AN ORDINANCE AMENDING CHAPTER 17 OF THE
MUNICIPAL CODE OF THE CITY OF SOUTH BEND,
INDIANA, BY THE AMENDING OF ARTICLE 7,
COMMONLY KNOWN AS SEWER SERVICE FUND AND
CHARGES.
STATEMENT OF PURPOSE AND INTENT
In 1980, the South Bend Common Council passed Ordinance
No. 6830 -80 which established a sewer service fund and related
charges which would be used for the repair of a sewer service consistent
with the ordinance.
Since the passage of this ordinance, it has been determined
that the deductible amount of $1,000.00 payable by the owner of the
private sewer is no longer necessary, and that said amount should be
reduced to $500.00.
The Common Council believes that the proposed amendment is
in the best interest of the City.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. Chapter 17, Article 7, of the Municipal Code of
the City of South Bend is hereby amended to read as follows:
Sec. 17 -58. Application of funds.
Funds collected under this article shall be used for
the payment of all costs in excess of- ewe- hesa�el- d��las-
f$47609 799} five hundred dollars ($500.00) which the City
declares to be directly attributable to the repair of a
private sewer service. Said costs shall not include any
charges associated with the removal or replacement of any
trees, shrubbery, plants, lawns, sprinkler systems, or other
landscaping features on public or private property; and
shall not be responsible for any expenses incurred in
tunneling under and /or replacing any hard surface ir,1.provements
such as bituminous, concrete, or brick driveways, patios,
sprinkler systems, gas grills, utility lines, foundations,
and any other surface or subsurface improvements found on
public or private property. Said costs shall include charges
associated with the removal and /or replacement of public
streets, curbs and walks.
Sec. 17-60. Charges to private sewer owner; payment.
(a) The owner of the private sewer shall be responsible to
pay to the City of South Bend the first- e��- ie�sae1- e1e��as-
i$ }7989799} -five hundred dollars ($500.00) of cost incurred
for all work as allowed under section 17 -58, "Application of
funds."
(b) Payment shall be due the City of South Bend within three
hundred sixty -five (365) days of date of invoice by the
Controller of the City of South Bend. Failure to pay as required
herein shall constitute a lien upon the property in favor of
the City of South Bend.
SECTION II. This ordinance shall be in full force and effect
July 15, 1983, after passage by the Common Council and approval by the Mayor.
