MAY 12, 1997
Be it remembered that the Common Council of the City of South
Bend met in the Council Chambers of the County -City Building on
Monday, May 12, 1997, at 7:00 p.m. The meeting was called to
order and the Pledge to the Flag was given.

REPORT FROM THE SUB - COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
The sub - committee has inspected the minutes of the April 28,
meetings of the Council and found them correct.
Therefore, we recommend the same be approved.

Council Member Coleman made a motion that the minutes of the
April 28, 1997, meeting be accepted and placed on file, seconded
by Council Member Hosinski. The motion carried.
CITY REPORTS
Bob Allen, director of information technologies, reported on the
upgrades to the AS400, which were done by Linda Schmidt and Bob
Evans on weekends, thus eliminating downtime. He also reported
on the Novell networking, indicating that Century Center, Bureau
of Planning, the Building Department, Bureau of Housing, City
Clerk's Office, Olive Street pumping station, Municipal Services
and Parks, still have to be done. He gave statistics on the
City's Web Page; discussing the number of hits, users, countries,
and session length. He indicated they would be putting the
Council's agenda on the internet sometime in the near future.
Council Member Coleman made a motion to resolve into the
Committee of the Whole, seconded by Council Member Hosinski. The
motion carried.
COMMITTEE OF THE WHOLE
Be it remembered that the Common Council of the City of South
Bend met in the Committee of the Whole at 7:15 p.m. with nine
members present. Chairman Coleman presiding.
BILL NO. 38 -97 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH
BEND, INDIANA, ANNEXING TO THE CITY OF SOUTH BEND
CERTAIN TERRITORY CONTIGUOUS THEREWITH LOCATED IN
CENTRE AND PENN TOWNSHIPS, ST. JOSEPH COUNTY,
INDIANA (EMRO /NDCU ANNEXATION)
Council Member Hosinski made a motion to continue this bill, at
the request of the petitioner, until May 27, seconded by Council
Member Aranowski. The motion carried.

This being the time heretofore set for public hearing on the
above bill, proponents and opponents were given an opportunity to
be heard. Council Member Varner reported that the Public Works
and Property Vacation Committee had met on this bill and
recommended it to the Council favorable. Ken Fedder, attorney
for the petitioner, made the presentation for the bill. He
indicated the petitioner, the abutting property owner, as well as
the remaining affected property owners have agreed this alley
should be closed. He reported that the alley in question has
been a route for people the neighbors do not want in their area,
and there has also been vandalism. Council Member Varner made a
motion to recommend this bill to the Council favorable, seconded
by Council Member Aranowski. The motion carried.
BILL NO. 12 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY
LOCATED ON FELLOWS STREET AT THE INTERSECTION WITH
VACATED KEASEY STREET IN THE CITY OF SOUTH BEND,
INDIANA
This being the time heretofore set for public hearing on the
above bill, proponents and opponents were given an opportunity to
be heard. Council Member Hosinski made a motion to accept the
substitute bill on file with the City Clerk, seconded by Council
Member Kelly. The motion carried. Council Member Hosinski
reported that the Zoning and Vacation Committee had met on this
bill and recommended it to the Council favorable. John Byorni,
Area Plan, reported that the petitioners were requesting this
change of zoning to "PHC" to allow for a medical clinic. He
indicated this property was vacant land totaling 2.8 acres, which
is directly south of the new Family and Children's Center. He
reported that the Area Plan Commission recommended this zoning to
the Council favorable. Michael Hardy, attorney, made the
presentation for the bill. He indicated this bill and site
development plan of Family & Children's Center Properties
Management and the South Bend Redevelopment Commission to zone
this property to "PHC", in order that Memorial Health Systems can
construct a clinic. He reported this zoning was compatible with
the other uses in the area. Council Member Kelly made a motion
to recommend this bill to the Council favorable, as amended,
seconded by Council Member Broden. The motion carried.
BILL NO. 17 -97
A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY
LOCATED ON THE 1600 BLOCK OF N. MAPLEWOOD STREET,
800 FEET NORTH OF LINCOLN WAY AVENUE IN THE CITY
OF SOUTH BEND, INDIANA
This being the time heretofore set for public hearing on the
above bill, proponents and opponents were given an opportunity to
be heard. Council Member Hosinski reported that the Zoning and
Vacation Committee had met on this bill and recommended it to the
Council favorable. Council Member Hosinski made a motion to
accept the substitute bill on file with the City Clerk, seconded
by Council Member Kelly. The motion carried. John Byorni, Area
Plan, reported that the petitioners were requesting this rezoning
in order to build a transmitter tower. He indicated that the
Area Plan Commission recommended this to the Council favorable,
however, this should not mean that industrial development is
appropriate in residentially zoned areas, however, this property
is located within the Airport 2010 project. Charles Hayes, the
petitioner, made the presentation for the bill. He advised his
company was in the process of constructing this type of a tower
and transmitters at specified locations in the area, which will
relay signals for telecommunications. Council Member Aranowski
made a motion to recommend this bill to the Council favorable, as
amended, seconded by Council Member Pfeifer. The motion carried.
BILL NO. 18 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY
LOCATED AT 17924 STATE ROAD 23, IN THE CITY OF
SOUTH BEND, INDIANA

