After the second (2nd)reading, Councilmember Lee requested the committee report. Councilmember Dr. Davis stated that Bill No. 39-24 went before the Zoning and Annexation Committee and comes with a favorable recommendation. Councilmember Lee requested that the petitioner(s) state their name and address and share key points before the council. Skip Morrell, Principal Development Planner with offices on the 141h floor of the County-City Building presented Bill No. 39-24. The owner is Pinnacle Wealth Investments LLC. This Bill is seeking a special exception for 1006 Beale Street allowing for a duplex to be built. The lot is currently vacant.The new building will blend well into the neighborhood and will increase density of the neighborhood. Nick Benninghoff, 332 North Ironwood Drive, South Bend IN 46615, is the petitioner for Bill No. 39-24. Each unit will be eight hundred and seventy (870) square feet, two (2) bedrooms and two (2)bathrooms. Councilmember Lee held the public hearing, and nobody spoke. After the second (2nd) reading, Councilmember Lee requested the committee report. Council Vice President Niezgodski stated that Bill No. 40-24 went before the Public Works & Property Vacation Committee and comes with a favorable recommendation. Councilmember Lee requested that the petitioner(s) state their name and address and share key points before the council. The petitioner was absent,the Council delayed the vote to give time for the petitioner to arrive. Councilmember Dr. Davis motioned to delay the vote for Bill No. 40-24 until the end of the current meeting, which was seconded by Council Vice President Niezgodski and carried by a vote of nine (9) ayes. This Bill would vacate an alley to the north of the Morris Perfonning Arts Center which is currently used as a pedestrian walkway from the parking lot in the rear of the facility. Councilmember Lee held the public hearing, and nobody spoke. The Common Council doesn't select or approve contracts for vendors or contractors.The conflict of interest forms from each Council Member is on file with the City Clerk's office and is available when the State Board of Accounts audits the City in the spring. The City Controller stated that the State Board of Accounts has not identified any conflicts with this Council. 9 REGULAR MEETING September 09, 2024 NEW BUSINESS Councilmember Lee thanked the code enforcement officers for their work in the first (1st) district. Carlos Leyva stated that the Adam's Highschool boys' cross-country team won the City championship coached by Savino Rivera. Sarah Foster, 1138 College Street, South Bend IN 46628, spoke regarding a matter that occurred following the May 13, 2024 Common Council meeting.
