AN ORDINANCE AMENDING ORDINANCE NO. 4990 -68,
AS AMENDED, COMMONLY KNOWN AS THE ZONING
ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA
(Chapter 21, Municipal Code).
BE IT ORDAINED by the Common Council of the City of South
Bend, Indiana:
Section 1. Ordinance No. 4990 -68, as amended, which ordinance
is commonly known as the Zoning Ordinance of the City of South Bend, Indiana,
be and the same hereby is amended in order that the zoning classification of
the following described real estate in the City of South Bend, St. Joseph
County, State of Indiana:
All of Block Lettered "A" as shown on the recorded Plat of Garden
Village Second Unit Addition, in the City of South Bend, together
with that part of a 7 foot vacated alley, more particularly
described as follows: Beginning at a point 136 feet !nest of the
Northeast corner of Lot No. 1010 as shown on the recorded Plat
of LaSalle Park Second Addition to the City of South Bend; thence
South 90 feet; thence West 7 feet; thence North 170 feet; thence

Re: A proposed ordinance and site development plan of Sylvester and Susan
Klusczinski to zone from "C" Commercial, "E" Height and Area to "D" Light
Industrial, "E" Height and Area, property located at 3921 W. Western
Avenue, City of South Bend
Gentlemen:
The attached rezoning petition of Sylvester and Susan Klusczinski was legally
advertised April 6 and 7, 1984. The Area Plan Commission gave it a public
hearing on April 17, 1984, at which time the following action was taken:
Upon a motion by Joseph Serge, being seconded by C. J.
Witz and unanimously carried, the proposed ordinance
and site development plan of Sylvester and Susan
Klusczinski to zone from "C" Commercial, "E" Height
and Area to "D" Light Industrial, "E" Height and Area,
property located at 3921 W. Western Avenue, City of
South Bend is sent to the Common Council with a 7
favorable recommendaton, subject to a Final Site Plan
meeting the recommendations of the City Engineer.
PLEASE NOTE that the attached Ordinance has been amended by the petitioner to
include a legal description ditferent than that used for the Common Council's
first reading. The amended Ordinance was the Ordinance legally advertised and
heard by the Area Plan Commission. The original of the amended Ordinance is
attached to this letter.
The above recommendation is made subject to a final site plan.

arriving at the above decision are shown in the minutes of the public hearing,

The petitioner is requesting a zone change from
"C" Commercial, "E" Height and Area to "D.' Light
Industrial, "E" Height and Area to allow for a
"secondary finishing operation of premolded
plastic parts in production for automotive,

EXISTING LAND USE:
The property contains a vacant commercial
bu7iding.
SURROUNDING LAND USE AND
ZONING: LocaTed to the north is a single family
house zoned "A" Residential, "A" Height and
Area; to the east are single family houses
zoned "B" Residential, "A" Height and Area,
and a car wash facility zoned "C"
Commercial, "E" Height and Area; to the
south is an auto and truck repair garage
zoned "C" Commercial, "E" Height and Area;
and to the west is a vacant commercial
building and the Z. B. Falcons Lodge, zoned
"C" Commercial, "E" Height and Area.
ACCESS:
Access to the site is from Western and
Sheridan Avenues.
DRAINAGE:
Seven 1800 gallon drywelis are proposed for
storm drainage.
Dom:
The total site to be rezoned is 41,990
square feet. Of that, the building occupies
12,000 square feet or 28.6$ of the site and
the parking and drives occupy 29,990 square
feet or 71.4% of the site.
SITE PLAN:
The site plan Is preliminary.
AGENCY COMMENTS:
The City Engineer had the following
comments: 1. City water and sanitary
sewers are available to the site. 2. Storm
water must be retained in dry wells. 3. We
would request that the western most driveway
on Western Avenue be closed.
