commonly known as
1210 McCartney
for the sum of $410.00.
2. Buyer agrees to pay the purchase price and recording fee
in full at the time of closing.
3. Buyer agrees to pay all title and abstract costs
involved in said transaction which it shall desire or request.
4. At the time of closing and after a submission of a
receipt for the total purchase price has been submitted by the
Controller to the Board of Public Works, the Board shall cause a
Quit -Claim Deed to be prepared, which deed shall be signed by the
Mayor and attested to by the City Clerk with the Seal of the City
affixed, which shall then be recorded with the St. Joseph County
Recorder's Office.
5. It is expressly agreed that all terms and conditions of
this contract are included herein, and no verbal agreements of any
kind shall be binding upon the parties, and this contract shall be
binding upon all parties hereto, their heirs, administrators,
executors, successors, and assigns.

Dear Mr. Golob:
Section 36-1-11--5 of the Indiana Code gives the Board of Public
Works the authority to offer for sale City -owned property with an
assessed valuation of less than Two Thousand Dollars ($2,000.00).
Pursuant to that authority, the Board of Public Works has accepted
your bid in the amount of Four Hundred Ten Dollars ($410.00) for the
purchase of the property at 1210 McCartney.
Pursuant to the acceptance of that offer, I am enclosing the
original and two (2) copies of the Purchase Agreement prepared by
this office. Please sign all copies and return them, within ten (10)
days, to the Board of Public Works, 1308 County -City Building, South
Bend, Indiana, 46601., for approval. Upon execution of these
documents, you will be issued a Quit --Claim Deed for the property. A
closing date will then be set for the final transaction.

A more detailed legal description of the parcels and specific
information concerning the size of the parcels, public improve-
ments thereon and the City's offering price is available in the Office
of the Board of Public Works, 1308 County -City Building, South Bend,

Bids to purchase said parcels must be received in the Office of the

on or before APRIL 24, 1989 at 9:30 a.m. At that time, a

WHEREAS, the Board of Public Works of the City of South Bend,
Indiana, has compiled a current detailed inventory of all real
property owned by the City of South Bend; and
WHEREAS, the Board of Public Works has reviewed said inventory
of real property and it finds that certain of the parcels of real
estate now owned by the City of South Bend are not necessary to the
public use and are not set aside by State and City laws for public
purposes; and
WHEREAS, the Board of Public Works finds that each of the
properties described below has an assessed valuation of less than
$2,000.00, that the cost of maintaining said parcels equals or
exceeds the estimated fair market value of the parcels, and that the
highest and best use of the parcels is sale to an abutting
landowner.
WHEREAS, the Board of Public Works now wishes to take the
necessary action to make it possible for the Board, in the future,
to sell said parcels of real estate pursuant to State statutes.
NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of
the City of South Bend, Indiana:
That the parcels of real estate owned by the City
contained in the following list are not necessary
to the public use, are not set aside by State or
City laws for public purposes, that the cost of
maintaining said parcels equals or exceeds the
