ROLL CALL Present: Council Members Luecke, Pfeifer, Kelly, Broden, Varner, Zakrzewski, Coleman, Hosinski Sniadecki Absent: None REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub - committee has inspected the minutes of the December 9, 1997, meeting of the Council and found them correct. Therefore, we recommend the same be approved. Council Member Coleman made a December 9, 1996 be accepted Council Member Hosinski. The SPECIAL BUSINESS /s/ Roland Kelly /s/ David Varner motion that the minutes of the and placed on file, seconded by motion carried. Council President Kelly announced the reorganization meeting of the Council will be January 6, at 5:00 p.m. Council Member Coleman reported that the Community and Economic Development Committee had interviewed prospective members for the Redevelopment Commission. He made a motion to reappoint Robert Hunt, and to appoint Eugenia Schwartz, for a one year term, seconded by Council Member Zakrzewski. The motion carried. RESOLUTION NO. 2429 -96 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMENDING JOSEPH E. KERNAN FOR HIS NINE (9) YEARS OF DEDICATED SERVICE AND - LEADERSHIP AS MAYOR OF THE CITY OF SOUTH BEND, INDIANA Whereas, the South Bend Common Council proudly acknowledges that Joseph E. Kernan has served as Mayor of our fine City for the past nine years; and Whereas, the Council acknowledges that as the Lieutenant Governor -elect for the State of Indiana, Mayor Joe will head the state's economic development efforts and will seek to foster a state that is "safe, attractive, vibrant, inexpensive, strong, fun, stable and healthy ", like the goals he established for the City of South Bend in his State of the City Address to the Council; and Whereas, Mayor Kernan was the first South Bend Mayor to ever win a third four -year term in our City's history, reflecting the popularity and the support of the many programs he and his very able staff have fostered by placing the City on an aggressive mission of being recognized as a model city by the year 2000; and Whereas, some of his many achievements and accomplishments include: the Sister City Program with Czestochowa, Poland; Mayor's Night Out and Mayor's Night In Programs; the Good Neighbors /Good Neighborhoods initiative as well as the multitude of neighborhood programs and revitalized economic commitment to enhance and improve neighborhood activities; stabilizing the REGULAR MEETING DECEMBER 23, 1996 City's financial base by improving the City's bond rating to AA; revitalizing the downtown; the opening of Blackthorn Development Area; the College Football Hall of Fame; and enthusiastically supporting and promoting the South Bend Silver Hawks; and Whereas, the dedication and caring attitude of this special -� public servant, who has built his entire career on trust will continue to instill confidence in our state and our citizens. Because of his efforts, we will "celebrate the dawn of a new millennium ", will "be excited about the prospects:, and will be "ready to tackle all of the challenges and excitement that it will bring." Now, therefore, be it ordained by the Common Council of the City of South Bend, Indiana, as follows: Section I. On behalf of all the citizens of the City of South Bend, Indiana, the Common council hereby publicly commends JOSEPH E. KERNAN for his nine (9) years of dedicated and selfless service to all of the citizens of south Bend, Indiana. Section II. The Common Council notes that under Mayor Joe's leadership the keystone has been his commitment of working together to preserve and enhance our community, with the citizens of our community being the true benefactors of his legacy and vision. Section III. The South Bend Common Council wishes Mayor Joe and his wife Maggie, continued success as they take on state -wide issues, and encourage them to return to our City often, since the welcome mat will always be out. RESOLUTION NO. 2431 -96 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, COMMENDING THOMAS ZAKRZEWSKI, SIXTH DISTRICT COUNCIL MEMBER, FOR HIS 13 YEARS OF DEDICATED SERVICE TO THE CITY OF SOUTH BEND, INDIANA Whereas, the South Bend Common Council proudly acknowledges that Thomas Zakrzewski has served as Sixth District Council Member for the past thirteen years; and Whereas, the Council acknowledges that when Council Member Zakrzewski was first elected he was unable to partake in Holiday Spirits cause he was too young; and Whereas, despite being the youngest Council Member ever elected to serve on the South Bend Common Council, Tom Zakrzewski used his energy, youth, and enthusiasm to pursue many new and innovative causes for the citizens