above bill, proponents and opponents were given an opportunity to
be heard. Council Member Hosinski reported that the Zoning and
Vacation Committee had met on this bill and recommended it to the
Council favorable. Council Member Pfeifer made a motion to
accept the substitute bill on file with the City Clerk, seconded
by Council Member Hosinski. The motion carried. John Byorni,
Area Plan, reported the petitioners were requesting a change of
zoning to "0" Office, in order to use the existing structure as
an office. He advised the Area Plan Commission recommends this
to the Council favorable. Bernard Feeney, land surveyor, made
the presentation for the bill. He indicated this home is located
at the southwest corner of SR 23 and Maplelane Ave., and will act
as a buffer between the "C" commercial and the residential area
to the east. He advised that screening will be provided.
Council Member Pfeifer made a motion to recommend this bill to
the Council, as amended, seconded by Council Member Broden. The
motion carried.
BILL NO. 27 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY
GENERALLY LOCATED BETWEEN ROGERS STREET ON THE
NORTH, WASHINGTON STREET ON THE SOUTH, OLIVE
STREET ON THE EAST, AND KALEY STREET AND KALEY
STREET EXTENDED ON THE WEST, CITY OF SOUTH BEND,
INDIANA
This being the time heretofore set for public hearing on the
above bill, proponents and opponents were given an opportunity to
be heard. Council Member Hosinski reported that the Zoning and
Vacation Committee had met on this bill and recommended it to the
Council favorable. John Byorni, Area Plan, indicated this was an
Area Plan initiated petition to "A" Residential to allow the
appropriate zoning, as a large portion of the area is single
family homes. He indicated that Economic Development wants to
make this a residential impact area. Mike Urbanski, owner of
Garden Homes, indicated this area on Linden is a stable
neighborhood and we feel new construction would improve the area.
Lee Cotton, Planning and Neighborhood Development, spoke in favor
of this rezoning. Council Member Hosinski made a motion to
recommend this bill to the Council favorable, seconded by Council
Member Pfeifer. The motion carried.
BILL NO. 37 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY
GENERALLY LOCATED AT THE NORTHEAST CORNER OF NEW
ENERGY DRIVE AND S.R. 23 IN THE CITY OF SOUTH
BEND, INDIANA
This being the time heretofore set for public hearing on the
above bill, proponents and opponents were given an opportunity to
be heard. Council Member Hosinski reported that the Zoning and
Vacation Committee had met on this bill and recommended it to the
Council favorable. John Byorni, Area Plan, reported this was an
Area Plan initiated petition to "D" Light Industrial to allow for
the appropriate zoning for property annexed into the City. He
indicated this property presently is vacant land. He advised
that the Area Plan Commission sends this petition with a
favorable recommendation. Kurt Young, 50563 Dusty Trails,
indicated they planned to purchase this property, and build an
office. He advised they would like to develop an industrial park
utilizing New Energy Dr. Harry Grzeskowiak, 2606 S. Kaley, spoke
against zoning, indicating there is already too many trucks
coming into the area and there have been two accidents with
school buses. Edgar Kurzhal, 2645 Prairie, spoke against this
zoning. Council Member Hosinski made a motion to recommend this
bill to the Council favorable, seconded by Council Member Varner.
The motion carried.

