GAMMON t,cr v�—r f 19 0 BILL NO. 33 -84 Ordinance No. 7343 -84 AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, (Chapter 21, Municipal Code), (Lincolnway East, South Bend, St..Joseph County, Indiana). STATEMENT OF PURPOSES AND INTENT TO ESTABLISH an Historic Preservation District, to be known as the Lincolnway East'Historic District, with such uses as permitted in Section2l -36.1 of the Municipal Code of the City of South Bend, such District having been recommended by the Historic Preservation Commission of South Bend and St. Joseph County, for the purpose of preserving the architectural, historical, and cultural significance and educational value of the described area. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION I. Ordinance No. 4990 -68, as amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: A parcel of land being a part of the West Half of the Northwest Quarter of Section 9, Township 37 North, Range 2 East, Portage Township, St. Joseph County, Indiana and being more particularly described as follows: Beginning at the Northwest corner of Lot J of Leer's Survey, thence Southeast along the South bank of the St. Joseph River to the Northwest corner of William Rupel's First Addition, thence South along the West boundary of William Rupel's First Addition, thence Northwest along the South right -of -way line of the alley parallel and just north of the Conrail Railroad Tracks to the point of intersection with the Western boundary line of Lot BB of Leer's Survey extended south to the south right -of -way line of said alley, thence Northeast along the Western boundary of Lot BB across Lincolnway East to and along the Western boundary of Lot J to the Northwest corner of said Lot and the place of beginning. Including but not limited to Lots 2 through 17, 33, 34, BB, J through V; J.H. Kelsey's Sub of Lot 13 of Leer's Survey; Delmar C. Leer's Sub of Lot 5 and part of W of Leer's Survey; Kinzie and Good's Sub in Lot 1 of Jacob Leer's Sub; and the river lots across from said properties. BE AND THE SAME IS HEREBY established as an Historic Preservation district with such uses as permitted in Section 21 -36.1 of the Municipal Code of the City of South Bend, Indiana, and shall be designated the Lincolnway East Historic District. SECTION 2. The Historic Preservation Commission of South Bend and St. Joseph County shall adopt guidelines for the Lincolnway East Historic District. SECTION 3. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor and legal publication. JOHNSON Executive Director (219) 284 -9571 4i Re: An ordinance initiated by Councilman Beverlie Beck to establish an Historic Preservation District for Lincolnway East, located along Lincolnway East, from Miami Street to Vernon Street, City of South Bend Gentlemen: The attached ordinance initiated by Councilman Beverlie Beck was legally advertised May 4, and May 5, 1984. The Area Plan Commission gave it a public hearing on May 15, 1984, at which time the following action was taken: Upon a motion by Robert Lehman, being seconded by Joseph Serge and unanimously carried, the proposed ordinance initiated by Councilman Beverlie Beck to establish an Historic Preservation District for Lincolnway East, located along Lincolnway East, from Miami Street to Vernon Street, City of South Bend is sent to the Common Council with a favorable recommendation PLEASE NOTE that the attached Ordinance has been amended by the petitioner to include a legal description different than that used for the Common Council's first reading. The amended Ordinance was the Ordinance legally advertised and heard by the Area Plan Commission. The original of the amended Ordinance is attached to this letter. The deliberations of the Area Plan Commission and points considered in arriving at the above decision are shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of this report. Attached, for your consideration in the review of this matter, is a copy of the Area Plan Commission's Staff Report. Sincerely, Richard S. The proposed district lies between the St. Joseph River on the north and the Penn Central Railroad on the south. The proposed eastern boundary is approximately 145 feet west of Vernon Street, and the proposed western boundary is approximately 523 feet east of Miami Street as measured along Lincolnway East. The current zoning of the petition area is "B" Residential, "A" Height and Area, and no changes to this zoning classification are proposed. EXISTING, LAND USE: The petition area contains single family houses, a doctor's of =ice, a dentist's office, an insurance agency, a day care center, and a floral shop. SOUNDING LAND USE AND ZONING: Located to the east is a dentist's office and single family houses zoned "B" Residential, "A" Height and Area; to the south across the Pean Central Railroad tracks are single family and multiple family houses zoned "B" Residential, "A" Height and area; to the west is a business office zoned "C" Commercial, "A" Height and Area; and to the north is the St. Joseph River. � �k ALL ClQlTEl ST.