of South Bend, and in particular the residents of the Sixth District; and Whereas, Council Member Zakrzewski has diligently served under Mayor Roger 0. Parent and Mayor Joseph E. Kernan; has held every elected officer position of the Council from Council President and Vice - President to Chairperson of the Committee of the Whole; has chaired the most powerful committees of the Council; and has answered thousands of citizen calls and requests over his thirteen years of service; and Whereas, Council Member Zakrzewski a /k /a "Junk Yard Czar" has faithfully inspected on an annual basis each of the recycling centers wishing to operate in the City; fought hard to ensure the rights and voices of the citizens of the West Side during the debates on the Ethanol Plant; was instrumental in making Coveleski Stadium a reality; challenged the City Administration to focus on a paved alley program which would enhance the older sections of our fine City; championed enforceable truck route legislation, and supported the Belleville Softball Complex which is scheduled to open in 1997 -- -with these just being some of the many vital activities Tom Zakrzewski has dedicated his time and efforts to in his 13 years of service. Now, Therefore, Be it Ordained by the Common Council of the City of South Bend, Indiana, as follows: Section I. On behalf of all of the citizens of the City of South Bend, Indiana, the Common Council hereby publicly commends Thomas Zakrzewski for his thirteen (13) years of dedicated and enthusiastic service to the citizens of South Bend and in particular the residents of the Sixth District and the entire West side. Section II. The Common Council notes that Council Member Zakrzewski just turned 34 years old last week, but is today the "Dean of the Council" by having the longest current tenure on the South Bend Common Council. Section III. The South Bend Common Council wishes Tom well as he takes on career endeavors as the newly elected Treasurer of St. Joseph County; wishes him, his wife, Mindy, and their entire family continued success; and gratefully says Dzienkuje on behalf of all of South Bend!!!! BILL NO. 80 -96 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1615 PORTAGE AVENUE, IN THE CITY OF SOUTH BEND, INDIANA This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Zakrzewski reported that the Zoning and Vacation Committee had met on this bill and recommended it to the Council unfavorable. John Byorni, Area Plan, reported that the petitioners were requesting rezoning for this property in order to allow for a video store. Rick Morgan, attorney for Northwest Bank, indicated this building has been vacant for two years and the bank feels this particular use, a video store, is less intensive than some of the other uses in "C" Commercial. Tim Reynold, regional manager for Family Video, indicated Family Video owns their stores, they take care of the property and have never closed a store. Mike Sculati, 1414 Woodlawn, Charlie Maternowski, 716 Beale; Bill Borders, 946 Roosevelt; Elaine Able, 5102 Kinyon; and Timothy Rosh, 1758 N. Olive, spoke against this rezoning. Council Member Varner made a motion to recommend this bill to the Council unfavorable, seconded by Council Member Zakrzewski. The motion carried. He indicated the 1997 budget was another break -even, however, we feel we will be slightly above the projected figures. Council Member Luecke made a motion to recommend this bill to the Council favorable, as amended, seconded by Council Member Hosinski. The motion carried. BILL NO. 105 -96 A BILL TRANSFERRING MONIES FROM VARIOUS ACCOUNTS TO VARIOUS ACCOUNTS WITHIN DEPARTMENTS WITHIN THE VARIOUS FUNDS OF THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR 1996 BILL NO. 106 -96 A BILL INCREASING APPROPRIATIONS AND DECREASING APPROPRIATIONS WITHIN THE VARIOUS DEPARTMENTS WITHIN THE VARIOUS FUNDS OF THE CITY OF SOUTH BEND, INDIANA FOR THE YEAR 1996 This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Luecke reported that the Personnel and Finance Committee had met on these bills and recommended them to the Council favorable. Jeff Rinard, deputy city controller, made the presentation for the bills. He indicated these bills represented the City's annual year -end transfers and appropriations which are necessary in order that all departments stay within their budgets. Council Member Luecke made a motion to recommend Bill No. 105 -96 to the Council favorable, seconded by Council Member Kelly. The motion carried. Council Member Pfeifer made a motion to recommend Bill No. 106 -96 to the Council favorable, seconded by Council Member Broden. The motion carried.