RESOLUTION NO. 2A58 -97 A RESOLUTION OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND DESIGNATING
CERTAIN AREAS WITHIN THE CITY OF SOUTH
BEND, INDIANA, COMMONLY KNOWN AS 314 E.
BROADWAY AS RESIDENTIALLY DISTRESSED
AREAS FOR PURPOSES OF A FIVE (5) YEAR
REAL PROPERTY RESIDENTIAL TAX ABATEMENT
FOR AMERICAN DREAM HOMES, INC.
WHEREAS, a Statement of Benefits and a petition for real property
tax abatement.has been submitted to and filed with the City Clerk
for consideration by the Common Council of the City of South
Bend, Indiana requesting that the areas commonly known as 314 S.
Broadway, South Bend, Indiana, and which are more particularly
described as follows:
Lot numbered three hundred twenty -nine (329) as shown on the
recorded Plat of Wenger & Kreighbaum's First Broadway
Addition, recorded in the office of the Recorder of St.
Joseph County, Indiana, in Plat Book 9, page 74.
Lot Numbered three hundred thirty (330 as shown on the
recorded Plat of Wenger & Kreighbaum's First Broadway
Addition, recorded in the Office of the Recorder of St.
Joseph County, Indiana, in Plat Book 9, page 74,
together now known as 315 E. Broadway Street and having tax key
numbers 18- 7013 -0499 and 18- 7013 -0500, respectively, be
designated as Residentially Distressed Areas under the provisions
of Indiana Code 6 -1.1 -12.1 et seq., and South Bend Municipal Code
Sections 2 -76 et seq., and;
WHEREAS, the Department of Community and Economic Development has
concluded an investigation and prepared a report with information
sufficient for the Common Council to determine that the areas
qualify as Residentially Distressed Areas under Indiana Code 6-
1.1 -12.1, et sea., and South Bend Municipal Code Sections 2 -76,
et sea., and has further prepared maps and plats showing the
boundaries and such other information regarding the areas in
question as required by law; and
WHEREAS, the Community and Economic Development Committee of the
Common Council has reviewed said report and recommended to the
Common Council that the areas qualify as Residentially Distressed
Areas.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City
of South Bend, Indiana, as follows:
SECTION I. The Common Council hereby determines and finds that
the petition for real property tax abatement and the Statement of
Benefits form meet the requirements of Indiana Code 6 -1.1 -12.1 et
sue., for tax abatement. —
SECTION II. The Common Council hereby determines and finds the
following:
A. At least thirty -five percent (35 %) of the parcels are
currently vacant;
B. A significant number of dwelling units within the areas
are not permanently occupied or a significant number of
parcels in the areas are vacant land;
C. A significant number of dwelling units in the areas are:
I. the subject of an order issued under IC 36 -7 -9; or
ii. evidencing significant building deficiencies;
D. The areas have experienced a net loss in the number of
dwelling units, as documented by census information, local
building and demolition permits, or certificates of
occupancy, or the areas are owned by Indiana or the
United States.
E. The areas (plus any areas previously designated) do not
exceed ten percent (10 %) of the total area within the
designating body's jurisdiction.
F. That the description of the proposed redevelopment meets
the applicable standards for such development.
G. That the estimate of the value of the redevelopment is
reasonable for projects of this nature;
H. That the other benefits about which information was
requested are benefits that can be reasonably expected to
result from the proposed described redevelopment; and
I. That the totality of benefits is sufficient to justify
the requested deduction, all of which satisfy the
requirements of Indiana Code 6- 1.1- 12.1 -3.
SECTION III. The Common Council also hereby determines and finds
the following:
A. The deduction will not be allowed unless the dwelling is
rehabilitated to meet local code standards for habitability.
B. The deduction will not be allowed unless the dwelling
rehabilitation is completed within five (5) calendar years
from the date of the adoption of this Resolution by the
Common Council.
SECTION IV. The Common Council hereby determines and finds that
the proposed described redevelopment can be reasonably expected
to yield benefits identified in the Statement of Benefits and the
petition for real property tax abatement consideration and that
the Statement of Benefits form prescribed by the State Board of
Accounts are sufficient to justify the deduction granted under
Indiana Code 6 -1.1- 12.1 -3.
SECTION V. The Common Council hereby accepts the report and
recommendation of the Community and Economic Development
Committee that the areas herein described be designated as
Residentially Distressed Areas and hereby adopts a Resolution
designating these areas as Residentially Distressed Areas for
purposes of real property tax abatement.
SECTION VI. The designation as a Residentially Distressed Areas
shall be limited to five (5) calendar years from the date of the
adoption of this Resolution by the Common Council.
SECTION VII. The Common Council hereby determines that the
property owner is qualified for and is granted property tax
deduction for a period of five (5) years.

