Be it remembered that the Common Council of the City of South Bend, Indiana,met in person on
Monday, September 23, 2024, at 7:00 p.m. Council President Sharon McBride called the meeting
to order. Father Ryan Pietrocarlo of St. Adalbert Catholic Church gave the invocation.

Clerk Tirado stated that the Sub-Committee on Minutes has inspected the September 9, 2024,
Common Council meeting minutes and recommended that they be approved.
Councilmember Troy Warner motioned to approve the September 9, 2024 Common Council

SPECIAL BUSINESS
The Council presented a Special Resolution Congratulating the Leadership of South Bend /

Skip Morrell, Principal Development Planner with offices on the 14th floor of the County-City
Building, presented Bill No. 41-24. The owner is Shamrock Reality Group LLC. Bill No. 41-24
requests a rezoning from Urban Neighborhood One(U1)to Urban Neighborhood Three(U3). The
lot located at 734 Notre Dame Avenue is currently vacant. The new development will include four
(4) condo-style units. The Planning Commission's favorable recommendation is subject to a
written commitment stating that the building will not exceed three (3) stories except for rooftop
amenities.
Angela Smith, Senior Staff Planner at Danch Hamer&Associates LLC., 1643 Commerce Drive,
South Bend, IN 46628, spoke on behalf of the petitioners. The project aims to increase the
neighborhood's density.

Erik Horvath, Public Works Director with offices on the 131h floor of the County-City Building,
stated that the legal description for Substitute Bill No. 45-24 had been corrected to better describe
the vacation.
Steven Woolley, petitioner, 902 South Michigan Street, South Bend IN 46601, stated that vacating
the alleys would allow for more space on his property.

Councilmember Tomas Morgan stated that Substitute Bill No. 45-24 was submitted before the new
alley vacation requirements were enacted.
Councilmember Warner stated that both of these alleys are referred to as paper alleys. This means
no physical alley exists; the alleys only exist within the City's records.

the Department of Community Investment's Grants Fund will have a transfer of one million dollars
($1,000,000) to fund new homeownership and home repair programs, and an allocation of one
million, eight hundred and sixty-seven thousand, seven hundred and thirty dollars($1,867,730)for
the Urban Canopy Program.Three million five hundred and one thousand, six hundred and ninety
dollars ($3,501,690) from the Local Income Tax-Public Safety Fund will be used to pay the Police
and Fire Department's salaries. Two hundred thousand dollars ($200,000) from the Water Works
Operations Fund will be implemented in the Water Works Facilities Plan.

Council Vice President Niezgodski stated that Bill No. 50-24 went before the Personnel and
Finance Committee and comes with no recommendation.

James Mueller, Mayor with offices on the 14th floor of the County-City Building, highlighted the
changes in the 2025 budget since the August 14,2024,budget overview. Mayor Mueller stated that
this is the seventh(7th)budget presentation out of eleven(11). Due to state statutes, the budget has
to be passed by November 1, 2024. The Build the Budget campaign received public input at
community events such as Fusion Fest. This is the fourth (4th) year of the Build the Budget
campaign. This year the City has seen record engagement from the public in the budget process
via three-one-three (311) voicemails, online survey responses, and in-person Envelope Wall
participants. In 2024,just over one thousand five hundred (1,500)people participated in the Build
the Budget campaign.The annual Innovation&Technology(I&T) Build the Budget report will be
distributed on September 25, 2024. The five (5) top priorities of the City are resurfacing and
repairing roads, improvements to neighborhood infrastructure, safe and non-violent
neighborhoods, ample affordable housing, and continued investment in the City's parks and trails.
Mayor Mueller stated that inflation and prices have stabilized following the COVID-19 pandemic.
The Federal Reserve has lowered interest rates following the historic increases over the past four
(4) years. Competitive wages continue to climb faster than revenue growth as property taxes and
income taxes lag behind income growth. Mayor Mueller stated that the City has grown its reserves
in the last four (4) years. The state road formula may change in 2025, which would benefit the
City. Mayor Mueller stated that there has been a reduction in projected revenue for property taxes
and income taxes for 2025 based on the Department of Local Government Finances (DLGF)
estimates. The City expects four million dollars ($4,000,000) to six million dollars ($6,000,000)
more revenue than the DLGF estimates. The Mayor's Office budget is increasing by more than
three percent(3%) due to increased fringe benefits and salaries. The I&T budget is increasing due
to the continued installation and management of City cameras as a part of the Real Time Crime
Center(RTCC). Negotiations with the Fire Department are ongoing,the salaries of firefighters are
expected to increase. The City's cash reserves are more than the required fifty percent (50%) of
the General Fund annual operating expenses. Mayor Mueller stated that the 2024 cash reserves are
nearly double the 2020 amount. The projected General Fund deficit for 2025 is ten million eight
Hundred thousand dollars ($10,800,000). Mayor Mueller stated that the City will receive more
revenue than is budgeted, and the departments will not spend their total budgets. This should get
the overall deficit close to zero(0). In 2022, the budgeted deficit was six million and three hundred
thousand dollars($6,300,000),and the City had a surplus in 2022 of two million and seven hundred
thousand dollars($2,700,000). In 2023, the budgeted deficit was thirteen million and one hundred

