3, NEW BUSINESS
a. Authorit a roval re ested for Petition to Vacate Public
Right-of-Wav. (Old Cleveland Road)
Mrs. Kolata explained that now that the first phase of
Nimtz Parkway is completed and open for use, we would: like
to vacate that portion of Old Cleveland between Mayflower
and the U.S. 31 By-pass. The Redevelopment Authority and
St. Joseph County Airport Authority are the adjacent
property owners. The property needs to be vacated to
build Blackthorn Golf Course. The Redevelopment Authority
needs to petition for the vacation and the Airport
Authority will approve the petition at its December., 30
meeting. The Common Council will consider the petition
sometime in January.

Upon a motion by Mr. Fewell, seconded by Mr. Wroblewski
and unanimously carried, the Authority approved the
Petition to Vacate Public Right-of-Way. (Old Cleveland
Road)
b. Authority annroval requested for Contract for enaineerina
services in the Airt~ort Economic Development Area
(eastern portion of Nimtz Parkway)
Mrs. Kolata explained that we previously had some
engineering work done to design the eastern portion of
Nimtz Parkway, but would like to have it re-designed to
change its location. The relocation would not require the
purchase of any additional right-of-way and would open up
the basbeelesslthanbpurchasingethesrightrofawaygfrom
shou
several different property owners.
Ken Herceg & Associates has proposed to do the work at an
hourly rate not to exceed $68,645.
Mrs. Kolata noted that we have applied for additional
• funds from the Transportation Improvement Fund to build
phase two of Nimtz Parkway and would like to have the
plans in place if and when we receive the funds for
construction.
Upon a motion by Mr. Fewell, seconded by Mr. Wroblewski
and unanimously carried, the Authority approved the
Contract with Ken Herceg & Associates for engineering
services in the Airport Economic Development Area.

Mrs. Kolata explained items 3.c and 3.d. together. When
the Airport Authority transferred title to its land to the
Redevelopment Authority for construction of the golf
course, we got title to 50 feet along the southern
boundary that we had not intended to take title to. The
Quit Claim Deed returns this 50 foot strip to the Airport
Authority. The Perpetual Easement on the west side of the
golf course is a 60 foot strip to provide the Airport
Authority with enough land for a road to serve the soccer
fields being developed south of the golf course. The
Airport Authority will maintain the road.

Upon a motion by Mr. Wroblewski, seconded by Mr. Fewell
and unanimously carried, the Authority approved the Grant
of Perpetual Easement to the St. Joseph County Airport
Authority for land in the Airport Economic Development
Area.