SECTION VIII. The Common Council directs the City Clerk to cause
notice of the adoption of this Declaratory Resolution for Real
Property Tax Abatement to be published pursuant to Indiana Code
5 -3 -1 and Indiana Code 6 -1.1- 12.1 -2.5, said publication providing
notice of the public hearing before the Common Council on the
proposed confirming of said declaration.
SECTION IX. Pursuant to Indiana Code 6 -1.1- 12.1 -2, the
rehabilitation must meet all local code standards for
habitability as a specific condition of having such properties be
designated as residentially distressed areas.
SECTION X. This Resolution shall be in full force and effect
from and after its adoption by the Common Council and approval by
the Mayor.

A public hearing was held on the resolution at this time.
Council Member Broden reported that the Community and Economic
Development Committee had met on this resolution and recommends
it to the Council favorable. Juan Maninault, Work Force
Development, indicated he was representing American Home Dreams,
Inc., made the presentation for the resolution. He indicated the
petitioners were building a single family home at a value of
$65,000 on one of eight available properties on East Broadway.
Mike Urbanski, Garden Homes, spoke in favor of this resolution.
Council Member Broden made a motion to adopt this resolution,
seconded by Council Member Varner. The resolution was adopted by
a roll call vote of nine ayes.
RESOLUTION NO. 2_459 -97 A RESOLUTION OF THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, DESIGNATING
CERTAIN AREAS WITHIN THE CITY OF SOUTH
BEND COMMONLY KNOWN AS 1525 W. WESTERN
AN ECONOMIC REVITALIZATION AREA FOR THE
PURPOSE OF A THREE YEAR REAL PROPERTY
TAX ABATEMENT FOR COMMUNITYWIDE FEDERAL
CREDIT UNION
WHEREAS, a petition for real property tax abatement has been
filed with the City Clerk for consideration by the Common Council
of the City of South Bend, Indiana requesting that the area
commonly known as 1525 W. Western, South Bend, Indiana, and which
is more particularly described as follows:
Lot No. 1 Goodwill /CommunityWide Minor Subdivision of Lot 3,
Goodwill Industries minor part of the northeast quarter of
Section 10, Township 37 North, range 2 east, City of South
Bend, Portage township, St. Joseph County.
and which has Key Number 18 4096 358113 be designated as an
Economic Revitalization Area under the provisions of Indiana Code
6 -1.1- 12.1 -1 et. seq. and South Bend Municipal Code Sections 2 -76
Et Seq.
Whereas, the Department of Economic Development has
concluded an investigation and prepared a report with information
sufficient for the Common Council to determine that the area
qualifies as an Economic Revitalization Area under Indiana Code