thousand dollars ($13,100,000), and the City had a surplus in 2023 of nine million and three
hundred thousand dollars ($9,300,000). In 2024, the budgeted deficit was sixteen million and one
hundred thousand dollars ($16,100,000), and the City had a surplus in 2024 of five million and
two hundred thousand dollars ($5,200,000). The General Fund deficit is caused by subsidies for
the Streets Department to increase paving across the City. The gas tax is inadequate to fund the
paving operations of the city as it does not keep up with inflation. The Police Department is fully
staffed with two hundred and fifty-seven (257) sworn officers. The Real Time Crime Center
continues to expand its operations and technology. The upcoming Fire Department negations will
allow for the increased retention of firefighters in the City. The City continues to invest in the City
through parks and neighborhood projects, the Vibrant Places grant, and the Innovation Grants for
Neighborhood Information, Transformation, and Enhancement (IGNITE) grant. The
neighborhood plan for Twyckenham Hills will be completed in 2025.The new twenty-five million
dollar($25,000,000)Martin Luther King Jr. Dream Center(MLK Dream Center)will require more
staffing in 2025. The all-of-the-above housing strategy will continue in 2025. Mayor Mueller
stated that the cost of living adjustments for the salaries of City employes are vital to attracting
and retaining employees. The Climate Action Plan keeps the City's residents healthy and attracts
visitors to parks and other venues.
Councilmember Warner asked what Mayor Mueller thought of the possible State budget changes
with the new State government and stated that the budget needs to be better balanced.
Mayor Mueller stated that many proposals are being made regarding the State budget. Mayor
Mueller stated that the City's best hope is for legislators to listen to their communities and not do
something that causes drastic disruption. The City budget is over fifty percent (50%) of public
safety, so any cuts made would have to include cuts to public safety.
Councilmember Warner stated that the City has thirty-five(35)budget-related meetings,exceeding
other jurisdictions in the surrounding area.
Councilmember Tomas Morgan stated that the City would be pulling from cash reserves for the
first time in a while.
Mayor Mueller stated that the cash reserves will be double what they were in 2020. The City will
spend down the cash reserves to get them closer to the cap.
Councilmember Tomas Morgan congratulated Mayor Mueller on the City's Leadership in Energy
and Environmental Design (LEED) Gold Certification.
Councilmember Lee asked if the City needs to make cuts to the budget and what the first(I") cuts
would be.
Mayor Mueller stated that many temporary programs started with Federal funds. Many are still
operating with City funds but have been scaled back. These discretionary funds would be the first
(1 St)to be rolled back. Mayor Mueller stated that a soft hire freeze has been contemplated for these
programs.

Sue Kesim, 4022 Kennedy Drive, South Bend IN 46614, stated the City has a total debt of four
hundred and sixty-two million dollars ($462,000,000). The City has over sixty-eight (68) active
tax abatements.
Brendan Crumlish, 1091 Riverside Drive, South Bend, IN 46616, stated the City has a higher
budget than the surrounding municipalities.