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. The Common Council hereby determines and finds that
the Petition for Real Property Tax Abatement and the Statement of
Benefits form completed by the Petitioner meet the requirements
of Indiana Code 6 -1.1- 12.1 -1 et seq., and qualifies under the
relevant provisions of South Bend Municipal Code Sections 2 -76 et
seq., for tax abatement.
SECTION II. The Common Council hereby determines and finds the
following:
A. That the description of the proposed redevelopment or
rehabilitation meets the applicable standards for such
development.
B. That the estimate of the value of the redevelopment or
rehabilitation is reasonable for projects of this nature;
C: That the estimate of the number of individuals who will
be employed or whose employment will be retained by the
Petitioner can reasonably be expected to result from the
proposed described redevelopment or rehabilitation;
D. That the estimate of the annual salaries of those
individuals who will be employed or whose employment will be
retained by the Petitioner can be reasonably expected to
result from the proposed redevelopment or rehabilitation.
E. That the other benefits about which information was
requested are benefits that can be reasonably expected to
result from the proposed described redevelopment or
rehabilitation; and
F. That the totality of benefits is sufficient to justify
the requested deduction, all of which satisfy the
requirements of Indiana Code 6 -1.1- 12.1 -3.
SECTION III. The Common Council hereby determines and finds that
the proposed described redevelopment or rehabilitation can be
reasonably expected to yield benefits identified in the Statement
of Benefits set forth as Sections I through II of the Petition
for Real Property Tax Abatement Consideration and that the
Statement of Benefits form prescribed by the State Board of
Accounts are sufficient to justify the deduction granted under
Indiana Code 6 -1.1- 12.1 -3.
SECTION IV. The Common Council hereby accepts the report and
recommendation of the Human Resources and Economic Development
Committee that the area herein described be designated an
Economic Revitalization Area and hereby adopts a Resolution
designating this area as an Economic Revitalization Area for
purposes of real property tax abatement.
SECTION V. The designation as an Economic Revitalization Area
shall be limited to two (2) calendar years from the date of the
adoption of this Resolution by the Common Council.
SECTION VI. The Common Council hereby determines that the
property owner is qualified for and is granted property tax
deduction for a period of three (3) years.
SECTION VII. The Common Council directs the City Clerk to cause
notice of the adoption of this Declaratory Resolution for Real
Property Tax Abatement to be published pursuant to Indiana Code
5 -3 -1 and Indiana Code 6 -1.1- 12.1 -2.5, said publication providing
notice of the public hearing before the Common Council on the
proposed confirming of said declaration.

SECTION VIII. This Resolution shall be in full force and effect

- Council Member Borden reported that the Community and Economic
Development Committee had met on this resolution and-recommended
it to the Council favorable. Ralph Caruso, 105 E. Jefferson, a
reporesentative of CommunityWide Credit Union, informed the
Council they intended to construct a building on what is
currently undeveloped property, which will be used for a credit
union. Council Member Coleman made a motion to adopt this
resolution, seconded by Council Member Sniadecki. The resolution
passed by a roll call vote of nine ayes.

NEW BUSINESS
Council Member Broden announced there would be a neighborhood
meeting regarding the rezoning of St. Michael's church at
Jefferson and Ironwood this Wednesday, May 14, at 7:00 p.m.
PRIVILEGE OF THE FLOOR
Mike Urbanski, Garden Homes, indicated that several contractors
are committed to building home in the City and unless the
property owner gets a tax abatement the taxes on a $65,000 are
approximately $2,305. He indicated the average person building
in the inner -city cannot afford the taxes.
Jim Cierzniak, 1156 E. Victoria, spoke regarding the new building
downtown. He congratulated the Redevelopment staff. He
questioned why there has not been more publicity regarding this
project.
Pat Bryan, 515 E. Monroe, indicated she decided to come to the
County -City Building in her motorized wheelchair from Karl King
Towers and in many areas there were no curb ramps.
There being no further business to come before the Council
unfinished or new, Council Member Kelly adjourned the meeting at
8:40 p.m.