Amy Hill, General Manager & Chief Executive Officer (CEO) of Traspo, with offices at 1401
South LaFayette Boulevard, South Bend, IN 46613,gave an overview of the 2025 Transpo budget.
Transpo has one hundred and six (106) employees. Transpo operates fifty (50) fixed-route buses
and twenty (20) paratransit vans. The paratransit vans are designed for individuals who may,
because of a disability, not be able to ride the regular fixed route service. There is an application
process for that service that requires medical certification. 2024 is the first (Is`) year with one
hundred percent (100%) of Transpo's fixed route fleet fueled by compressed natural gas (CNG).
The first (Is') CNG buses will be eligible for replacement in 2026. The CNG buses are used for
twelve (12) years before being replaced. The paratransit vehicles can be used for five (5) years
before being replaced. The paratransit vehicles have doubled in cost over the last four(4)years.A
fuel feasibility study is being conducted to be eligible for Federal grants. Technology upgrades
include real-time information, bus tracking, and automated next stop/American with Disabilities
Act (ADA) announcements in 2025. Amy Hill stated that Transpo has been focused on expanding
its ridership programs. The K-12 Summer Travel Program saw a record-setting thirty-seven
thousand (37,000)rides in June, July, and August. Retaining fleet operators has been challenging,
but Transpo is close to being fully staffed. The 2025 budget has increased by sixteen thousand
dollars($16,000)over the 2024 budget. Most of the tax revenue is from property taxes, about four
million dollars ($4,000,000) annually. Two hundred and sixty thousand dollars ($260,000) come
from the excise tax and eight hundred thousand dollars ($800,000) from the local income tax. The
Public Mass Transportation Fund(PMTF)funds all public transportation agencies state-wide.This
funding has not been increased in ten(10)years.The Federal funding will be down nearly twenty
percent (20%) in 2025. It is one dollar($1) to ride the fixed route service and two dollars ($2) for
the paratransit service. It costs Transpo about eight dollars ($8) for a fixed route ride and twelve
dollars ($12) for a paratransit ride. Leased revenue is down as Transpo has one(1)parking garage
left that it leases to the City. That lease will end in 2025, and ownership of the parking garage will
be turned over to the City. Seventy-seven percent (77%) of the Transpo budget are wages and
benefits. The benefits have remained flat due to Transpo being a part of the St. Joseph County
Health Plan. Fuel expenses have remained flat. From 2021 through 2023, Transpo has had clean
financial audits. The operating budget has increased as Transpo has come closer to being fully
staffed.Amy Hill stated that funding uncertainty is always an issue. State and Federal funding for
public transportation is uncertain in the next few years. Ridership continues to increase at ninety
percent (90%) of pre-pandemic levels. The CONNECT Transit Plan will start to be implemented
in 2025.

LLC. Four (4) duplexes will be built on these properties. Property Bros LLC has been building
affordable housing in the City for the last two (2) years. Total private investment has been one

million and four hundred thousand dollars($1,400,000). These lots were vacant and owned by the
City.
Jordan Richardson, 1251 N. Eddy Street, South Bend IN 46617, petitioner, owns Property Bros

Council President McBride thanked the petitioners for their investment in a distressed area.
Councilmember Lee thanked the petitioners for their investment in the first (1st) district.
Tony Ruiz, 837 Garden Lane, South Bend IN 46619, petitioner, thanked the Council for this
opportunity. Tony Ruiz grew up in that neighborhood and is happy to give back to the community.
Jordan Richardson thanked the Council for this opportunity and the investment into a minority-
owned business.
Councilmember Lee asked how necessary the tax abatement is to allow the developers to make
this investment.
Jordan Richardson stated that it is essential for all parties involved. The City saves money by no
longer needing to maintain vacant lots, gains revenue from the new duplex taxes,and houses more
of its residents in well-built homes. For developers tax abatements, it creates an incentive for
investment.

Sue Kesim, 4022 Kennedy Drive, South Bend, IN 46614, spoke in opposition to Bill No. 24-30.
Sue Kesim stated that there is a Tax Increment Financing (TIF) deficit of three million and five
hundred thousand dollars ($3,500,000). Sue Kesim stated that the tax abatements are too long and
too high a percentage.
Erik Glavich stated that an annual tax abatement report is available to the public.
Councilmember Warner stated that TIF does not have a deficit of three million five hundred
thousand dollars ($3,500,000). In TIF, it is uncommon that an allocation is made, and the money
is spent not only in the same year but even years down the road. 300 East LaSalle Apartments was
approved in 2017. The TIF funds were allocated from the 2018 TIF budget and were not spent
until 2021 and 2022. Councilmember Warner stated that you must consider the cash on hand when
looking at TIF. Councilmember Warner noted that this tax abatement does not affect the TIF
budget.
